RESOLUTION
WHEREAS, it has been determined by the Board of
County Commissioners, Weld County, Colorado, that a certain
tract of land, being the property of Larry Kammerzell,
Greeley, Colorado, and more particularly described as
follows, to-wit:
The Northwest Quarter of Section 29 , Township 5
North, Range 66 West of the 6th P. M. , Weld County,
Colorado, also the North Half of the North Half of
the Southwest Quarter of Section 29 , Township 5
North, Range 66 West of the 6th P. M. , Weld County,
Colorado.
BEGINNING at the North Quarter corner of said
Section 29; thence along the North line of said
Northwest Quarter North 89°39 ' 42" West 2631. 18 feet
to the Northwest corner of said Section; thence
along the West line of said Northwest Quarter South
0°18 ' 33" West 2635. 09 feet to the West Quarter
corner of said Section; thence along the West line
of the North Half of the North Half of the Southwest
Quarter of said Section South 0°22 ' 45" West 658. 77
feet to the Southwest corner of said North Half;
thence along the South line of said North Half South
89°25 ' 36" East 2645. 16 feet to the Southeast corner
of said North Half; thence along the North-South
centerline of said Section North 0°04 ' 52" East
3304. 74 feet more or less to the point of BEGINNING.
The above described parcel is subject to a 30. 00
foot wide reservation for County Road right of way
along the Westerly, Northerly, and Easterly sides
thereof.
The above described parcel contains a gross acreage
of 199. 79 acres more or less , and
does not come within the purview of the definition of the terms
"subdivision" and "subdivided lands" as set forth in CRS 106-2-
33 (a) and (b) 1963 , as amended, and
WHEREAS, the Board of County Commissioners of the
County of Weld, State of Colorado, desires to exempt this particular
division of land upon the recommendation of the Weld County Zoning
Administrator for the reasons as stated and pursuant to its
authority under CRS 106-2-33 (d) , 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Larry Kammerzell, Greeley, Colorado,
be exempt from the definition of the terms "subdivision" and
"subdivided lands" as provided for in the new Weld County Subdivision
Regulations at Section 201 A. , (3) adopted August 30 , 1972 , as
amended.
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the 14th day
of April, A. D. , 1976.

RE: Recorded Exemption - 200
Dear Commissioners:
The attached application, plat and related items are in reference to a
request by Larry Kammerzell , for a Recorded Exemption. The parcel in
questions is described as the NWa and the NZ of the SWq of Section 29,
T5N, R66W of the 6th P.M. , Weld County, Colorado. Said property con-
tains 199.79 acres more or less. The request is to split off a 1 .76
acre parcel with the improvements from the remainder of the parcel .
Their intention is to sell the existing improvements, which do not
adequately meet their housing needs, and build a new set of improve-
ments in the southwest corner of the property on a piece of non-irri-
gated waste land which is separated from the remainder of the farm by
an irrigation ditch. If the Kammerzells were to expand the existing
improvements in the NE corner so that they adequately met their housing
and farm storage needs, they would be consuming prime irrigated agri-
cultural land whereas their proposed building site in the southwest
corner would be consuming non-irrigated waste land.
Based upon the information submitted, the Planning Commission staff
recommends approval for the following reasons:
1. The proposed split conforms with the intent clause Section 9-2 of
the Weld County Subdivision Regulations, the Weld County Compre-
hensive Plan, and the intent clause for the Agricultural District,
Section 3.3 (A) of the Weld County Zoning Resolution, since non-
productive agricultural lands are being developed for a higher and
more productive use. The use would be compatible with surrounding
agricultural uses.
2. As explained by the Kammerzells, expansion of the existing improve-
ments would consume prime agricultural land whereas the installation
of a new set of improvements at the proposed site would be consuming
non-irrigated waste land which is severed from the remainder of the
f. by an irrigation ditch;

Gentlemen:
The present facilities are inadequate for our needs. There are
presently 6 people living in a small house and the machine shed does
not have high enough ceiling clearance for modern farm equipment,
I now own and have to store outdoors with no crotection.
To correct these deficiencies, additional farm land would have
to be taken for construction of suitable and needed facilities.
It is my opinion that the construction of these facilities could
be better carried out on a piece of waste land located on the
South-West corner of my farm; therefore I propose to sell the present
imrrovements and build a new and larger home and machine shed.
