Owner indicated the structures would be gone (at the latest) in 6 months. • 06/14/2013 — Notice of Intent to Proceed Letter sent. Never dealt with Mr. Lange from this point on. • 11/08/2013 — Case forwarded to Courts To elaborate on the timeline above, the property owner indicated that the units were being stored for a church located in Denver who wanted to use the units on their property as axillary offices and classrooms. Staff contacted the church and began working with them to remedy violation. The church encountered issues with Denver planning and zoning. Weld County Planning Director granted several extensions in hopes that the issues with Denver would be resolved. This latitude is reflected in the gaps you see in the timeline provided. Unfortunately, the church couldn't get the issues with Denver resolved and the units remained on the property for over a year. Department continued to receive complaints about the units and forwarded the case to legal. During the violation process additional time was given via a stipulated agreement. The owner was assessed an initial penalty of$500.00 followed by daily penalty assessments of$20 per day. The units sat on the property for more than a year which racked up a total of$6,020 in fines. The church voluntarily agreed to pay the fines on behalf of the property owner because the fines in the County were still substantially less than the permit fees (and red tape) Denver was assessing. The Commissioners didn't have to certify the fines because the church paid the fines in-full and the violation was closed. The property has been in compliance since May 2015. According to PW, counts were done on each mile of CR 41. The first mile from CR 4 to CR 6 had an average of 79 vehicles per day; the second mile from CR 6 to CR 8 on the east side of I- 76 had an average of 57 vehicles per day; and, the half mile on the west side of I-76 from the I- 76 frontage road to CR 8 had an average of 129 vehicles per day.
