DISTRICTS (LANDSCAPE TURF INSTALLATION, TRUCKING AND TRUCK REPAIR
SHOP ALONG WITH OUTSIDE EQUIPMENT/VEHICLE STORAGE AND STAGING),
PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED
SUBDIVISION MAP OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF
ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL)
ZONE DISTRICT- RYAN GALLATIN AND KAY COLLINS
A public hearing was conducted on June 17, 2015, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated May 15, 2015, and duly published
May 20, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request
of Ryan Gallatin and Kay Collins, for a Site Specific Development Plan and Use by Special
Review Permit, USR15-0022, for any Use permitted as a Use by Right, Accessory Use or Use
by Special Review in the Commercial or Industrial Zone Districts (landscape turf installation,
trucking and truck repair shop, along with outside equipment/vehicle storage and staging),
provided that the property is not a lot in an approved or recorded subdivision map or part of a
map or plan filed prior to adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of
record.
El Chair Kirkmeyer advised Katherine Vorlage, Greeley Attorneys, representing the
applicant, that, since Commissioner Cozad was not able to be present, she had the option of
continuing this matter to a date with the full Board present. However, if she decides to proceed
today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Cozad will
listen to the record and make the determining vote. Ms. Vorlage indicated she would like to
proceed.

El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal
and the location of the site. He stated the property has historically been utilized for rangeland,
and is not in the floodplain or geologic hazard area. Mr. Ogle reviewed the surrounding land
uses and stated staff is requiring screening of the outdoor storage. He stated the property is
within the three-mile referral area for the Towns of Nunn and Pierce; however, municipal referral
responses were not received. He also reviewed the business operations and referral responses.
He entered the favorable recommendation of the Planning Commission into the record as
written and displayed photographs of the site and surrounding area.
El Wayne Howard, Department of Public Works, provided a brief overview of the
transportation plans and requirements. He stated County Road (CR) 29 is classified as a local
gravel road which requires 60 feet of right-of-way, CR 94 is a non-maintained 30-foot
right-of-way, and both roads will be delineated on the plat. Mr. Howard reviewed the anticipated
daily truck trips, with most vehicles arriving and leaving from the south on CR 29. He stated
there is an approved access permit; the entrance gate will be setback so staging traffic does not
block the roadway; the internal circulation will be surfaced with recycled asphalt, and the
engineered water quality feature has been accepted by staff.
• Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions. She stated portable toilets will be provided for the truck drivers, the entrance
will be surfaced with road base for dust control, there will be no washing of vehicles, and
Development Standards 6-13 are typical health standards.
Ms. Vorlage stated Gallatin Turf Installation, is requesting to use this property as their
base of operations for the business. In response to Commissioner Conway, Ms. Vorlage
conferred with her client concerning the number of employees.
El No public testimony was offered concerning this matter.
• Upon speaking with the applicant, Ms. Vorlage stated they would be in agreement with
amending Development Standard #3 to increase the maximum number of employees to 15,
which will accommodate future expansion of the business. In response to Commissioner
Moreno, Ms. Vorlage stated normal business is conducted from 6:00 a.m., to 6:00 p.m.
la In response to Chair Kirkmeyer, Ms. Vorlage stated Ryan Gallatin and Kay Collins
indicated they have reviewed, and have no concerns with the proposed Conditions of Approval
and Development Standards.
• In response to Chair Kirkmeyer, Mr. Howard stated a Drainage Report was not required
and Condition of Approval (COA) #1.A may be deleted; however, he indicated the language in
COA #1.B.10 and 11 is still necessary since the swale is considered a drainage feature and
does tie in with the grading plan submitted yesterday. In response to Chair Kirkmeyer, Mr.
Howard stated the applicant does have the option of using recycled asphalt "or" road base and
CA #1.B.9 was amended to include the word "or." Following discussion, the Board agreed to
delete COA #1.B.10 and modify COA #1.B.11 to read: "Show and label the access turning radii

(60 feet), and parking and circulation on the map." In response to Commissioner Moreno, Ms.
Vorlage confirmed the applicant currently operates with three (3) semis and three (3) pickups.
In response to Commissioner Kirkmeyer, Ms. Vorlage stated the applicants have reviewed, and
agree to abide by, the Conditions of Approval and Development Standards, as amended.
Commissioner Freeman moved to approve the request of Ryan Gallatin and Kay Collins
for a Site Specific Development Plan and Use by Special Review Permit, USR15-0022, for any
Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial
or Industrial Zone Districts (landscape turf installation, trucking and truck repair shop, along with
outside equipment/vehicle storage and staging), provided that the property is not a lot in an
approved or recorded subdivision map or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record and amended. The motion
was seconded by Commissioner Conway, and it carried unanimously. There being no further
discussion, the hearing was completed at 11:07 a.m.
This Certification was approved on the 22nd day of June, 2015.
