Minutes WELD COUNTY COUNCIL February 9, 2015 The Weld County Council met in full conformity with the Weld County Home Rule Charter, Monday, February 9, 2015, at the Weld County Administration Building, Greeley, CO. ROLL CALL: The meeting was called to order by Councilman Abernathy and on roll call the following members were present, constituting a quorum of members thereof: Councilwoman Marge Klein Councilman Brett Abernathy Councilman Don Mueller Councilman Jordan Jemiola-Absent Councilman Charles Tucker Also present: County Attorney, Robert Frick, and Sarah Mundt, Council Secretary. APPROVAL OF AGENDA: Councilman Mueller made a motion to approve the February 9, 2015 agenda. The motion was seconded by Councilman Tucker and the motion carried. APPROVAL OF MINUTES: • Formal Approval of the January 19, 2015 Minutes, Councilman Mueller motioned to accept the Minutes. The motion was seconded by Councilman Tucker and the motion carried. PRESENTATION: County Attorney, Robert Frick County Attorney, Robert Frick, is the Weld County Attorney as of December 1, 2014. Mr. Frick went to school at Creighton Law School in Omaha, Nebraska, and did his undergraduate work in Political Science and Business at the University of Iowa. He moved to Colorado where he did some real-estate development before being named a Deputy District Attorney and appointed to a Judge in the City of Greeley. He then accepted the position as the hearings manager with the Colorado State Oil and Gas Conservation Commission before returning to Weld County where he is happy to join Team Weld County. The Weld County Attorney's Office has eight full-time attorneys and one contracted attorney. There are also four support personnel. The County Attorney's Office represents Clients, those being the Board of County Commissioners, and the Board delegates the authority for the County Attorney's office to represent the County Departments and the Council, each as a client. The County Attorney's office is divided into 2 areas, Department of Human Services (largest area) and General 2015-4095 Cluvnmunn ) ,5-9 0209/l0 Weld County Council February 9,2015 Minutes Services (smaller in size but broadest in nature). Bruce Barker was retained on a part- time nature to support Mr. Frick and do the Legislative hearings. Mr. Frick's statement on the Mileage question that was addressed in several Council meetings and addressed again at the February 9 meeting, specifically to address the County Commissioner's mileage allowance: Any elected official may receive mileage, in Weld County and around the State. This has been the practice in Weld County long before the Charter was enacted. The Charter does have provisions to allow for mileage reimbursement for elected officials. This is a common practice and is considered to be a business expense. County Commissioners are bound by District Representation and are not allowed to move closer to their"place of work". Also, "job duties"for County Commissioners are continuous and often of an "on call" nature. The Board has the policy to acknowledge these situations and their policy is supported by State Law and the Charter. Robert Frick would like that the Council make a good record. Follow Roberts Rules so that he can best represent the Council if need may arise.
