Highland Ditch Company shall defend, indemnify and hold harmless County, its elected officials, its
officers, agents, and employees, from and against injury, loss damage, liability, suits, actions, or claims of
any type or character arising out of the work done in fulfillment of this project or on account of any act,
claim or amount arising out of the failure of the Highland Ditch Company to conform to any statutes,
ordinances, regulation, law or court decree. Highland Ditch shall be fully responsible and liable for any
and all injuries or damage received or sustained by any person, persons, or property on account of this
project.
