Truck parking - Hernandez
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Parking of 4 trucks (two belly dumps and two dump trucks)
This project is northwest of HWY392 and CR49. Access is from CR49.
Roads:
This project is adjacent to CDOT Highway 392.
County Road 49 is a Gravel road and is designated on the Weld County Road Classification Plan as a
Local road, which requires 60 feet of right-of-way at full buildout. The applicant shall verify and delineate
on the plat the future and existing right-of-way and the documents creating the existing right-of-way. If
the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the
edge of future right-of-way. This road is maintained by Weld County.
No traffic counts are available in the area.
Traffic:
A traffic narrative was submitted with the application materials and indicated that there will be
approximately 4 daily round truck trips. The site will have 3-4 employees working typically 5am to 7pm.
Access:
An access permit has been approved for the access to the site for three access points (AP15-00139).
Tracking Control:
Tracking control is required to prevent tracking from the site onto the County Roadway. Minimal standards
are listed below. Temporary Tracking Control shall be used during construction unless permanent
tracking control is installed ahead of construction activities.
O 4 to 10 round large truck trips/day:
• Access onto gravel roads requires recycled asphalt/road base on all driving surfaces.
Other PW Permits:
A Transport Permit is required for any oversize and/or over weight vehicles. Contact Weld County Public
Works at 970-304-6496 ext. 3764.
General Site Plan Requirements: i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes)
A development standard will be applied to the recorded map indicating any impacts to the road must be
mitigated by the owner. There shall be no tracking from the site onto publically maintained roads. The
applicant is responsible for mitigation of any damage or offsite tracking and upgrading and/or maintaining
onsite tracking control.
Geologic hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a Floodplain.
Drainage Study:
A drainage narrative and water quality calculations were submitted with the application materials. The
water quality feature design is accepted by Weld County.
The applicants will be required to maintain historic drainage flows and run-off amounts on the property.
No stormwater detention shall be required for redevelopment of commercial and industrial sites where the
change of use does not increase the imperviousness of the site; however, water quality capture shall be
required.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning
Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
CONDITIONS OF APPROVAL:
The map shall be amended to delineate the following:
A. County Road 49 is a Gravel road and is designated on the Weld County Road
Classification Plan as a Local road, which requires 60 feet of right-of-way at full buildout.

the documents creating the existing right-of-way. If the existing right of way cannot be
verified it shall be dedicated. All setbacks shall be measured from the edge of future right-
of-way. This road is maintained by Weld County.
B. Show the approved access(es) on the plat and label with the approved access permit
number (AP15-00139).
C. Show and label the approved tracking control onto publically maintained roadways on the
map.
D. Show the accepted water quality feature on the map with volume and label as WATER
QUALITY FEATURE, NO-BUILD OR STORAGE AREA.
E. Show and label the accepted drainage features, drainage flow arrows, turning radii, and
parking and circulation on the map.
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction. Contact the Planning Department for application information.
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized.
5. There shall be no tracking of dirt or debris from the site onto publically maintained roads. The
applicant is responsible for mitigation of any offsite tracking and maintaining onsite tracking control
devices.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for a Home Business
(parking for up to 4 commercial vehicles along with occasional on-site vehicle
maintenance, oil changes) in the A (Agricultural) Zone District.
The application indicates there are 3 to 4 employees. A portable toilet can be utilized
for drivers. The residence is currently served by a domestic well and a septic system
that is sized for 3 bedrooms. The well and septic system cannot be used in conjunction
with the business or the well will need to be repermitted to commercial and the septic
system will have to be reviewed by an engineer to determine if it is adequately sized for
the business. The applicants have indicated they will supply a portable toilet, which is
acceptable.
The dust abatement plan states that either A&W Water or E&R Trucking will supply
water trucks and spray as needed. It appears the area where the trucks will be parked
is recycled asphalt.
The waste handling plan indicates Northern Colorado Disposal is utilized for trash
removal. According to the application, there will be no washing of vehicles or fuel
storage on site. There will be some oil changes occurring on site and the oil will be
taken to Auto Zone to recycle.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved Waste Handling Plan, at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. For employees or
contractors on site for less than 2 consecutive hours a day, portable toilets and
bottled water are acceptable. Records of maintenance and proper disposal for
portable toilets shall be retained on a quarterly basis and available for review by
the Weld County Department of Public Health and Environment. Portable
toilets shall be serviced by a cleaner licensed in Weld County and shall contain
hand sanitizers.
7. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling. All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Subject: USR15-0015 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV14-00206)was noted. This
violation was initiated due to the operation of a commercial trucking operation without first completing the
necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all but 1 (one)Commercial Vehicle shall be
removed from the property 30 (thirty) days of denial or the violation will proceed in court accordingly.

Dear Mr. Gathman:
The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county
planning directors, this office will only perform a cursory review of the referral information and provide
comments. The comments will not address the adequacy of the water supply plan for this property or the
ability of the water supply plan to satisfy any County regulations or requirements.
The application is sought to allow the applicants to park their commercial trucks at their residential
property of approximately 3.5 acres. The trucks are used to service oilfield locations in and around Weld
County. The site will be utilized by a total of three or four truck drivers, one of which resides at the site, to
pick up and drop off vehicles each day.
Water for the existing residence is supplied by an existing well, permit no. 231595. This well may be
used for fire protection, ordinary household purposes inside not more than three single-family dwellings, the
irrigation of not more than one acre of home gardens and lawns, and the watering of domestic animals. This
well may not supply water for any commercial use at the site, including use by employees who do not also
reside on site.
A portable toilet will be provided for employee use. Water trucks will be utilized for dust control as
needed.
The site is proposed to contain a water quality feature (detention pond), with a calculated required
storage volume of 0.0102 acre-feet. Any storm water runoff captured by the detention pond that is not
diverted or captured in priority must infiltrate into the ground or be released to the stream system within 72
hours. Otherwise, a substitute water supply plan or an augmentation plan approved by water court must be
obtained to replace evaporative losses. Further, construction of the pond must not result in the exposure of
ground water without providing replacement water to the stream system.
