HomeMy WebLinkAbout20153600.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 9, 2015 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 9, 2015, at the hour of 9:00 a.m. ▪ ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Accounting, Chris D'Ovidio EJ MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of November 4, 2015, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner Conway moved to read Code Ordinances #2015-23 and #2015-24 by audio. Commissioner Cozad seconded the motion, which carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on November 4, 2015, as follows: 1) USR15-0034 -Apolinar Vallejo and Francisco Barron, 2) USR15-0042 - Drill Green, LLC, 3) USR15-0046 - Floyd and Kala Cole, and 4) USR15-0038 - Timbro Ranch and Cattle Company, LLC, c/o Wells Trucking, LLC. Commissioner Conway seconded the motion, which carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. —]--' CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. IEI PUBLIC INPUT: No public input was given. Minutes, November 9, 2015 2015-3600 0, Page 1 BC0016 BIDS: -�- 1) APPROVE BID#61500176, INTERIOR DEMOLITION (822 7TH STREET)- DEPARTMENT OF BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, stated staff recommends approving low bid from Property Assurance for a total of $114,307.00. In response to Commissioner Conway, Toby Taylor, Director of Buildings and Grounds, confirmed the second low bid is a local vendor with an 8% difference. Commissioner Freeman moved to approve said low bid. The motion, which was seconded by Commissioner Moreno, carried unanimously. NEW BUSINESS: Ei 1) CHANGE ORDER #2 TO AGREEMENT FOR DESIGN BUILD TO PUBLIC WORKS OFFICE ADDITION (#B1500064) - GROWLING BEAR COMPANY, INC: Mr. Taylor explained the reason for the change order is to repair a construction anomaly in a County building in the amount of $21,985.00. Commissioner Freeman moved to approve said agreement. Seconded by Commissioner Cozad the motion, carried unanimously. ID 2) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES AND AUTHORIZE CHAIR TO SIGN-DUANE DURAN: Roger Ainsworth, Sheriffs Office, presented the agreement to provide Chaplain services for the inmates. Commissioner Cozad moved to approve said agreement and authorize the Chair to sign. Commissioner Freeman seconded the motion, and it carried unanimously. El 3) CONSIDER CONSTRUCTION AGREEMENT FOR BRIDGE 35/38A AND AUTHORIZE CHAIR TO SIGN - FARMERS RESERVOIR AND IRRIGATION COMPANY: Richard White, Department of Public Works, stated this bridge is on the 2015 rehabilitation list and the second one located along the Farmers Reservoir and Irrigation Company Canal. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously. En 4) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN IMPROVEMENTS TO CR 27 AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS - NELSON AND STACIE HOLLAR: Tiffane Johnson, Department of Public Works, reviewed the terms of the purchase agreement for a total of $800.00. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. El 5) CONSIDER GRANT APPLICATION FOR PHREATOPHYTE CONTROL PROGRAM (TAMARISK AND RUSSIAN OLIVE TREES)AND AUTHORIZE CHAIR TO SIGN: Tina Booton, Pest and Weed Division, stated the Youth Conservation Corp will do the majority of the work along the South Platte River, the Little Thompson River and the Big Thompson River. Commissioner Freeman moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. PLANNING: El 1) FIRST READING OF CODE ORDINANCE #2015-23, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, OF THE WELD COUNTY CODE: Bruce Barker, County Attorney, reported the changes are to update the annual fees for the County. No public input was offered concerning this matter. Commissioner Freeman moved to approve on First Reading. The motion, which was seconded by Commissioner Cozad, carried unanimously. Minutes, November 9, 2015 2015-3600 Page 2 BC0016 El 2) FIRST READING OF CODE ORDINANCE #2015-24, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION AND CHAPTER 17 PUBLIC PLACES, OF THE WELD COUNTY CODE: Mr. Barker explained that the changes include some forms that are approved by the Board for signature from the Chair; the second part is putting into effect the new policy regarding Quasi-judicial hearings before a partial board, and the use of meeting rooms. No public input was offered concerning this matter. Mr. Barker discussed the use of conference rooms and making the rules consistent. Commissioner Cozad moved to approve on First Reading. The motion was seconded by Commissioner Moreno, and upon a roll call vote the motion passed four to one with Commissioner Conway opposed specific to the proposed change concerning use of meeting rooms. El 3) FINAL READING OF CODE ORDINANCE #2015-16, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 19 COORDINATED PLANNING AGREEMENTS (SEVERANCE), OF THE WELD COUNTY CODE: Commissioner Freeman moved to read Code Ordinance #2015-16 by title only. Seconded by Commissioner Cozad, the motion carried unanimously. Mr. Barker read the title for the record. Tom Parko, Director of Planning Services reported there are no changes since the second reading. Commissioner Moreno moved to approve on Final Reading. Seconded by Commissioner Freeman, the motion carried unanimously. ' 4) FINAL READING OF CODE ORDINANCE #2015-19, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE: Commissioner Cozad moved to read Code Ordinance #2015-19 by title only. Commissioner Moreno seconded the motion, and it carried unanimously. Mr. Barker read the title for the record. Michelle Martin, Department of Planning Services, reported there are no changes since second reading. No public input was offered concerning this matter. Commissioner Moreno moved to approve on Final Reading. The motion was seconded by Commissioner Freeman, and it carried unanimously. 5) FINAL READING OF CODE ORDINANCE #2015-20, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE: Commissioner Freeman moved to read Code Ordinance #2015-20 by title only. Seconded by Commissioner Conway, the motion carried unanimously. Mr. Barker read the title for the record. Ms. Martin presented the changes made in reference to the floodplain to reflect Article 11 and to prohibit the use of steel rings in the floodplain. She stated there are no other changes. No public input was offered concerning this matter. Commissioner Conway expressed this change is in response to regulations of the Colorado Oil and Gas Conservation Commission concerning steel rings in the flood plain which should be removed for public safety. Commissioner Cozad moved to approve on Final Reading. Commissioner Conway seconded the motion, and it carried unanimously. '---- 6) FINAL READING OF CODE ORDINANCE #2015-21, IN THE MATTER OF REPEALING AND REENACTING,WITH AMENDMENTS, CHAPTER 23 ZONING,AND CHAPTER 24 SUBDIVISIONS, OF THE WELD COUNTY CODE: Commissioner Conway moved to read Code Ordinance#2015-21 by title only. The motion, which was seconded by Commissioner Freeman, carried unanimously. Mr. Barker read the title for the record. Ms. Martin presented and described the four(4) changes made to the code. El Commissioner Cozad asked for clarification for Section 23-2-240, number 12. El Mr. Barker suggested it might be best to go over the part concerning off-site signs for clarification processes. No public input was offered concerning this matter. Commissioner Cozad moved to approve on Final Reading with the proposed changes. Seconded by Commissioner Conway, the motion carried unanimously. Minutes, November 9, 2015 2015-3600 Page 3 BC0016 El 7) FINAL READING OF CODE ORDINANCE #2015-22, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 27 PLANNED UNIT DEVELOPMENT, OF THE WELD COUNTY CODE: Commissioner Freeman moved to read Code Ordinance#2015-22 by title only. The motion was seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read the title for the record. Ms. Martin explained the details of the two (2) proposed code changes. No public input was offered concerning this matter. Commissioner Conway moved to approve on Final Reading. Commissioner Freeman seconded the motion, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinances#2015-23 and#2015-24 were approved on First Reading and Code Ordinances #2015-16, #2015-19, #2015-20, and #2015-21, and #2015-22 were approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
