Melvin Dinner, being first duly sworn upon oath, deposes and
says: That he is of legal age and was acquainted with Donald R.
Uhrich during his lifetime. That the said Donald R. Uhrich, who
departed this life on June 23, 1994, referred to in the standard
certificate of death attached hereto as Donald R. Uhrich, was one
and same person as Donald R. Uhrich, who at the time of his death
was the owner in joint tenancy with Shirley Ann Uhrich of the
following described property situate in the County of Weld, State
of Colorado, to-wit:
NEB of Section 27, Township 6 North, Range 65
West of the 6th P.M. , Weld County, Colorado,
excepting a parcel of land conveyed to the
Union Pacific Railroad Company by deed
recorded in Book 292 at page 473 of the Weld
County records, and further excepting a parcel
of land heretofore conveyed to Home Light and
Power Company as recorded in Book 1327 at page
80 of the Weld County records, together with
2 certain irrigation wells located on the
premises, subject to the following: (1) any
and all restrictions, reservations, exceptions
and easements appearing of record or as now
existing on the premises, (2) that certain oil
and gas lease dated August 5, 1977, recorded
November 14, 1977 in Book 814 under Reception
No. 1735804 of the Weld County records
executed by Donald R. Uhrich and Shirley
Uhrich as lessor to Chris L. Christensen, Jr. ,

Irrigating Co. and twenty-four(24) shares of the capital stock of The Cache La Poudre
Reservoir Company,
Together with all related easements and/or rights of way related thereto necessary
for the delivery of said water to the above described property,
together with one(1)North Weld County Water District(NWCWD)water tap,
two (2)electric center pivots in an as/is condition and related equipment in an as/is
condition, all currently located on the property,
Subject, however, to the following:
(1) 2007 real estate taxes due and payable in the year 2008;
(2) Rights of way or other easements as granted or reserved by instruments of record or
as now existing on said premises, including Grantor's interest, if any, in any vacated
street, alley or other right of way that adjoins the subject property;
(3) A reservation to the grantor herein, Shirley Ann Uhrich, in, to and from an undivided
one-half(1/2) interest in and to all oil, gas,minerals and other hydrocarbons from the
above described property, and all rights of access thereto;
(4) Any and all reservations, limitations, exceptions, covenants, contracts and conditions
contained in instruments of record which in any way relate to or burden the above

22 at page 190 of the Weld County records;
(5) That certain Farm Lease dated February 27, 2006 between Shirley A. Uhrich as
lessor and Hungenberg Produce,Inc. as lessee;
(6) That certain Lease between Cox Oil Company as lessor and Shirley Ann Uhrich as
lessee pertaining to the use of one(1) propane tank;
(7) That certain Oil and Gas Lease dated August 5, 1977, recorded November 14, 1977
in Book 814 at Reception No. 1735804 of the Weld County records, and any and all
assignments thereof or interests therein;
(8) Those two certain oral month-to-month residence leases covering residence units
located on the premises;
(9) The terms, conditions, provisions, agreement and obligations specified under the

August 28, 1958 in Book 1458 at page 582 of the Weld County records;
(12) Easement for ingress and egress and incidental purposes granted to Dewey L.
Darling by the instrument recorded February 3, 1969 in Book 605 at Reception No.
1526990 of the Weld County records;
(13)That the above described premises are included in the West Greeley Soil
Conservation District, Eaton Fire Protection District, Northern Colorado Water
Conservancy District and the North Weld County Water District.
