CONDITIONS OF APPROVAL #1.B.3, #1.L AND DEVELOPMENT STANDARDS #4
AND #27 - JAY AND SHERRIE WOODS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 12, 2009, the Board of County Commissioners approved the
application of Jay and Sherrie Woods, 2500 West F Street, Greeley, Colorado 80631, for a Site
Specific Development Plan and Use by Special Review Permit #1651 for a Use Permitted as a
Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone
Districts (lawn and tree care business) in the A (Agricultural) Zone District, on the following
described real estate, being more particularly described as follows:
Part of the SW1/4 SE1/4 of Section 36, Township 6
North, Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board of County Commissioners has been presented with a request from
Jay and Sherrie Woods to relocate and enlarge the proposed shop building from 100 X 60 to
100 X 80 feet, and to remove the screening requirement, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendation of the
Weld County Department of Planning Services and all of the exhibits and evidence presented in
this matter and, having been fully informed, finds that this request shall be approved to relocate
and enlarge the proposed shop building from 100 X 60 feet to 100 X 80 feet and to delete the
following:
Condition of Approval #1.B.3 - Prior to recording the plat, the plat shall be amended to
delineate the following: "3. The approved Screening Plan."
Condition of Approval #1.L - Prior to recording the plat: "L. The applicant shall submit a
Screening Plan to the Department of Planning Services, for review and approval."
Development Standard #4 - "All outdoor storage and vehicle parking shall be screened
from adjacent properties by an opaque privacy fence. Outdoor storage shall not
extend above the top of the privacy fence."
Development Standard #27 - "The screening on the site shall be maintained in
accordance with the approved Screening Plan."

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request to relocate and enlarge the proposed shop building from
100 X 60 feet to 100 X 80 feet be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that Conditions of Approval #1.6.3, #1.L, and
Development Standards #4 and #27 for Use by Special Review Permit, USR-1651, on the
hereinabove described parcel of land be, and hereby are, deleted.
BE IT FURTHER RESOLVED by the Board that all other Conditions of Approval and
Development Standards included in Resolution #2009-1632, approved on August 12, 2009,
remain in full force and effect.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of March, A.D., 2015.

SUBJECT: Proposed changes to the layout of USR-1651 and reconsideration of
conditions of approval for USR-1651
Location: South of and adjacent to"F" Street and 1/8 mile east of"C" Street.
Legal Description: Part of the SW4SE4 of Section 36, T6N, R66W.
Request: Consider modifications prior to recording the plat for Use by Special Review Permit USR-1651 -
A Site Specific Development Plan and Use by Special Review Permit for a Use by Right, Accessory Use,
or Use by Special Review in the Commercial or Industrial Zone Districts (Lawn and Tree Care Business)
in the A(Agricultural) Zone District. The proposed modifications include: 1) relocating the proposed shop
building and 2) enlarging the shop building from 100 x 60 feet to 100 x 80 feet. The applicant is also
requesting to remove the screening requirement soutlined under conditions of approval 1.B.3, 2.L and
Development Standard#4 and Development#27.
Background: USR-1651 was approved by the Board of County Commissioners on August 12, 2009. The
USR-1651 plat has not been recorded. USR-1651 (at the initial hearing to consider rescinding the
approval of USR-1651)was referred back to staff on January 23, 2012. The original applicant(Jay
Woods) is no longer involved with the application. His son—Brad Woods has been wrapping up the
remaining conditions of approval and finalizing the plat.
Should the Board approve this, the following modifications would be required to the USR-1651 resolution:
• Remove Prior to recording the plat condition 1.B.3
• Remove Prior to recording the plat condition 1.L
• Remove Development Standard#4
• Remove Development Standard#27
Staff Recommendation: Staff has no issues with relocating the proposed shop building and expanding the
size of the proposed building.
Staff went out and looked at the site and adjacent areas. There is Use by Special Review Permit with
outside storage of equipment associated with Use by Special Review Permit USR14-0007 (office and
equipment storage for a concrete construction company) on the property to the east of this site and a
there is outdoor storage of vehicles on the west end of the parcel to the west of this site. Based on the
uses in the surrounding area, staff has no issues with the request to remove the prior to recording the plat
conditions 1.6.3 and 1.L and development standards#4 and#27.

The FHDP Map I am working on is attached, It shows where I feel the building should be
located. The proposed building location from the USR blocks storm water flows across
the property. The location I am proposing is 70' to the south. Two things happen here,
the storm water flows will continue across the site in the historic drainage pattern and
less fill will be required to get the building elevated above the BFE. Mr. Woods would like
to raise the building 1.5' above the BFE.
Mr. Woods is also requesting an increase of the building size from 60' by 100' to 80' by
100'. He is willing to take this to the county commissioners if required.
The last question is for engineering development and review. What will be required,
Water Quality Capture Volume (WQCV) or a full detention/Drainage report. I am
assuming that the change in the site I value will be less than 10%, however, I have not
calculated that value at this time.

1. Use the Cache La Poudre Study.
2. Do you or Brad have a drawing showing the change. I and possibly Engineering will need to take a look
at it. I need to compare what is proposed vs. what was presented at the land use hearings. I will need to run
this by staff. On many of these items/changes - when the plan differs from what the BOCC approved -we
have to take it back before the Planning Commission for reconsideration.

Couple of things for the USR.
1 . Sheet 2 of 2 is showing the Firm Map, the county is now using the Cache La Poudre River study.
Do we switch these out and use map panel 3 of the New study.
2. Is the proposed build size set in stone (60' by 100'), this building size was set by Jay Woods.
As Jay has passed, Brad Woods is now in charge and he would like to upsize the proposed building
to a 80' by 100' building. Is this worth the effort to change the proposed building size
I have started on the Flood Hazard Development Permit and I need to know what the building size is
going to be.
