BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MARCH 11 , 2015
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building , Greeley, Colorado, March 11 , 2015, at the hour of 9: 00 a. m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:

El MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of March 9, 2015, as printed . Commissioner Moreno seconded the motion,
and it carried unanimously.
AMENDMENTS TO AGENDA: Per Board's direction , Bid Approval item #2, has been amended
to reflect the quantity of eight (8) bridge repairs. Per Judy Griego , Director of Human Services , the title
for agenda item #2 will be changed to read , "Approve Acceptance of Allocation and Budget for
Employment First Program and authorize Chair to sign. " Further, per the County Attorney, item #3 will
be changed to read, "Consider Establishing the Neighborhood to be Served, Designating a
Commissioner to Make On-Site Inspection and Setting the Hearing Date Concerning the Application of
Carpco , LLC, and 7-Eleven Inc. , dba 7-Eleven Store #39510, for a 3. 2 Percent Beer Retail License."
e CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed .
Commissioner Freeman seconded the motion , and it carried unanimously.
PUBLIC INPUT: Steve DeVries, resident of Platteville, expressed his concern over the serious
increase in trash being dumped along the County roads and stated his interest in creating a rural
garbage company called the "Clean Up Colorado Campaign" with his partner, Mr. Johnson . Mr. DeVries
stated he is curious about how to put something together because they are currently cleaning up on a
voluntary basis and they are asking for the County's help. Dickie Johnson , Greeley resident, stated he
has lived in Colorado since 1964, and expressed his agreement that this problem is getting worse. He
stated it seems there is trash , mattresses , and other big items being dumped everywhere, and as
stated above is interested in providing a service to the rural community. Commissioner Conway stated

from the pictures submitted, marked Exhibit Al it seems CR 18 is a real problem , and suggested they
discuss these pictures and issues with the Director of Public Works, Jay McDonald, and give him their
contact information for further consideration. Commissioner Conway also listed some places in the
community that will pick up or accept items to be dropped at their location for free and made various
other suggestions notably for the public. He expressed his thanks to both gentlemen for their concerns
and efforts. Commissioner Cozad expressed her appreciation for their interest in this problem and
taking the time to come today stating she has also noticed the problem . She further mentioned the
successful "Adopt a Road Program" and suggested similar solutions may be worth investigating .
VI COMMISSIONER COORDINATOR REPORTS : Commissioner Moreno reported that all the
Commissioners are invited to the presentation for the creation of a community Grief Center, April 23,
2015 , at the Greeley Country Club. Brian and Brooke Griese will be speaking about their efforts to
create and run the Judy House in Denver. Commissioner Moreno mentioned he and Commissioner
Cozad attended the Colorado Central Board meeting . Their presence was appreciated as they are
preparing to celebrate 50 years of existence. Further, he reported being invited to the Rocky Mountain
Industry Summit and asked to participate in a discussion regarding the Oil and Gas Task Force. The
summit was well attended and the discussions were beneficial to the community. la Commissioner
Freeman reported being invited to tour the new Banner Health Facility in Fort Collins prior to the grand
opening scheduled for April 6, 2015. He stated it is a state-of-the-art facility and will reportedly
specialize in certain procedures and services while the existing facilities specialize in various other
services making it a regional cooperation of the three hospitals. Chair Kirkmeyer reported
attending the Floodplain Open House in Kersey with Commissioner Cozad and stated it was very well
attended . She credited Tom Parko and his Planning staff for the exceptional presentation and the
outstanding manner in which they represented Weld County. Chair Kirkmeyer further reported attending
the Kersey Town Board Meeting and stated the discussion regarding County Road 49 was positive.
Commissioner Conway reported attending the 2015 Upstate Colorado Annual Meeting Reception
where they recognized Anadarko as the Business of the Year, and Berthoud as the Community of the
Year. The organization also recognized Eric Berglund for his contributions as Director and stated they
are in the final phase of the selection process to hire a new director for Upstate. Secondly, at the MPO
meeting , Colorado Park and Health gave an Ozone update reflecting the new standards and new
testing parameters. Commissioner Conway submitted two maps as Exhibit B, which display the
compliance statistics with the new ozone standards. Lastly, he attended the South Platte Round Table
meeting where a resolution was unanimously passed regarding a Dewatering Plan to lower the water
table during seasons of flood hazard . CI Commissioner Cozad reported attending the Town of Mead
Board Meeting where concerns were discussed regarding the I-25 cooridor signage for merging lanes
and also future growth and expansion concerns as the coalition moves forward with seeking funding .
She and Commissioner Conway also attended a presentation at the Human Services Division
regarding demographics and future growth . She stated the population growth was projected to double
for Weld County by 2040 and it was discussed what a huge impact that would have on County
Services. The presentation can be found on the State website. Commissioner Moreno attended a
Coffee with Cozad and expressed his support for the positive opportunity to connect with the
community.
BIDS :
IR 1 ) APPROVE BID #B1500040, HAZARD MITIGATION PLAN UPDATE — OFFICE OF
EMERGENCY MANAGEMENT: Trevor Jiricek, Director of General Services, presented the terms of
the agreement and recommended approval of the award to Michael Baker International for the sum of
$79, 536. 00. Roy Rudisill , Director of Office of Emergency Management, stated some of the features
provided by Acadis were beyond the scope of the proposal ; however, the additional services may be

considered to meet future needs. The motion to approve the low bid, which was made by
Commissioner Conway, and seconded by Commissioner Freeman, carried unanimously.
Ei 2) APPROVE BID #B1500022, BRIDGE REHABILITATIONS - 2015 (QTY 8) -- DEPARTMENT
OF PUBLIC WORKS: Mr. Jiricek stated the stipulations of the project and the recommendation to
award the project to Weld County Construction, Inc. , for a total amount of $273, 181 .00. The
Department reduced the number of bridges to be repaired from 10 to 8 to meet the parameters of the
budget. Jay McDonald , Director of the Department of Public Works, and Richard White, Department of
Public Works, explained the process of reviewing cost estimates for the projects to meet the repair
needs in conjunction with the budget and stated each year costs increase and they attempt to add a
percentage to estimate the costs for the budget. In response to Chair Kirkmeyer, Mr. White clarified the
method of scoring and Mr. McDonald stated he would get the exact scores to the Board along with a
map of all the subject bridges. He further stated this contractor has completed similar work for Weld
County in the past. The motion , which was made by Commissioner Freeman , and seconded by
Commissioner Conway, carried unanimously. (Clerks Note: the Quantity of bridges has been amended
to reflect the correct number of bridge repairs.)
NEW BUSINESS:
e 1 ) CONSIDER APPLICATION FOR SCIENCE, TECHNOLOGY, ENGINEERING AND
MATHEMATICS (STEM) CAREER PATHWAY FUNDS AND AUTHORIZE CHAIR TO SIGN: Judy
Griego, Director of the Department of Human Services, presented the application for funds that are
available through the Colorado Education Initiative related to developing career pathways for youth to
acquire in-demand middle-skills jobs in STEM occupations. Ms. Griego stated they are proposing a
partnership with Aims Community College to create a certificate program. In response to Commissioner
Conway, Ms. Griego explained how the applicants are chosen for the program . Commissioner Cozad
moved to approve said application and authorize the Chair to sign . The motion was seconded by
Commissioner Moreno, and it carried unanimously.
e 2) CONSIDER ACCEPTANCE OF ALLOCATION AND BUDGET FOR EMPLOYMENT FIRST
PROGRAM AND AUTHORIZE CHAIR TO SIGN : Ms. Griego requested the title be amended to reflect
acceptance of the budget. She went on to state the terms of the acceptance and the stipulations of the
program which require work participation for able bodied adults who are receiving food assistance.
Commissioner Conway moved to approve said Acceptance and authorize the Chair to sign . Seconded
by Commissioner Cozad , the motion carried unanimously. (Clerk's Note: The title has been amended to
reflect acceptance of the budget)
3) CONSIDER APPLICATION FOR 3. 2 PERCENT BEER RETAIL LICENSE ISSUED TO
CARPCO, LLC , AND 7-ELEVEN INC. , DBA 7-ELEVEN STORE #39510, AND AUTHORIZE CHAIR TO
SIGN : Bob Choate, Assistant County Attorney, presented the Application and stated because the
license expired months ago, it is considered a new Liquor License application which should be
amended to reflect needing a Commissioner visit, and a new hearing . Mr. Choate recommended it be
continued to March 30, 2015, to allow a Commissioner to visit the establishment and set the
neighborhood parameters, prior to considering the application . After further discussion, the board
deemed it necessary to move this item to the end of the hearing .
ID (Clerk's Note: The Board returned to this item.) In response to Chair Kirkmeyer, Mr. Choate
stated the Clerk to the Board has since amended the resolution to reflect designating the neighborhood
and setting a commissioner inspection, suggesting a hearing on March 30, 2015. Commissioner
Conway moved to continue consideration of the Liquor License Application to March 30, 2015. The
motion, which was seconded by Commissioner Freeman , carried unanimously. e Further, Chair

Kirkmeyer recommended amending the agenda to add the aforementioned and amended item as
hereby stated: "Consider Establishing the Neighborhood to be Served , Designating a Commissioner to
Make On-Site Inspection and Setting the Hearing Date Concerning the Application of Carpco, LLC, and
7-Eleven Inc. , dba 7-Seven Store #39510, for a 3.2 Percent Beer Retail License." Commissioner
Conway made a motion to amend the agenda to add the item as discussed, and Commissioner
Freeman seconded the motion . It carried unanimously.
ea Therefore, the aforementioned and amended item for consideration at this time is: CONSIDER
ESTABLISHING THE NEIGHBORHOOD TO BE SERVED, DESIGNATING A COMMISSIONER TO
MAKE ON-SITE INSPECTION AND SETTING THE HEARING DATE CONCERNING THE
APPLICATION OF CARPCO, LLC, AND 7-ELEVEN INC . , DBA 7-ELEVEN STORE #39510, FOR A 3.2
PERCENT BEER RETAIL LICENSE: Mr. Choate presented the neighborhood description,
recommended setting the date for the application hearing for March 30, 2015, further stating
Commissioner Cozad has agreed to perform the on-site inspection . Commissioner Conway made a
motion to establish the neighborhood, assign Commissioner Cozad to inspect the premises, and set the
hearing date for March 30, 2015. Seconded by Commissioner Freeman, it carried unanimously.
IR 4) (Clerk's Note: This item was also moved to the latter part of the hearing.) CONSIDER
ESTABLISHING THE NEIGHBORHOOD TO BE SERVED, DESIGNATING A COMMISSIONER TO
MAKE ON-SITE INSPECTION AND SETTING THE HEARING DATE CONCERNING THE
APPLICATION OF RM , INC. , DBA ROOM 119 NIGHT CLUB, FOR A TAVERN LIQUOR LICENSE:
Mr. Choate presented the Consideration for Establishment and recommended setting the date for the
application hearing for March 30, 2015, further stating that Commissioner Cozad will also perform this
on-site inspection . Commissioner Freeman moved to establish the neighborhood, assign
Commissioner Cozad to inspect the premises, and set the hearing date for March 30, 2015.
Commissioner Moreno seconded the motion, and it carried unanimously.
12 5) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR USE OF GUEST NETWORK
CONNECTION AND AUTHORIZE CHAIR TO SIGN - COLORADO STATE PATROL: Frank Haug,
Assistant County Attorney, stated the terms which give the Colorado State Patrol permission to access
the internet via the County's network in the southern part of the county. Commissioner Conway moved
to approve said agreement and authorize the Chair to sign. The motion was seconded by
Commissioner Moreno, and it carried unanimously.
6) CONSIDER TEMPORARY CLOSURE OF CR 31 BETWEEN CR 80 AND HIGHWAY 14:
Janet Lundquist, Department of Public Works presented the terms of the closure effective April 6, 2015,
through April 10, 2015, for a culvert replacement. Magnesium Chloride will be used for dust abatement
and message boards will be used along the detour route due to traffic volume. Notifications of the
closure will be sent to school districts, emergency services and residents. The motion to approve said
temporary closure, which was made by Commissioner Conway, and seconded by Commissioner
Moreno, carried unanimously.
IQ 7) CONSIDER TEMPORARY CLOSURE OF CR 84 BETWEEN CR'S 15 AND 19: Ms. Lundquist
presented the closure details effective March 30, 2015, through April 3, 2015 , for a culvert replacement.
Water will be used for dust abatement, and message boards will not be necessary. In response to
Commissioner Conway, Ms. Lundquist stated surrounding property owners will be notified and staff will
work with agriculture traffic to ensure safe passage during the time of construction. Commissioner
Moreno moved to approve said temporary closure. The motion was seconded by Commissioner
Conway, and it carried unanimously.

8) CONSIDER PETITION AND AUTHORIZE VACATION OF A 60-FOOT EASEMENT ALONG
CR 49 - ROBERT SWARTZ: Brad Yatabe, Assistant County Attorney, presented the vacation of
right-of-way. Rich Hastings, Department of Public Works, stated staff made sure this would not impact
the CR 49 project and that, per Leon Sievers, this appears to be an old wagon trail road that was
abandoned and it would be best to document the vacation for County records. Mr. Yatabe agreed this
action also creates a record for the homeowner to alleviate any future disputes in the event they should
develop this area or sell this parcel . In response to Chair Kirkmeyer, Mr. Yatabe clarified there are two
portions being vacated .
U Robert Swartz, property owner, stated he is requesting the vacation to allow long-term planning
regarding oil and gas interests and further to institute the documentation in the event they choose to
sell . Mr. Swartz sent a letter to neighbors initiating the petition to the landowners affected by the
vacation and stated he is representing his mother. In response to Chair Kirkmeyer's concern for the
other landowners, Mr. Yatabe clarified the legal process of providing the notice of a hearing .
IR Scott Kinnison, neighbor and owner of part of the subject right-of-way property, stated he received
the letter and is in agreement with the vacation because it runs across his acreage splitting it unevenly.
Alvin Davis, neighbor and landowner, also supports the vacation for the same reasons mentioned by
Mr. Kinnison .
e- Mr. Yatabe stated that if the Board has concerns for other property owners not present, they may
approve to vacate portions of the right-of-way. Chair Kirkmeyer stated she is generally in support
because the vacation cleans up the abandonment. Her concerns include not vacating any portion that
crosses a section line because any section line has the potential to become a road in the future.
Secondly, Chair Kirkmeyer shared her concern for the other property owners who are not present and
should have a say. Commissioner Freeman agreed; however, he clarified the other property owners
were notified and could have been present. Commissioner Conway suggested other property owners
be named in the Resolution and , in response, Mr. Yatabe suggested language to amend the resolution ,
and clarified by Chair Kirkmeyer to add that "60-feet within any section line not be vacated. "
Commissioner Conway made a motion to approve the amended language for the Resolution .
Commissioner Cozad seconded the motion and it carried unanimously. Futher, there was a motion
made to approve the amended resolution, which was made by Commissioner Conway, and seconded
by Commissioner Freeman , and it carried unanimously.
9) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES AND AUTHORIZE CHAIR TO
SIGN - MAXIMUS CONSULTING SERVICES, LLC: Barbara Connolly, Controller, presented the terms
of the Agreement recommending approval . Commissioner Freeman moved to approve said Agreement
and authorize the Chair to sign. Seconded by Commissioner Moreno , the motion carried unanimously.
RESOLUTIONS AND ORDINANCES : The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
