The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: This project is for a construction office and storage yard. This project is south of SH52 and west of HWY85. Parcel number 146901400001. Access is across an adjacent property and from SH52. Roads: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163)to verify the access permit or for any additional requirements that may be needed. (State Highway 52) Traffic: The traffic information provided with the application indicates per day there are expected to be 10-15 passenger vehicles, 3 large trucks greater than 66,0001bs and 4 smaller trucks under 26,0001bs Access: This project accesses onto CDOT SH52. The traffic narrative indicates an easement has been granted for access to a new entrance road that is pad of an acceleration/deceleration project with Ready Mixed Concrete Company. The easement must be shown on the map with recorded reception number at date the easement was recorded. For shared accesses, Engineering strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Tracking control is required. For access onto paved roads, a tracking control device plus 300ft of recycled asphalt/road base is required. Tracking control devices can be double cattle guards or other specialized device. Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: The project site IS within a known floodplain. A floodplain permit is required for any development in the floodplain. Contact Diana Aungst with the Department of Planning Services. Drainage Study: During the pre-application and phone call with the applicant on November 25, 2014 staff indicated a drainage narrative and water quality feature design would be required and full drainage report and detention pond could be waived if the stormwater drainage impacts of the project are insignificant and the overall site imperviousness is less than 10%. A drainage narrative and water quality feature calculations were submitted with the application materials. It appears the overall site imperviousness shown in the calculations is 16%. It also appears there may be drainage improvements on the adjacent property to the south. If the pond to the south is to be used for this project, a drainage easement must be acquired. Detention or water quality storm drainage guidance and related documents can be found on the County Website at: http://www.co.weld.co.us/Departments/PlanningZoning/Engineering.html. Please contact Department of Planning Services Engineering for questions or assistance with drainage requirements at 970-353-6100x3552. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303- 692-3575. CONDITIONS OF APPROVAL: Prior to recording the plat: A. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact CDOT to verify the access permit or for any additional requirement that may be needed to obtain or upgrade the permit (SH52). B. An accepted drainage design is required. The map shall be amended to delineate the following: A. Show the approved CDOT accesses on the plat and label with access permit number if applicable (SH 52). B. The applicant shall indicate specifically on the plat any right of way and/or easements and indicate whether they are dedicated, private, or deeded and label with recorded document, book and page and/or reception number to provide adequate access to the parcel. C. Show and label standard tracking control onto publically maintained roadways on the map. D. Show and label the accepted drainage features, drainage flow arrows, turning radii, and parking and circulation on the map. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. DEVELOPMENT STANDARDS (NOTES ON THE PLATT 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. MEMORANDUM EL �� TO: CHRIS GATHMAN, PLANNING SERVICES a0-uNT Y FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR15-0005 DATE: FEBRUARY 25,2015 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (office, maintenance shop, and outdoor storage/staging of vehicles and equipment for an earthmoving and excavation company) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions. There will be up to 15 employees accessing the site. The shop will be utilized for maintenance. The application indicates a commercial septic system will be installed in conjunction with the construction of the buildings. The property is currently served by a commercial well which is permitted for inside use only for a commercial business. The dust abatement plan states that the existing access is a gravel drive shared with the site to the east and the parking area will be asphalt. A water truck will be utilized if necessary. The waste handling plan indicates that employee waste will be collected by Waste Management. The disposal of fluids, tires and batteries was addressed in the plan and was acceptable. If there will be floor drains in the maintenance shop the drains must discharge to a watertight vault, and contents removed for proper off-site disposal. If there will be fuel storage onsite that shall be indicated in the waste handling plan and secondary containment is required. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Sewage disposal shall be by septic system when the number of full time on site employees exceeds 2. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes when the number of full time on site employees exceeds 2. 9. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 2 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. Water from this well shall not be used for lawn and landscape irrigation or for any other purpose outside the business building structure.
