Everist , Inc . , I will respond to. your August 3 15 , 2015 adequacy review letter concerning Struc - ture agreements . While I disagree with your assessment that we need attempt to or obtain structure agreements with parties that have chosen to encroach within the 200 - foot limit of an existing mine , I will agree that it is something than may need to be resolved with a change in the statute . Attached is Adequacy Map Exhibit AR , an excerpt from the Reclama- tion Plan Map showing the area that remains to be mine or where active mining is taking place . This is the area designated as Phase 4 lying in the northwest part of the permit area and east of Idaho Creek . The blue line shows the 200 - foot setback from the permit line on the north and west and the mining area on the south and east . While there are some changes in Phase 1 they amount to reclamation activities including grading and shaping and not new mining , so I did not include this area . To resolve the Structural Agreement issue , address your review and keep it moving along , I went back to the maps and Exhibit S to determine what new or existing structures were within 200 feet of the area that is being mine or will be in the future and did not have structure agreements on file . Attached is a list of the structure owners and the structures that are within 200 feet of ENVIRONMENT, INC. Palermo 10365 County Road 7 Longmont, CO 80504 RE: Structure Agreement Rinn Valley Resource, Permit # M-1997-093 Dear Mr. Palermo: As you are aware from a previous notification letter to you, L.G. Everist, Inc. , is amending their Colorado Mined Land Reclamation (MLR) permit to extract sand and gravel materials from Rinn Valley Resource (M-1997-093), located in the SW 1 /4 SW 1 /4, Sec 10, T2S, R68W, 6th Prime Meridian, Weld County, Colorado. For your information, the amendment is simply to change the final reclamation of the site from unlined ponds to lined water storage. This letter and attached Structure Agreement is being sent to you as part of the permitting process to address an MLR rule that requires the operator/permittee to pursue an agreement with owners of any structures within 200 feet of the permit area, in which the operator agrees to reimburse the structure owner for any damage done to their structure as a result of the mining operation. In lieu of obtaining an agreement, the operator can provide the state with a Geotechnical study that demonstrates that any structures within 200 feet of the permit area shall not be damaged by activities occurring at the mining operation. The operator has already completed the study as part of the planning process for this mine and it indicates that the structures listed in this agreement will not be damaged by mining activities. We are sending this agreement to you as required by law, but also because we wanted to inform you of all the aspects of the MLR rules and also be able to provide you assurances that should something occur that we do not foresee, L.G. Everist, Inc. will repair or replace the damaged structure. Please return this agreement, signed and notarized, within 30 days of receiving it if possible.
