RE: APPROVAL OF RECORDED EXEMPTION NO. 325 - GEORGE LEGINO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 5th day of July, 1978 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 325, being the property of
George Legino, being more particularly described as follows:
A tract of land in the South Half (S1) of Section 2,
Township 7 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, more particularly described
as follows:
Beginning at the Southwest corner of said Section 2;
thence South 89°45' East along the South line of
said Section 2 a distance of 1768.1 feet to the
True Point of Beginning;
Thence North 0°27' East 19.3 feet, more or less,
to a 1" O.D. pipe at the Southwest fence corner;
Thence North 14°03' West, 408.55 feet, more or
less to a 1" O.D. pipe along the West side of
the fence;
Thence North 2°29' West 70.55 feet, more or less,
to a 1" O.D. pipe along the West side of the
fence;
Thence North 20°31' East 265.34 feet, more or less,
to a 1" O.D. pipe at the corr..er change of the
fence;
Thence North 48°30' West 498.92 feet, more or less,
to a 1" O.D. pipe along the fence;
Thence North 14°59' West 272.76 feet, more or less,
to a 1" O.D. pipe along the fence;
Thence North 9°26' East 293.36 feet, more or less,
to a 1" O.D. pipe along the fence;

to a 5/8" diameter piece of ref r on the West
bank of the Collins Lateral;
Thence South 57°11' East 15 feet, more or less,
to the centerline of the Collins Lateral;
Thence, following a Southerly meander line along
the centerline of the *Collins Lateral to the
South line of said Section 2;
Thence Westerly along said South line of said
Section 2, a distance of 1315 feet, more or
less, to the True Point of Beginning.
*Collins Lateral is more properly known as the
Tarimer County Canal.

does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA(3) of the Weld County
Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by George Legino, be and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the 5th
day of July, A.D. , 1978 .

Dear Commissioners :
The attached application , plat and related items are in reference to a
request by Mr. George Legino for a lot size variance and a recorded
exemption. The parcel of land on which these requests have been made
is described as Pt . Si Section 2, T7N, R67W of the 6th P.M. , Weld
County, Colorado. The subject property contains 35 acres more or less
of Class II and III irrigated soils and Class IV non-irrigated soils .
The request is to split the property into parcels of 1 . 985 acres and
33. 015 acres. This property is located 5 miles north and a mile west
of Severance.
As indicated by George Legino in a letter submitted with this applica-
tion, the intent is to convey the 1 .985 acre parcel to his son. Mr.
Legino's son is currently residing in a mobile home located on the
1. 985 acre parcel . His son wishes to construct a new residence on this
parcel . Mr. Legino' s son is a partner in the farm and hog operation
located on the property. In addition to the 35 acre parcel , George
Legino owns an adjacent 64 acre tract .
Based upon the information submitted and the adopted policies in the
County , the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1 . The proposed request conforms with the intent clause of the re-
corded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) , the intent clause of the Agricultural Zone
District (Section 3. 3 A. of the Weld County Zoning Resolution) ,
and the Weld County Comprehensive Plan in that each parcel does
have an existing set of improvements. The use will be compatible
with surrounding agricultural uses. The request will allow agri-
culture and related uses to be the predominant land use .
