Subject: Compliance with Development Standards, USR-900
Legal: Part of the SE4 NW4 and NE4 SW4 Section 33, T6N, R66W
Dear Daniel and Mildred Buxman:
The Department of Planning Services has identified a part of this property to be regulated by USR-900 a
Special Use Permit for a Gravel Mining Operation in the Agricultural Zone District as stated in the Board of
County Commissioners Resolution of March 7, 1990. As stated in the Resolution, the operation of the
mining operation is subject to the application materials and Development Standards for this land use
application.
That being stated, staff visually identified stockpiles of overburden placed in an area that is designated on
the FIRM Community Panel Map number 080266 0609 D, dated September 27, 1992 and Floodway Map
number 080266 0003, dated September 28, 1990. Placement of overburden in the floodplain and
floodway is a violation of Development Standard number 5, that states"The property shall be maintained
in compliance with the Weld County Flood Hazard Overlay District Requirements;"and Development
Standard number 6, that states"The property shall be maintained in compliance with Section 404 of the
Clean Water Act, if applicable."
The placement of this material in this area is of concern, not only from a permitting perspective, but also
from a potential flood issue. Granted, the State and County are experiencing a drought, however, given
the extremely dry and parched site conditions this only amplifies the potential for sheet flooding and
erosionary processes.
To correct this issue, it is requested that the overburden be removed out of the floodplain and floodway
immediately. A follow-up site investigation will be performed on July 9, 2004 to verify compliance with this
letter.
