RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR15-0019, FOR A KENNEL (UP TO 35 DOGS) IN THE A (AGRICULTURAL) ZONE
DISTRICT-ANNE BACKSTROM
A public hearing was conducted on July 22, 2015, at 10:00 a.m., with the following present:

The following business was transacted:
• I hereby certify that pursuant to a notice dated June 19, 2015, and duly published
June 24, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request
of Anne Backstrom, for a Site Specific Development Plan and Use by Special Review Permit,
USR15-0019, for a Kennel (up to 35 dogs) in the A (Agricultural) Zone District. Brad Yatabe,
Assistant County Attorney, made this a matter of record.
• Chair Pro-Tem Freeman advised Rose Netto, representing the applicant, that, since
Commissioner Kirkmeyer was not able to be present, she had the option of continuing this
matter to a date with the full Board present. However, if she decides to proceed today, it will
require three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to
the record and make the determining vote. Ms. Netto indicated she would like to proceed.
• Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and stated the applicant's intent is to increase the number of dogs from ten (10) to 35,
construct a new kennel building, and grow the family business. He explained there will be no
training of dogs on-site and access to the facility is by appointment only, and limited to four
families per weekend. Mr. Gathman described the adjacent properties, nearest residence, and
stated there are existing USRs for kennels in the immediate area which makes it a good fit for
the existing location. He reported 14 referrals were sent out and staff received seven (7)
responses indicating no conflicts; and, there have been no letters or phone calls from
surrounding property owners objecting to this application. He reviewed the Development
Standard requiring the dogs be kept indoors at night and stated the site is within the three (3)
mile referral area of the Towns of Gilcrest and Platteville. Mr. Gathman displayed photos of the

location and surrounding properties and entered the favorable recommendation of the Planning
Commission into the record as written.
Jennifer Petrik, Planning Services Engineer, provided a brief overview of the
transportation plans and requirements to include the average daily traffic counts for the relevant
county roads, and potential number of vehicle trips as being four (4) per weekend, by
appointment only. She stated the Access Permit has been approved for a small commercial
access, AP#15-00169, and reviewed the appropriate tracking control materials. Ms. Petrik
further stated the site is not in a geologic hazard or floodplain area; however, there is a natural
depression area that is acceptable as a water feature. She reviewed the relevant Development
Standards and in response to Commissioner Cozad, explained the basic requirements include
tracking control.
• Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions stating that Central Weld County Water District provides water to the site and
the applicant has applied for a separate septic permit which needs to be installed prior to
operation. She reviewed the Waste Handling Plan, driveway materials and the noise
restrictions.
El Ms. Netto stated the family has raised dogs for many years and wants to increase the
number of dogs and grow the business. She reviewed the positive support of the neighbors and
reiterated there are existing kennels on both sides of the property making it a good fit for the
neighborhood. Ms. Netto clarified the proposal will not be taking any land out of agricultural
production and stated the gravel road is currently maintained by Anadarko. In response to
Commissioner Cozad, Ms. Netto stated the hours of operation are acceptable and that the new
building will have nine (9) kennel runs which provides enough room for the dogs to be kept
indoors at night. In response to Commissioner Conway, she clarified visitors to the site are
limited to four (4) families each weekend, by appointment only, and many of those are previous
clients.
• No public testimony was offered concerning this matter.
• Commissioner Conway suggested deleting Condition of Approval (COA) #1.B.8.
Commissioner Cozad asked for clarification regarding the referral from the fire district, to which
Mr. Gathman explained the possibility of a clerical error because there was no letter submitted,
only the notes at the bottom of the page. She further recommended amending Development
Standard (DS) #5 to reflect daylight hours. Laurie Mining, Anne's daughter and co-owner of the
business, explained the family activities that include the dogs such as 4-H and FFA, and agreed
that daylight hours would work better. Commissioner Conway suggested daylight hours with
provision for later hours during the summer months. Mr. Yatabe interjected it would be best to
set clear parameters such as 10:00 p.m. to 6:00 a.m., to eliminate the variability of "daylight
hours". In response to Commissioner Moreno, Ms. Netto clarified how noise is monitored and
reminded staff that the kennel is located in the middle of 119 acres. The Board agreed with the
recommended amendments and Chair Pro-Tem Freeman reviewed the changes for the
applicant.

Commissioner Moreno moved to approve the request of Anne Backstrom, for a Site
Specific Development Plan and Use by Special Review Permit, USR15-0019, for a Kennel (up
to 35 dogs) in the A (Agricultural) Zone District, based on the recommendations of Planning staff
and the Planning Commission, with the Conditions of Approval and Development Standards as
amended and entered into the record. The motion was seconded by Commissioner Conway,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:37 a.m.
This Certification was approved on the 27th day of July, 2015.
