Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Bucklen equipment is applying to permit the recycling of aggregate, concrete, asphalt and dirt fill on the property in stockpiles. This project is east of and adjacent to 25`h avenue near Greeley. Parcel number 080331200002. Roads: 25th Avenue is maintained by Weld County. Traffic counts from January 2014 were 3086. Traffic: The traffic information provided with the submittal states that 20 semi-trucks and trailers will visit the site daily. Access: An access permit has been approved for the access to the site (AP14-00467). Access is proposed across parcels 080536400097 and 080331300024. An access easement is required to provide legal access to the site across these parcels. Tracking control is required to prevent tracking from the site onto the County Roadway. O Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. O Standard tracking control for accesses onto gravel roads includes double cattle guards at the access point. O Standard tracking control for accesses onto paved roads includes either 300 feet of pavement onsite OR 100 feet of pavement plus double cattle guards. O Alternatives such as recycled AC, gravel/road base,may be considered with lighter traffic impact projects. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. General Site Plan Requirements: i.e(IA, RMA, City Town Agreement, etc...,offsite auxiliary lanes) Improvements Agreement: The Bucklen complex has previously entered into a long term maintenance and improvements agreement approved by the Board of County Commissioners (document number 930714, recorded 11/10/93) for USR-1001. This improvements agreement will still remain in place for the activities associated with this Use by Special Review project. Geohazard Area: This site IS NOT in a Geologic Hazard Area. Floodplain: The project site lies entirely within the Poudre River FEMA regulatory floodway. A meeting with the Colorado Water Conservation Board (CWCB), the County and the applicant and applicant's attorney was held July 9'12014 to discuss the possibility of allowing the historic use. It was discussed at this meeting the applicant would propose distances from the river channel and stockpile boundaries for CWCB to review and ultimately approve to protect the County in the event of an audit. CWCB is a referral agency for this project and those comments will be included in the floodplain permit. Drainage Study: The applicants will be required to maintain historic drainage flows and run-off amounts on the property. A drainage narrative was submitted. This project is within an State defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements. The narrative indicates stonnwater runoff enters into a borrow pit and acts as water quality. The narrative must be stamped and signed by a licensed professional engineer in the State of Colorado. The drainage narrative was not stamped by a Colorado PE. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than I acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-3575. CONDITIONS OF APPROVAL: Prior to recording the plat: A. This site is in an MS4 area. A Drainage Narrative stamped and signed by a Professional Engineer registered in the State of Colorado is required. The map shall be amended to delineate the following: A. 25"' Avenue is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full build out. The applicant shall verify and delineate on the map the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. B. The applicant shall indicate specifically on the plat any right of way and/or easements and indicate whether they are dedicated, private, or deeded and label with recorded document, book and page and/or reception number to provide adequate access to the parcel. C. Show and label standard tracking control onto publically maintained roadways on the map. D. Show the accepted water quality feature on the map with volume and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA. E. Show and label the drainage flow arrows, turning radii, and parking and circulation on the map. F. Show and label the floodplain and floodway (if applicable) boundaries on the map. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. A long term maintenance and improvements agreement approved by the Board of County Commissioners (document number 930714,recorded I (/10/93 will apply to this site. 2. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15,Articles 1 and II, of the Weld County Code. 3. The historical flow patterns and runoff amounts will be maintained on the site. 4. Weld County is not responsible for the maintenance of onsite drainage related features. 5. This site is located in a State Designated, Municipal Separate Storm Sewer System(MS4) Area which may trigger specific water quality requirements or other drainage improvements if the lot develops further. FROM: HEATHER BARBARE, ENVIRONMENTAL HEALTH SUBJECT: USR14-0073, BUCKLEN DATE:REVISED JULY 3, 2015 Weld County Environmental Health Services (WCDPHE) has reviewed this proposal for conducting an aggregate recycling operation to include asphalt, concrete, and fill dirt. There will be no more than two employees' onsite at one time and, in accordance with Weld County policy, the applicant is proposing to provide bottled water to employees for drinking water and to provide portable toilets for employee use. The applicant provided a dust abatement plan indicating gravel and/or road base will be used onsite to control dust and that a water tanker truck or portable sprinkler system will be used as necessary. The applicant also provided a waste management plan/waste handling plan indicating no wastes will be managed onsite. Based on information available, because this is an accessory property, waste generated from the recycling and employee trash will be managed via dumpster at a neighboring parcel. The applicant submitted a soil screening and profile form/soil screening plan, which discusses how the facility will screen material to prevent waste acceptance. The plan describes material acceptance procedures to ensure the material entering the facility is uncontaminated soil with minimal debris. The applicant indicated in the application that the facility will meet 6 CCR 1007-3 Section 8.5 requirements such that registration of the facility with the Colorado Department of Public Health (CDPHE) will not be required. In order to meet the exemption the applicant must ensure: 1. material is managed and separated into commodity specific piles processed for reuse; 2. material is managed in active piles separated by material type or use within the past year; and 3. incoming loads shall have all non-concrete, non-asphalt and non-rebar material removed from concrete and asphalt materials within thirty (30) calendar days and non-concrete, non-asphalt and non-rebar material shall not exceed 10% of the total material onsite by weight or volume. A Compliance Advisory was issued on April 2, 2014 by the CDPHE and a Violation Notification was issued by WCDPHE on March 26, 2014 for conducting disposal activities at the site without a Certificate of Designation. The applicant's May 21, 2014 response letter "Inspection Report and Compliance Advisory for February 28, 2014 Inspection; Bucklen Equipment Company, Inc." indicated the solid waste was used beneficially on the subject parcel (080331200002) and the adjoining parcel (080331300024) as fill material to create a stable base for vehicle traffic and facility operations. The applicant will be required to demonstrate that the fill area does not pose a risk to human health and the environment or remove the waste. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. As indicated in the CDPHE Compliance Advisory issued on April 2, 2014 and the Violation Notification issued by WCDPHE on March 26, 2014, waste has been illegally disposed of at the facility. The applicant shall either remove the waste illegally disposed of onsite or shall enter into a Consent Agreement with Weld County regarding the waste materials placed on the property subject to USR14- 0073. The Consent Agreement shall address, but not be limited to, the following issues: A. Applicant shall provide evidence acceptable to WCDPHE that the waste is suitable to be left in place and will not negatively impact off-site groundwater or surface water. The applicant shall provide a proposal acceptable to WCDPHE regarding how such evidence will be obtained to show the waste is suitable to be left in place and will not negatively impact off-site groundwater or surface water. The proposal may include, but is not limited to, submitting records indicating the composition and location of the deposited waste and conducting a subsurface investigation to characterize the in-place waste including a screening process to investigate groundwater/soil chemical contamination. B. Applicant shall provide engineering design information indicating that the waste is stable in-place and unlikely to wash away. If the waste is not stable or is likely to wash away, additional engineering and stabilization, or removal of the waste if stabilization is not feasible, will be required. C. Dependent upon the nature of the waste, the Applicant may be required by Weld County to record an environmental covenant on the property subject to USR14-0073. R 14-0073. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and 2 Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. As indicated in the CDPHE Compliance Advisory issued on April 2, 2014 and the Violation Notification issued by WCDPHE on March 26, 2014, waste has illegally been disposed of at the facility. The applicant shall either remove the waste illegally disposed of onsite or shall demonstrate that the waste does not pose a risk to human health and the environment. If the applicant does not choose to remove the waste, applicant shall comply with the terms and conditions of the Consent Agreement referred to in Section 1 of the Conditions of Approval for USR14-0073. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the accepted "waste handling plan", the accepted "soil screening plan", and Chapter 14, Article 1 of the Weld County Code, at all times. 5. Fugitive dust and fugitive particulate emissions should be controlled on this site. The facility should operate in accordance with the accepted "dust abatement plan". Fugitive dust should be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's Air Quality Regulations. 6. This facility shall adhere to the maximum permissible noise levels allowed in the non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. If employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. All potentially hazardous chemicals must be handled in a safe manner in 3 accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAPs) and volatile organic compounds (VOCs). All chemicals must be stored securely, on an impervious surface, and in accordance with manufacturer's recommendations. 9. The facility shall comply with all provisions of the Colorado Department of Labor and Employment Division of Oil and Public Safety Underground and Above Ground Storage Tank Regulations, as applicable. 10.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 4 MEMORANDUM TO: DIANA AUNGST, PLANNING SERVICES fillG O N T Z-9? The applicant shall submit an operations and waste acceptance plan or a soil screening plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment and to the Colorado Department of Public Health and the Environment. The waste acceptance plan/ soil screening plan shall describe material acceptance procedures to ensure the material entering the facility is uncontaminated environmental media as defined by Section 1 of the Regulations Pertaining to Solid Waste Disposal Sites and Facilities, 6 CCR 1007-2, Part 2. 3. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4) The waste handling plan shall provide a commitment to notify the Weld County Department of Public Health and Environment in writing, in the event the plan is amended. This violation was initiated due to the expansion of the business operations without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process; however,due to exceeding the time limit for submittal of a complete application, an Investigation Fee IS required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. Use by Special Review Application Case # USR-14-0073 SW-WLD-BEC 1.1 Ms. Aungst, The Hazardous Materials and Waste Management Division ("the Division") of the Colorado Department of Public Health and Environment appreciates the opportunity to provide comments pertaining to the solid waste management activities conducted by Bucklen Equipment Company, Inc: ("Bucklen") located at 804 N. 25th Avenue in Greeley, CO ("the Facility"). Bucklen submitted an application for a Use by Special Review with Weld County and Weld County requested comments from the Division. The Division's comments regarding the applicability of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007- 2, Part 1 ("the Solid Waste Regulations") to Bucklen's activities are provided below. Bucklen currently accepts and processes concrete, asphalt and dirt at the Facility. Section 8.5 of the Solid Waste Regulations exempts asphalt and concrete recycling facilities from the Recycling Facility requirements when the materials are managed like a commodity. According to the USR application, Bucklen manages concrete and asphalt in a manner consistent with the exemption in Section 8.5.3(B). However, an inspection report from Weld County dated March 26, 2014 and a letter from Bucklen's attorney dated May 21, 2014 indicate that waste concrete and concrete fines are being buried onsite. The Division considers burying waste to be disposal and subject to the landfill requirements of Sections 2 and 3 of the Solid Waste Regulations. Bucklen should obtain either a Certificate of Designation or a beneficial use determination if they wish to continue to dispose of, or beneficially use, asphalt, waste concrete and concrete fines at the Facility.
