HomeMy WebLinkAbout20151822.tiff RESOLUTION RE : REGULATING, WARNING AND GUIDING TRAFFIC DURING THE TEMPORARY CLOSURE OF COUNTY ROAD 60.5 BETWEEN COUNTY ROADS 47 AND 49 TO BE EXTENDED TO JULY 24, 2015, DUE TO WEATHER DELAYS WHEREAS, the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter. is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, pursuant to Section 42-4- 106(6) (a) , C . R. S . : ". . . local authorities, with their respective jurisdiction may, for the purpose of road construction and maintenance, temporarily close to through traffic or to all vehicular traffic any highway or portion thereof for a period not to exceed a specified number of work days for project completion and shall , in conjunction with any such road closure establish appropriate detours or provide for an alternative routing of the traffic affected . . .", and WHEREAS, the Board , pursuant to said statute and upon the basis of traffic and personal investigations, has determined that conditions exist which make it necessary to temporarily close to through traffic and to regulate, warn and guide vehicular traffic on said County roads by posting signs thereon . NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, deems it necessary to regulate, warn and guide vehicular traffic on County roads and any intersections thereof, and it hereby authorizes and orders the posting of such traffic control devices as shall be reasonably necessary to regulate, warn and/or guide traffic thereon for the safety of the general public and that said traffic control devices shall conform to the Federal Manual on Uniform Traffic Control Devices . This closure has been ongoing since May 3rd, and is set to expire on July 1st. Due to unusually severe (wet) weather during the month of May, the construction is behind schedule. Flatiron has submitted the attached letter and supporting documentation proposing to extend the WCR 60.5 closure period. There are no additional costs associated with this proposed closure extension request since this project has a lump sum bid item for the traffic control. Separately, staff received phone calls from Art Gutterson on May 29th and again on June 4th, indicating a slowdown in his truck washout and restaurant business. On May 29`x' staff had message board signs g installed stating "Local Business Open", to let the traveling public know the business in this area remains open on WCR 60.5 between CR 49 (detour location) and the road closure at WCR 60.5 and WCR 47 intersection. On June 9th PW received a letter dated June 4, 2015 from Art Gutterson requesting compensation for his lost business due to the road closure at WCR 60.5 and WCR 47. Staff wanted to bring this matter to your attention, but believes the closure extension is reasonable. What options exist for the Board: Option 1 : The Board can approve the proposed 21 day extension of the ongoing WCR60.5 closure. Option 2: The Board can schedule a work session to discuss this issue further. Option 3 : The Board can offer alternative ideas. Recommendation to the Board: The Greeley Tribune (6/6/15) reported 7.26" of rain in the month of May which is far above the 2.47" average amount. Public Works believes the additional time requested for the ongoing WCR60.5 closure is justified. If recommended by the BOCC, Public Works will submit this item for inclusion on the next available BOCC Meeting Agenda. Weld County Parkway (SRP-23) Re: Abnormal Rains in May / Impacts @ CR 60.5 intersection area Dear Mr. Bedell, As discussed in our recent weekly progress meetings and at multiple jobsite visits during my first two weeks on the project in late May, please find attached our initial packet of weather-related data for the abnormal heavy rains we've experienced during the month of May at the project site. This letter and packet is focused on the delay impacts to the Parkway/CR 60.5 intersection work area which currently includes an ongoing, planned 60-day closure period and detour for public traffic. Please consider the following key points: Notice of potential delays and impacts due to the heavy rainfall events was initially provided via letter dated May 131h from Chip Karo to Mike Command; v Your email dated May 21 ' addressed several contractual provisions and also recommended a brief memo for each "weather day". At this time, we have decided to first provide a summary timeline of "working days" and "non-working days", as well as backup weather calendars and daily reports for rain events from "NOAA", the federal weather center. The distinction between working and non-working days is focused upon the intersection work area due to the fact we were primarily performing earthwork and drainage pipe installation during the time frame in May when the rains began. V. You also stated in the May 215` email you 'may be asked to apply liquidated damages associated with this 60 day limit. ' We don't believe the "LD" provision should be applied to this closure period, based on the contract specifications. Our initial review of the weather impacts in this area shows a total of 21 non-work day v In addition , as we've re-entered this work area after the rain events ended last weekend, we have discovered unsuitable roadway material that has added work scope, and thus time, to the intersection schedule also. Preliminary estimates of quantities and work activity durations are currently being finalized, but may add at least one week to the required completion schedule for "Phase 1 ". Y We will continue to work toward completing the major portions of the "Phase 1 " work requirements, which will allow the closure to be removed and east-west traffic flow on CR 60.5 to open back up without a detour. Other work activities will continue in the area to complete all scope requirements. Please understand that any additional rain events will possibly extend the completion date of this phase even further due to saturated grade conditions that do not allow us to work in the area. WCR60.5 remains closed between WCR47 and WCR49 as required for our Contractor to construct a large concrete intersection and traffic signal at the WCR60.5/47 Intersection. The original plan was to close WCR60.5 for a period of 60 days, starting on 5/3/2015 and ending on 7/1 /2015. Unfortunately the unusually severe (wet) weather during the month of May has caused a construction delay. The current plan is to extend the closure to 7/22/2015.
