I have been monitoring this property since our last e-mail exchange. I would like to go on
record as opposing any special use approval in regards to how they are currently using this
property. They have taken it from a small acreage horse property to a commercial business
that includes several large vehicles being parked; large commercial vehicles being
dismantled, repaired, welded and painted, without being enclosed. If there is a particular form
I need to complete in order to oppose their special use request, please let me know. My
feeling is the buyer's should have checked on how the property could be used PRIOR to
buying and not asking for forgiveness after the fact.
Also, can I ask to be notified of any public hearings that will be held.

Good Day,
My name is Rick Onorato and I live at county address 5200 47th Avenue. I drive
49th Street on a consistent basis. Recently, it appears that the residence at 3600
49th Street that was listed for sale, has been sold. This address apears to be within
the Evans City limits. The new occupants have moved in several large dump trucks
and other associated equipment.
The reason I am bringing this to your attention is to ask if this storage of equipment
meets the current zoning restrictions . My concern is this will soon develop in to an
eyesore as it did on Industrial Parkway where it turns in to 49th Street in Evans,
where the dump trucks and other equipment turned in to a salveage yard .
There are also concerns about the large numbers of heavy vehicles using this street
given the poor condition of the road surface at the 49th Street and 35th Avenue
intersection . I'm fairly certain not much can be done about the traffic concern so
maybe I should ask if there are any plans to correct the drainage problem at this
intersection and resurface the roadway?

Reason's M & E Oil field services Trucking should not be issued a
special permit at 3600 49th Street Greeley, CO 80634.
This has been a quiet neighborhood sense 1979 when I brought this
property at 3610 49th Street Greeley, Co 80634. We have never had any
thefts, arguments or loud noises in the neighborhood and respect each other.
There is not room for a full blown trucking company on this one acre tract
who has no respect for no one or their privacy.
Reason's :
1 . 6 company trucks
6 dump trucks
1 tractor/trailer flatbed
1 septic tank truck
1 wreck semi tractor
2 flatbed trailer loaded with wrecked junk
6 to 7 employee vehicles daily
3 wrecked trucks
1 10 Ft. refrigerated box
1 backhoe
tires and junk piled up
2. Going to cause accidents entering 49th Street ( to much traffic)
3 . Running two full time bays for fabrication of wrecked trucks and
grinding, welding, sledge hammering, commercial painting next to my
house seven days a week.
4. M&E has had sheriffs department and Evans Patrol out numerous times
in just a few weeks.
5 . Disrespectfully removed fence on Shanks and trying to claim property .
Causing problems with property owner then getting restraint order on her.
6. This is not commercial or industrial property, it is residential.
7. Lot was advertised bring a animal or a semi( not a oilfield trucking co.)

8 . Backhoe running loading and unloading junk truck parts.
9. Driving my dog nuts working on this junk within feet of my dog pen.
10. Working on trucks ( fab bays ) and employee's showing up to work on
their vehicles too.
11 . Traffic from 7 employee's vehicles on daily basis.
12. In just 1 month this property looks like a junkyard driving the value of
the surrounding property's way down.
13 . No work should be performed on this property such as mechanical or
body shop to any commercial vehicle.
14. All surrounding property's should not suffer for the benefit of one
business !

To whom it may concern :
This letter is written as an objection to giving a permit for commercial
vehicle parking and machinery/tool storage at 3600 49th Street.
Our objections are as follows . The first objection to the business
use of the property is that just shortly after occupancy by this
company , we were notified that a theft had taken place at the above
mentioned address. Of course, we now wonder what kind of people
will be attracted to our neighborhood because of this business .
Secondly , the notice sent to us states the purpose of the permit and
it clearly defines the use as solely for storage and parking . However,
parking and storage is not all that takes place . There have been
several large gatherings (parties?) which increase the volume of
traffic at the intersection of 35th and 49th and the noise of the music
and number of people at these events.
Even though we live 3 houses to the west, we can hear music
being played loudly at other times as well . In addition , there is the
noise of equipment being run for long periods of time , employees
working on equipment outside, junk piled up outdoors. Oil is changed
on equipment outside , vehicles are washed , There is the overhauling
of engines and painting vehicles , high traffic in and out of property.
And a very noticeable increase in truck traffic that zooms past our
house sometimes so severe it shakes our home .

As I recall , years ago , when Amen ' s were seeking a permit to
operate their oil business out here, they were required to have some
kind of screening , building , something to hide the vehicles ,
equipment, etc. At the very least this trucking company should have
the same requirement.
We moved to this location almost 20 years ago seeking a peaceful ,
enjoyable, serene lifestyle. Which everyone is entitled to in Weld
County. We have made many improvements to our property over the
years not only for our own purposes but to add to the curb appeal of
our neighborhood . And we have lived a respectful , quiet life.
To allow a company like this to come in and not only to be an
eyesore with its many employee vehicles , trucks , equipment and junk
strewn around , increasing the traffic and noise is a slap in the face of
the residents who were here previous to Carrillo's purchase of 3600
49th Street.

I will try to keep this brief and yet still address my concerns.
I was born and raised in Weld County so I certainly understand the right to farm and a landowner's property
rights. What doesn't make sense is why someone would purchase property, knowing the use was going to be
changed from a small horse property to a surface parking lot for dozens of vehicles, including commercial size
and not take the time to see if that use is allowed. Now, several nearby landowner's like myself, are trying to
retain maybe not the intended use of the property, but certainly not agreeing that the applicants proposal is
appropriate.
The other usr's surrounding this property on 3 sides and mentioned in the staff report are acceptable uses in my
mind. The quonset type sheds to the north have been there for decades and do not produce any noticeable
traffic or other concerns. In fact, I don't even know what they do there it is such a low impact usr.
The gas plant to the northeast has also been there for decades, so anyone purchasing property nearby, knows
what that usr involves.
The remaining one south of the applicant's property is so far away from the road that you see very little and
once again, the impact is so negligible that it has been no concern.
In the short time the applicant's have owned their property it started out with several commercial vehicles being
parked there, commercial vehicles being painted, commercial and private vehicles being repaired, and the usual
20 to 30 vehicles being parked. If you have not driven by you may not understand that this property is right
along side 49th street. It's simply an eyesore.
There is a recommendation to try and cover up this concern by having some visual barrier installed. This
creates its own concern. What is acceptable to everyone? Are we talking trees and bushes, a tall dirt berm, or
possibly an ugly corrugated sheet metal fence that the City of Evans must have approved for a similar site at the
intersection of 49th street and Industrial Pkwy?
I hope you now understand why this should not be just a simple usr approval. Even with the right in and right
out restrictions who has the time to monitor and enforce that?
I do sympathize with the applicant's position to an extent, but their intended use of the property should have
been investigated PRIOR to purchasing.

With regards to case number USR14 - 0074 I would like to express my
concerns .
First and foremost at no fault to the applicants I fault the realtor
that promoted this property as a place for a business as the promotional
flier stated " Bring your semi " . The public needs to be more diligent
when purchasing a property such as this by researching the existing
zoning regulations . I have lived less than a mile from this property
for the last 30 years and I drive past this property several times a
day . This is not the first buyer in this area nor will it be the last
that sees our existing zoning as an attractive alternative to combining
the current residential/agricultural zoning to include a commercial
business so they may get " bang for their buck " . Just because there are a
very limited amount of commercial uses in this area I need to stress
that this is the exception and not the rule as we are not an industrial
park .
My concerns with the current USR application are as outlined below :
1 . The odd shape and size of the lot is not adequate for the level of
activity that this commercial business constitutes . It has one point of
entry and exit access listed even though they also currently utilize an
opening on the north east corner of the property .
2 . The legal counsel for the applicant has not been accurate in their
representation of the commercial activities . In cover letter dated
October 20 , 2014 addressed to the City of Evans Public Works Department
it is stated that use is to be for " limited commercial activities " . It
is stated that 15 small pickup trucks are to be parked on the site . I
do not consider 10 qty 3 /4 ton and 5 qty one ton pick ups to be " small "
pickups in addition to the various array of other equipment on site to
include but not limited to semi tractors and body parts for semi
tractors , dump trucks , and a tractor backhoe . I do not consider this
as " limited " .
3 . I have witnessed the maintenance of vehicles at this site as well as
the painting of various semi truck parts and welding which to my
understanding is not approved nor being applied for under USR14 - 0074 .

4 . There is a walking path that sits directly to the south of the
property . If the USR is approved I would ask that quality fencing be
required around the " entire " perimeter of where the property is .
5 . The surrounding properties ( the property that was referred to that
is directly south that is used for the same purpose ) that have similar
uses have more land available along with buildings to store the
equipment . Again these properties are the exception and not the rule .
People move to this area to live a quality country life that is close to
the city and not to have to battle cases such as this .
6 . 20 to 30 employees parking their vehichies is an excessive amount
considering the small size of the lot . This will only add to the
already heavily traveled 49th Street and South 35th Avenue . Not to
mention another 15 employees that are proposed to be employed at the
site . The portable bathroom facilities are mentioned twice in the
special review questionaire answers and yet where are they located?
Where are they using bathroom facilities currently? ?
7 . My concerns for the water feature are that it is next to the walking
path and I would like to know if they will be required to participate
in some sort of insect control if there is standing water for the
comfort of the few neighbors that they do have as well as the walkers
that utilize the path .
I thank you for taking the time to let me voice some of my concerns . As
it is currently , it is very unsitely and this is not the place for a
commercial business to commence due to the small and odd size of the lot
not to mention the location at an already busy intersection . I
respectfully ask the planning commission to deny approval of
USR14 - 0074 .

This letter is written as an objection to giving a permit for commercial
vehicle parking and machinery/tool storage at 3600 49th Street.
Our objections are as follows . The first objection to the business
use of the property is that just shortly after occupancy by this
company , we were notified that a theft had taken place at the above
mentioned address. Of course, we now wonder what kind of people
will be attracted to our neighborhood because of this business.
Secondly, the notice sent to us states the purpose of the permit and
it clearly defines the use as solely for storage and parking . However,
parking and storage is not all that takes place. There have been
several large gatherings (parties?) which increase the volume of
traffic at the intersection of 35th and 49th and the noise of the music
and number of people at these events .
Even though we live 3 houses to the west, we can hear music
being played loudly at other times as well . In addition , there is the
noise of equipment being run for long periods of time, employees
working on equipment outside, junk piled up outdoors . Oil is changed
on equipment outside, vehicles are washed , There is the overhauling
of engines and painting vehicles , high traffic in and out of property.
And a very noticeable increase in truck traffic that zooms past our
house sometimes so severe it shakes our home .
As I recall , years ago, when Amen 's were seeking a permit to
operate their oil business out here, they were required to have some
kind of screening , building , something to hide the vehicles,
equipment, etc. At the very least this trucking company should have
the same requirement.
We moved to this location almost 20 years ago seeking a peaceful ,
enjoyable, serene lifestyle . Which everyone is entitled to in Weld
County . We have made many improvements to our property over the
years not only for our own purposes but to add to the curb appeal of
our neighborhood . And we have lived a respectful , quiet life .
To allow a company like this to come in and not only to be an
eyesore with its many employee vehicles, trucks , equipment and junk
strewn around , increasing the traffic and noise is a slap in the face of
the residents who were here previous to Carrillo's purchase of 3600
49th Street.

My name is Esther M. Schank and I reside at 4020 54th Street Road . I own the
property from 35th Avenue west to 47th Avenue on both sides of the River.
I am 92 years old and am house bound and unable to attend the meeting on
March 3, 2015.
I am giving my permission to Bobbi Cox and Conni Nelson (my daughters) to
represent me at these hearings.
The company purchased this property some time in the spring of 2014. I do not
have exact date. The first thing they did was take down my fence and encroach
on the easement I signed to the City of Evans for the walkway. Thirty feet south
of the fence they took down is Evans walkway but BETWEEN THE FENCED
PROPERY AND THE WALKWAY ARE HIGH PRESSSURED NATURAL GAS
LINES THAT HAVE BEEN THERE SINCE 1985-86 COMING FROM THE OIL
AND GAS WELLS THAT ARE IN THAT AREA THAT RUN UNDERGROUND TO
PLANT THAT IS OWNED BY DCP. It is marked by signs warning the public of
the gas lines but they continued to use their heavy equipment on these gas lines
and in fact mowed the gas on top of them.
My daughter Bobbi talked to Evans and their personnel ; was informed that these
people thought they had bought 3 acres so that was their justification for taking
the fence down . Who is responsible for putting the fence up again? Evans,
because of the walkway, our family, or the people responsible for taking it down?
I am concerned about 49th Street getting busier and busier when the new school
is open. How will the 3 way stop handle all the traffic. What is planned in the
future? How will 20 to 25 vehicles that are parked at this property handle the
stop sign and all of the traffic. tf they are given the opportunity to leave the
property on 35th avenue — how will they treat the 3 way stop. If Evans says the
only entrance will be off of 49th Street how will this effect the traffic on 49th Street.
These people also have their own duallies, dump trucks and sometime semi's
and low-bow trailers in the area. I have seen dump trucks at their little garage
area being worked on. Is this okay?
As I believe this special use permit should be denied as there is not enough room
for what they want to use it for and I believe they have encroached on my
property and caused some traffic problems without regard to the laws.

Butch, please take this letter to the hearing about the property use at 3600 49th St.
I do not like having a large commercial enterprise run from the house at 3600 49th St. that property is
zoned residential and it needs to stay residential. My property values have dropped because of that
business and I do not like it. I don't like the added traffic in the neighborhood, I don't like the additional
racket while they work on their equipment, I don't like the scrap iron piles and most likely waste oil and
paint being dumped on the ground. I don't like all of the people around there all the time.
Our houses are zoned as residential/agricultural and they need to stay that way. I don't know why the
county and the city of Evans even need to debate this issue. It should not even be up for debate, keep
the area as residential.
I do not want a large scale business being run in my neighborhood.

I would like to make you aware of the traffic problem at 35th ave ang 49th st. I have had
many near misses with their trucks. They drive on to 35th ave from their private drive way to
avoid the 4 way stop. They don't yield to cars at the the 4 way when it is there turn to go.
They just cut you off. When traveling East and North, They come through the intersection on
your blind side. They seem to have no regard to other peoples safety. I don"t know if they
are breaking any zoning laws, to have that kind of business out of their Home and property.

Just drove by and saw what I would consider a very large backhoe and very large fifth wheel
flatbed trailer . But if I remember right the lawyer said a small trailers were to be parked
