Existing C6 injection facility add a solids processing
facility
The Weld County Department of Planning Services-Engineering has reviewed this proposal.
Staff comments made during this phase of the application process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
This application is to add a separate solids processing facility with the purpose of recovering oil
from solid byproducts of the SWD process.
This project is west of and adjacent to CR39 and is north of CR28. Parcel number
121330400015. Access is from CR39.
Roads
CR39 is a County maintained collector roadway, which will require 80ft of future right of way at
full build out.
Unmaintained CR28 section line ROW existing on the south side of the parcel.
Traffic counts on CR28 just east of the site were 1406 in October 2013.
Traffic
The traffic information provided with the submittal states "The water disposal facility will
employ 15 persons per 24 hour period. This is an increase of five employees. With the
expansion, it will serve approximately a maximum of 180 trucks per day spread out over a 24-
hour period. The average is less than 150 trucks per day. The average number of trucks will not
exceed the estimated daily capacity of 4,600 vpd. The peak hour capacity with approximately 10-
20 per hour trucks is not exceeded and the access will unquestionably operate at LOS A in the
near-term and LOS B in 2035 with the projected volumes."
Access:
An access permit has been approved for the access to the site(AP14-00273).
Tracking control is required to prevent tracking from the site onto the County Roadway.
• Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
• Standard tracking control for accesses onto gravel roads includes double cattle guards at the
access point.
• Standard tracking control for accesses onto paved roads includes either 300 feet of pavement
onsite OR 100 feet of pavement plus double cattle guards.
General Site Plan Requirements i.e (TA, RMA, City Town Agreement, etc..., offsite auxiliary
lanes)
• Improvements Agreement:
An Improvements Agreement between the Applicant and the County exists for this site REC
2008-1263. The improvements agreement will remain valid for this modification to this site.
• Geologic hazard Area:
This area IS NOT in a Geologic Hazard Area.
• Floodplain:
This area TS NOT in a Floodplain.
Drainage Study:
A drainage letter dated July 3, 2014 prepared by Eric Wernsman PE33371 was submitted with
the application.
• In order for stormwater detention design to not be appropriate and a simple water quality
feature be appropriate, the engineer must certify the project impacts on stormwater runoff are
minimal and insignificant. The drainage letter provided did not indicate the project impacts
were insignificant. The PE must certify the drainage runoff impacts are minimal in the
drainage narrative.
• Please provide the existing imperviousness of the project and the increase that the project is
proposing. Include the total acres of the parcel and the project acres.
• The drainage narrative was not signed or stamped. Please submit a stamped and signed
drainage narrative.
• The applicants will be required to maintain historic drainage flows and run-off amounts on
the property.
This site is NOT in a State defined Municipal Separate Storm Sewer System (MS4) area which is
a more urbanized area with state mandated, higher water quality requirements.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre.

CONDITIONS OF APPROVAL:
Prior to recording the plat:
A. An Improvements Agreement and Road Maintenance Agreement is required for
offsite improvements at this site. Road maintenance including dust control, damage
repair, specified haul routes and future triggers for improvements will be included.
B. The applicant shall complete a Nonexclusive License Agreement for the upgrade
and maintenance of Weld County Right-of-Way.
The map shall be amended to delineate the following:
A. County Road 39 is a Paved road and is designated on the Weld County Road
Classification Plan as a Collector road, which requires 80 feet of right-of-way at full
buildout. The applicant shall verify and delineate on the plat the future and existing
right-of-way and the documents creating the existing right-of-way. If the existing
right of way cannot be verified it shall be dedicated. All setbacks shall be measured
from the edge of future right-of-way. This road is maintained by Weld County.
B. County Road 28 is unmaintained section line right of way. The applicant shall
verify and delineate on the map the existing right-of-way and the documents
creating the right-of-way. All setbacks shall be measured from the edge of right-of-
way. This road is not maintained by Weld County.
C. Show the approved access(es) on the plat and label with the approved access permit
number(will be provided OR AP14-00273).
D. The applicant shall indicate specifically on the plat any right of way and/or
easements and indicate whether they are dedicated, private, or deeded and label
with recorded document, book and page and/or reception number to provide
adequate access to the parcel.
E. Show and label standard tracking control onto publically maintained roadways on
the map.
F. Show the accepted water quality feature on the map with volume and label as
WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA.
G. Show and label the drainage flow arrows, turning radii (60ft), and parking and
circulation on the map.
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required
prior to the start of construction. Contact the Planning Department for application
information.
DEVELOPMENT STANDARDS(NOTES ON THE PLAT)
1. Should noxious weeds exist on the property, or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be
utilized.

Environmental Health Services has reviewed this proposal to a commercial Class II
Oilfield Waste Disposal Facility to include a Class II injection well, a produced water
recycling facility, a truck washout facility, a solids processing facility, and associated
infrastructure. The applicant is proposing to have 30 total employees onsite to operate
the facility over a 24 hour period.
The applicant provided information about an existing septic system for the facility (SP-
0701163). The applicant will be required to comply with Weld County Onsite
Wastewater Treatment System Regulations. The applicant has indicated that drinking
water will be provided by existing water well (permit number 272956). This well is
restricted to drinking and sanitary facilities inside the building. Additionally the applicant
has indicated a new well will be permitted through the state.
The applicant submitted an approved dust abatement plan. The dust abatement plan
indicates that the onsite access road and parking area will be covered with an
aggregate surface and the surface will be maintained in order to provide dust control.
Overflow parking and activity areas will be monitored for dust and water/chloride (such
as Magnesium Chloride) will be used for dust control, as needed during construction
and operation.
The applicant provided a copy of the CDPHE Recycling Facility Registration Form. The
facility has an approved CDPHE Recycling Facility Engineering Design and Operations
Plan dated February 2013, for a Water Treatment and Conditioning facility. A separate
Engineering Design and Operations Plan (EDOP) dated November 5, 2014 was
provided to Weld County for the solids processing recycling facility. The EDOP
Appendix D included The Construction Air Modification Application and evidence of Air
Pollution Emission Notices (APENs) from the Air Pollution Control Division, CDPHE.
The applicant submitted a Waste Handling Plan for review and approval. The applicant
has provided some waste handling information in the EDOP. The EDOP indicates that
solids from the processing facility will be transferred to the solids temporary staging
shed and temporarily stored in a roll-of container. At least once a week the solid waste
will be disposed of off-site at an approved landfill. Solids processing facility wash water
will be collected in floor drains and managed onsite. A SPCC plan dated October 30,
2014 was provided as Appendix B of the solids processing facility EDOP. The
September 17, 2014 SPCC plan encompasses the solids processing facility as well as
the produced water recycling facility and SWD well facility/infrastructure.
Unloading pad and secondary containment information was provided for the solids
processing facility in the EDOP. Information is required for the expansion of the
saltwater disposal facility. The solids processing truck off-load area will be a concrete
pad approximately 82' x 100'. The secondary containment structures will be constructed
of concrete and sized to hold 1.25 times the volume of the largest tank in each area with
additional volume/freeboard for precipitation and unloading pads are required to have
leak detection. Solids processing closure plan information was provided in the solids
processing facility EDOP.
The solids processing EDOP addresses storm water which may come into contact with
waste and indicates that any water which comes into contact with waste will be
managed as contaminated water. A Stormwater Management Plan was provided in
Appendix B of the EDOP.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
1. Prior to allowing the plat to be recorded:
A. In the event washing of vehicles will occur on site the applicant shall ensure
that any vehicle washing area(s) shall capture all effluent and prevent
discharges from the washing of vehicles in accordance with the Rules and
Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency. Vehicle washing areas should be
designated on the plat.
B. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
1. A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2. A list of the type and volume of chemicals expected to be stored on site.
3. The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

4. Solids and sediment will accumulate in the storage tanks. The waste handling
plan shall include a detailed plan that describes the method of how those solids
will be removed, including all on-site handling procedures.
5. The waste handling plan shall provide a commitment to notify the Weld County
Department of Public Health and Environment in writing, in the event the plan is
amended. The plan shall be reviewed and approved by the Weld County
Department of Public Health and Environment.
2. We recommend that the following requirements be incorporated into the permit
as conditions that must be met prior to release of building permits:
A. A leak detection system shall be designed and installed beneath the concrete
unloading pad(s), piping, and sump(s). The plans and engineered drawings
will be stamped and signed by a Colorado Registered Professional Engineer
(PE). Plans shall be submitted to and accepted by Weld County Department
of Public Health and Environment.
B. Detailed plans for the concrete secondary containment structure for all
storage and processing tanks shall be submitted for acceptance. Secondary
containment volume shall provide containment for the entire contents of the
largest single tank plus sufficient freeboard to allow for precipitation. The
plans and engineered drawings will be stamped and signed by a Colorado
Registered PE. The Weld County Department of Public Health and
Environment will consider structures other than concrete, provided a Colorado
Registered PE provides a certification indicating that the proposed alternate
containment system meets, or exceeds, the function of a concrete system
with regard to containment, spills, and unintended releases. Plans shall be
submitted to and accepted by Weld County Department of Public Health and
Environment.
3. Prior to the issuance of the Certificate of Occupancy:
A. In the event the applicant intends to utilize the existing septic system, the
septic system shall be reviewed by a Colorado registered professional
engineer. The review shall consist of observation of the system and a
technical review describing the system's ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed, the system shall be brought into compliance with current
regulations. Alternately, a new septic system may be installed for business
use.
B. The applicant shall submit evidence of an Underground Injection Control
(UIC) Class V Injection Well permit from the Environmental Protection

Agency (EPA) for any large-capacity septic system (a septic system with the
capacity to serve 20 or more persons per day). Alternately, the applicant can
provide evidence from the EPA that they are not subject to the EPA Class V
requirements.
4. We recommend that the following requirement be incorporated into the permit as
a condition that must be met within six months of operation:
A. The applicant shall submit documentation to the Weld County Department of
Public Health and Environment that the facility was constructed in accordance
with the application materials.
5. We recommend that the following requirements be incorporated into the permit
as development standards:
1. No disposal of waste, other than Class II, as currently defined by the
Environmental Protection Agency, is permitted. Any changes from the
approved Class II use will require an amendment to this Use by Special Review
Permit.
2. All liquid wastes received at the facility shall be unloaded on the unloading pad.
The unloading/loading pad leak detection system shall be constructed and
operated in accordance with the approved design. The unloading pad shall be
cleaned at a frequency that prevents oils and other wastes from building up on
the pad. During winter months, the facility shall maintain the unlading pad free
of ice.
3. Analytical waste data and environmental monitoring data shall be made
available to Weld County Department of Health and Environment upon request.
The Weld County Department of Health and Environment reserves the right to
require additional monitoring.
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
5. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended or those wastes outlined in the approved EDOP.
6. Any stained or contaminated soils on the facility shall be removed and disposed
of in accordance with applicable rules and regulations. All spills will be
documented and records will be kept onsite for WCDPHE review upon request.

All spills will be reported to local, state and federal agencies in accordance with
all state and federal regulations.
7. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
8. Temporary tanks will be onsite no longer than six months. All tanks, including
temporary tanks will be labeled in accordance with COGCC and NFPA
requirements.
9. The facility shall comply with the approved Groundwater Monitoring Plan.
Groundwater monitoring and leak detection results will be reported to WCDPHE
in accordance with the Groundwater Monitoring Plan reporting.
10.All stormwater, which has come into contact with waste materials on the site,
shall be confined on the site. In the event the storm water is not adequately
controlled on the site, upon written notification from the WCDPHE or CDPHE, a
comprehensive site-wide Stormwater Plan shall be developed or amended and
implemented. All contaminated solids shall be covered and stored on an
impervious surface to prevent and contain storm water that may come into
contact with the solids. The Stormwater plan must be approved, in writing by
the WCDPHE or CDPHE, prior to implementation.
11.Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. Laboratory wastes will not be disposed of in the
facility's septic system. The facility shall operate in accordance with the
approved "waste handling plan", at all times.
12. Should recycling occur at the facility, the facility shall operate in accordance
with their CDPHE-approved design and operations plan(s). The facility shall
recycle at least 75% of the total waste weight or volume processed at the solids
processing facility and water treatment and conditioning (recycling) facility.
Should the facility not recycle 75% of the material, an amendment to this Use
by Special Review Permit or a Certificate of Designation may be required. A
copy of the annual Recycling Facility Annual Reporting Form shall be submitted
to the CDPHE and WCDPHE by March 1 of each year.
13.WCDPHE will be notified prior to the closure of the facility. Upon site closure,
the facility will remove all wastes from the site and decontaminate all
equipment, tanks, and secondary containment. Upon closure, the facility will
conduct a soil and groundwater assessment and will conduct remediation
activities, as necessary. All wastes removed from the site during closure
activities will be disposed of off-site, in accordance with all state and federal

rules and regulations and with Weld County Code. Documentation of closure
activities will be provided to WCDPHE
14. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall operate in accordance with the approved "dust abatement
plan", at all times.
15.This facility shall adhere to the maximum permissible noise levels allowed in
the non-specified Zone as delineated in Section 14-9-30 of the Weld County
Code, or with all applicable State noise statutes and/or regulations.
16.Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. If employees or contractors
are on site for less than 2 consecutive hours a day or less than 2 fulltime
employees are onsite, portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall be
retained on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
17.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County
Code, pertaining to On-site Wastewater Treatment Systems.
18.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the private water supply.
19.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAPs) and volatile organic compounds (VOCs). All
chemicals must be stored securely, on an impervious surface, and in
accordance with manufacturer's recommendations.
20. A current professional engineer-certified and signed Spill Prevention, Control
and Countermeasure Plan copy shall be available on site, at all times.
21.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
We have previously provided comments on Case No. USR14-0081 by our letter dated January 15,
2015. In that letter we indicated that the purpose of the application is to amend MUSR11-0004
to include a solid processing facility to that existing oil and gas support and service facility
(Class II oilfield water disposal facility - salt water injection facility, a water recycling facility
and the addition of a solids processing facility). In this second referral, the Applicant indicated
that the site currently employs 17 employees and the proposal is to add 13 additional
employees, bringing the total number of employee to 30 who will work over 3 shifts. There will
be an average of 10 employees on site at any one time. The water supply for the site is still
listed as well permit no. 272956. Our previous comments regarding the water supply for the site
still apply.

Dear Mr. Ogle:
This letter is being sent by Anadarko Petroleum Corporation on behalf of its subsidiary
Kerr-McGee Oil & Gas Onshore LP ("KMG") to inform you KMG is the owner of valid oil
and gas leases underlying all or parts of Section 30, Township 3 North, Range 65 West, for
which High Sierra Water Services, LLC ("Applicant") is seeking approval of a request to
amend MUSR11-0004 to include a solids processing facility, a new pump house, new injection
well, expansion of concrete containment, addition of 6 tanks and expansion of the offload pad
within the subject property. KMG is submitting this comment and objection timely, in
accordance with State of Colorado and the County's procedural requirements.
KMG's recorded oil and gas leases are real property interests entitling it to produce oil
and gas from the leased lands. The company has the right to produce from existing wells, to
maintain, rework, recomplete, and fracture those existing wells to enhance production, and to
drill new wells to produce oil and gas, in accordance with applicable Colorado Oil and Gas
Conservation Commission regulations and Colorado Statutes. KMG's oil and gas assets have
significant value, and the company is consequently concerned about any development, surface
use, plan of use, PUD, zoning or rezoning, or other action by the County that would impair or
preclude its ability to develop its property.
KMG's preferred practice is to meet with surface owners and attempt to conclude a
mutually acceptable surface use agreement. In this case, KMG and the surface owner do not
have an agreement in place. KMG must object to any approval by the County for the
Applicant's plans that fail to fully accommodate KMG's right to explore for, develop and
produce oil and gas from its leasehold interests. KMG requests that the County withhold final
plat approval until such time as the Applicant and KMG have concluded the surface use
agreement. Any future surface development plans should incorporate and designate lands to be

set aside for mineral development and expressly provide protection for KMG's current and
future wells, pipelines, gathering lines and related oil and gas facilities and equipment. Weld
County has a constitutional obligation to ensure that the property rights of mineral interest
owners are accommodated in its land use planning process. Approval of any surface
development plan that forecloses the rights of mineral owners may be a compensable taking.
