NEIGHBORHOOD MEETING Highway 34 Development As soon as Martin Marietta identified this site as a prime location for their facility, they also identified the fact that the site is located near residential uses. Therefore, as soon as Martin Marietta had a conceptual plan for the facility put together, they scheduled an open house style neighborhood meeting to hear from the neighbors about their concerns in order to find ways to address those concerns so that Martin Marietta would be operating on the site as a good neighbor. The neighborhood meeting was held on Tuesday, January 27th at the Best Western Plus at Highway 34 and 1-25. Martin Marietta mailed a notice of the meeting to all neighbors within 500' per Weld County's notification requirements and recognized that word would get out to people outside of that notification area. Over 100 people attended the meeting. Attendees lived within the immediate area as well as in Loveland, Johnstown, Fort Collins, Eaton, and Boulder. At the meeting, the project was explained to attendees, and representatives from Martin Marietta and Tetra Tech were available to answer questions, listen, and take note of the concerns. We also provided comment cards for attendees to fill out to provide their feedback. Martin Marietta kept records of all who attended the meeting and all of the comments received so that we would not overlook any significant concerns raised by neighbors. Attached is a copy of the documentation related to the neighborhood meeting and input received from the neighbors. Documentation attached includes: • Copy of the neighborhood meeting notice that was mailed out to neighbors within 500' of the site. • The list of neighbors notified of the meeting. • The neighborhood meeting sign-in sheet. • A spreadsheet that we used to track the comments received from neighbors. • A copy of the notes taken by Martin Marietta and Tetra Tech staff at the neighborhood meeting. • Copies of emails received from neighbors following an update email sent to neighborhood meeting attendees following the meeting. Highway 34 Development Weld County Use by Special Review Application Page 1 of1 aMartin Mcnetta Open House Notification You are invited to attend an Open House to get information about plans by Martin Marietta for the 131-acre property owned by Gerrard Investments and Weld LV II that is located approximately 1/4 miles south of Highway 34, east of Weld County Road 13/Larimer County Road 1, and north of Weld County Road 56. Martin Marietta is proposing to submit a Use by Special Review application to Weld County to permit the property to allow the land to be used as a plant site for Martin Marietta's operations. Specific uses at the site would include an aggregate processing facility, a recycled product processing facility, an asphalt plant, a ready mix concrete plant, asphalt cement storage and fuel storage. The site would be accessed by both trucks off of WCR 13 and by a rail spur loop planned on the property. Martin Marietta refers to this proposed project as the Highway 34 Development. This project will support the Colorado economy by providing building and construction materials to the northern Colorado construction and agricultural markets. My wife and I build our custom home 10 years ago, planning for retirement. I retired last year and was looking forward to enjoying my retirement, enjoying the orchard I have been grooming, working in our large vegetable garden, and just enjoying our "Million Dollar View" of the mountains. I am very concerned that this asphalt/ concrete plant with rail road is not going to be anything I or anyone would want for a neighbor. Would you want to have this working plant in your back yard? I can only imagine the noise, the dust, and the pollutants that will be in the air. Not to mention the unsightly view I will have out my back door. Why would you ever want to place your industrial site right here?I cannot believe Martin Marietta has to make their money on the plummeting property values of all their neighbors.Can't you be a company that cares about American people. There really isn't enough room for the setbacks needed, the amount of traffic on Hwy 34 is huge already and there was a horrific accident on it yesterday. It is not compatible with the existing subdivision, which was here first. We want quiet, no odor, less intrusive industry, period. We know you have tons of money and will make a nice profit while our property values will go down and we will stand the loss not Martin Marietta. This is always unfair and totally unethical on Martin Marietta's part, since the loss in value is not the result of Colorado economics. I would encourage you to look at Milken, CO and talk to their community leaders. They have already set aside an 12 zone for such a company as yours, and a railroad is nearby. Martin Marietta s Proposed Highway 34 Site Neighborhood Meeting Questions and Comments June 9th, 2015 6: 30-9: 00pm General Presentation Questions and Comments 1 .) Compatibility next to last — not true 2 .) What other locations were looked at? - Along UP line from Loveland airport to Milliken - Issue: difficulty with fitting rail - Access to Interstate System difficult 3.) What will be in empty space inside the rail loop? - Space will be natural vegetation or agricultural 4.) What requirement is there to decrease chances of sparking from rail tracks? - 12 ' clearance buffer between vegetation and rail tracks on each side 5.) Concerning dust and pulmonary disease, will MM be willing to compensate regular health exams of all residents within 2 miles of plant? - MM understands concerns and has hired a medical doctor to look at data - Doctor hired by MM is available to talk to residents to address specific concerns 6.) If this site is rejected, does MM have a back-up plan? - At the moment, MM does not have a back-up site; finding a site with access to rail and highway is challenging 7.) Industrial parks in Weld County: Plant in Greeley/Fort Collins. MM is worth $9 billion and owned by Lockheed Martin . . .Why can t MM expand existing facilities or find a place not so close to other people? Toxic deposits have been shown to exist in a 2 mile radius of an asphalt plant. Shouldn t the company want to be community compatible rather than corporate compatible? - MM looked at expanding their Greeley facility to do rail, was not physically possible - MM would love to have a facility not close so neighbors, but railroad and highway dictate the location of possible sites 8.) The current proposed site has a high water table within 2 of the surface. Will MM conduct ongoing groundwater monitoring of any and all contamination? - MM considered the water table in its design - MM looks to protect groundwater and will look at groundwater monitoring 9.) Will clay liners be used to protect entire site? - No. There will be some areas that are paved. Air/Odor/Health & Safety Questions and Comments 1 .) What systems/plans/alarms are in place if something does go wrong and a system failure occurs? Want information on a hazard analysis to prevent and mitigate. - MM conducts a job safety analysis daily to idenitfy steps, what could go wrong, and what needs to be done if something does go wrong - If something were to fail/occur, employees would respond immediately and shut down the plant. - A root cause analysis would be done to identify the root cause and correct it 2.) How long would it actually take to shut down? What kind of failures could happen? - The plant would be shut down within 5 minutes — most of this time being for equipment to completely stop moving after power is cut - The most common events to occur would be a rip in a conveyor belt or a hole in a chute. - Uncommon events include fires or severe spills. - MM has never had a fire at an asphalt plant that MM operates. 3.) In regards to 2"d opinion studies, wouldn t it be more effective for parties involved to get independent party research done? - MM is willing to work with neighbors and the community on this., 4.) In regards to odor, would MM agree to loss of their USR if they don t comply with a 4x dilution standard? - MM conducted an Airscreen model - Odor isn 't harmful - Vertical tank design controls odor by limiting surface area - Are proposing carbon filters to address odors - filters take out organics and by doing so will remove even more odors - "Odor" is a very subjective parameter - Odors will be way below maximum limits at property line 5.) What was the Airscreen Model method? Location? Wind direction? - It was conducted using data from Fort Collins/Loveland Airport site (closest location) - Involved 10 years of data - Prevailing wind direction:N-S 75% of time; 10- 12% of winds from E; less from W 6.) The USR is so general from reviewing it. What are the concrete and asphalt capacities as well as the recycle process on facility? - Capacity is limited - Numbers for air screen model reflect max capacity of plants - Numbers presented in application will be limit in USR 7.) In regards to odor and no violations in the Fort Collins facility, would you be willing to accept a 4: 1 dilution ratio for violation standards? - The test is subjective so to give it a certain number is difficult to do - MM will consider it and provide a response 8.) Will MM include groundwater monitoring as part of their plan? - MM will look at this and will provide a response as to what they can or can 't do 9.) What kind of smoke will be emitted? - Very little smoke will be emitted due to filters - What you will see coming out is steam; the way you tell it is steam is by seeing that after the first 30-50 ' the steam evaporates and you don 't see it anymore - MM has to do stack testing - Smoke is not emitted since bag filters are used on the stacks 10.) I noted several errors in calculating storm water drainage and the use of ditches and piping to the river. - Drainage calculations per Weld County standards; we cannot mitigate with ditches 11 .) There are two ditches and current vegetation on site. Why not hold water in a retention pond and test to see if it is contaminated? - The storm water permit requires testing of all water leaving the site. - The flow going out will leave at historic levels - Calculations are per Weld County requirements 12.) Will bonds be put in place to protect neighborhood/are there bonds in place elsewhere? Can they be accessed without legal issues? - MM has bonds in place with locations in other states - Bond requirements are tied to permit and if they are not meeting requirements, they're in need of correction. If not corrected, bond becomes available. - This is something MM could consider for this site. 13.) A street sweeper, was mentioned. How much dust will there be if you need a street sweeper and won t the dust just blow all over? - The reason for the street sweeper is that aggregate trucks will be on non-paved surfaces. A street sweeper will help with tracked out material from non-paved to paved areas. Most operations do not have them, but MM is willing to do this. 14.) When will the Community Workgroup happen? - This is usually worked out as part of the USR. - The structure is developed over time and MM will work through this with the community. - Would suggest that the County be involved/have a member 15.) In regards to emissions, people are at great risk. Would MM be willing to install AQI monitoring to alert neighbors if an AQI above 75 was registered? Would MM agree to shut down until air quality improved? - AQI measures ozone, particulates, carbon monoxide, etc. Because of this, different triggers/factors can affect AQI. For example, farming can impact AQI during planting, as well as cars could add VOCs. Ozone alerts happening countywide can be due to oil and gas development. Therefore, it is extremely difficult to isolate the asphalt plant in regards to AQI measurement. 16.) What if the unthinkable happens? Say oil on site blows up. How much oil is on site? - 37, 000 gallons stored in multiple tanks - 24, 000 gallons of emulsified AC - MM is working with the fire district for controls - MM has never had an asphalt plant fire (Illinois asphalt fire found through a Google search was a contractor fire at an MM site) 17.) Do you think you will be compatible if you meet EPA standards? - Yes. 18.) Has MM ever measured the existing environment for sound, etc.? - No, MM has not done this. - MM is taking in additional measures to make sure to keep sounds levels will be lower than permitted levels. Traffic and Rail Questions and Comments , 1 .) I appreciate you moving the rail back 800 ; however, my house on the south side of the rail is still very close to the rail and you aren t moving this back. The dumping of aggregate will create a tremendous noise. - The location of the existing rail and the required rail radius drives what MM can do to locate the rail spur. 2.) Seeing that there will be 1 , 120 truck (round trips), that means there will be 16 miles of trucks (when you account for spacing between trucks) and traffic is already locked up on Hwy 34, how will this site affect traffic and road quality? - The county will require MM to upgrade roads/CR 13. - MM will work with CDOT on a plan for the signal light and intersection design. 3.) My wife has a respiratory problem — will emergency response be affected? - MM had a traffic study prepared to understand projected traffic issues and will be working with CDOT on road improvements. 4.) If the USR is approved, MM employees still get to go home at night. This site is taking away from our quality of life. Eight neighbors are out on extended holiday together, which shows how close this neighborhood is. You ruin our lives if this happens. 5.) Concerned about CR 54 being used by truck to avoid congestion on Highway 34. 6.) How much train traffic is projected? There are 20-25 trains a week; MM will add another 2-3 per week. 7.) This will degrade the neighborhood . Are you will to live there in the open space on the site? Don t do this. 8.) The Kelim Frontage road was said to be "irrelevant." My workers use this road all the time. 9.) What is the market? How far does MM want to reach to sell its product? The size of this facility seems way too big/oversized. - Facility will serve Greeley, Loveland, Ft. Collins and area North of Highway 66 - This is an average sized facility for a rail connected facility like this - The asphalt and ready-mix areas are not much larger than typical 10.) How long will it take to unload? What hours will trains be running? - Unloading will occur during daylight hours - Will not unload aggregates on Sunday - Usually takes 8 hours to unload - If not unloading, train will be parked - MM cannot promise when the train arrives and leaves as that is up to the UP Railroad. MM will work with UP to shorten the window. Visual/Noise/Real Estate Questions and Comments , 1 .) Neighbors didn t want to watch the visual model video so it was turned off before it got to the point that showed views of the facility from the west side of the Indianhead Subdivision looking toward the facility. 2.) Will MM compensate for loss of property values? - MM is still conducting a real estate value study and will look at the issue when the study is complete. 3.) MM is solely responsible of ruining the quality of life of everyone in the room. 4.) We live on CR 56 and look north . There is nothing to prevent us from looking into the plant and there is nothing to block the wind . - MM is looking to do additional screening and additional visual barriers. 5.) There are health issues related to breathing . The quality of life will be destroyed . 6.) Currently, there are no loud noises at night, so how can you prevent the sound level going from 0 decibels to 55 decibels? - MM will look at the area to the south for sound walls. - MM is working to minimize noise levels. 7.) How are studies going to be unbiased and truly reflect what is happening? - MM has to get their air permit from CDPHE and CDPHE will carefully review MM's studies before they will issue a permit. 8.) We live between both train tracks. This will increase train traffic in the area and the noise will affect us. Would you put your house in the middle of all of this? Child is upset every time a train passes their house on the tracks. 9.) How high are the berms? - Currently set at 20 '. 10 .) We live on a hill and will be able to look over the berms anyways. 10 .) I moved to the country to be in the county and don t want to see walls and berms. I don t want to see trucks crossing . There will be dust and aggregate on the roads will make it hard to stop due to rocks and gravel coming out. I see this as industrial area coming in . 11 .) How do you abate the dust? - In facility — water suppression/spray at transfer points - Street sweeper - Water trucks used to keep down trucks - MM can 't allow dust to cross their property lines 12.) MM is not meeting the residential standard at the property line for noise. Would MM be willing to do so? 13.) It will be a big ugly berm, what type of vegetation will be put on the berm? 14.) Sound can jump over walls and berms. 15.) Concerned about trucks during peak hours. Commuters don t have any idea what they are getting into. It will be horrible. 16.) People are taking a lot of time to express concerns, we plead with you to choose another location. 17.) This site will encourage other industrial areas- we are not NIMBY — we are ok with other development. Nothing but industrial will happen and that will drive down home values. Industrial use is incompatible. If this is approved it will begin a nightmare. 18.) Will there be a reclamation bond put in place to put site back to a green place to be sure there is an end to this nightmare? - MM will look at bond options. 19.) County Rd 15 is the only entrance to Indianhead Estates. At times it is hard to get out when trains are there or during rush hours. 20.) Concerned about impacts to emergency response times. 21 .) It s the County Commissioners we need to convince. This is just a job to MM. To us, this is our life. 22.) The worst case is in the summertime when people are outside in their yards. 23.) A slow train going around a curve will cause the wheels to squeal, possibly at 80 db. How can you remove this noise? - MM will look into this and the use of automatic lubricators. Also working with UP to prevent. - Squealing is not expected as part of the project. 24.) Our neighborhood is at less than 50 dB in the daytime and less than 40 dB 25.) Engineers have not studied USGS data 26.) Indianhead will look over any berms, don t use berms, they won t work. 27.) We want to see actual noise readings. 28.) Will the train start and stop during unloading? - The intent is to keep the train slowly moving around the loop 29.) If raw materials come from Wyoming, how does the train come from the south? - The UP line from Wyoming goes south along Hwy 85 and then turns back north toward our site. The line continues past the Hwy 34 site into Fort Collins where it ends. 30 .) The highest level of noise acceptable is listening to the birds on my property. 31 .) Did you extend the invitation to the Planning Commission and Board of County Commissioners? - MM invited Weld County Planning Staff - BOCC won 't attend, they need to decide based on hearing 32.) Vibrations causes low frequency noise that goes over things (like berms). 33.) Property values will be very negatively impacted . This includes a radius of up to five miles or more. Houses will see a 30-50% drop in value. There should be a real estate compensation fund of at least $75 million. 34.) Where do I find the traffic analysis? - In USR application — link to application is on MM's website. 35.) Have you heard of silica dust and silicosis? Are you willing to do a study on the quality of life that this will impact on Indianhead? I encourage people to read about this on the American Lung Society s website.
