SUBJECT: USR15-0031 Harms Gravel Pit
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
An existing gravel pit is being expanded
This project is east of and adjacent to CR 127 and is south of CR 124. Parcel number 021934000009.
Access is from CR 127.
Roads:
County Road 127 is a gravel road and is designated on the Weld County Road Classification Plan as a
collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the
site map the future and existing right-of-way. If the existing right of way cannot be verified it shall be
dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained
by Weld County.
The County Road 124 Section Line is estimated to have 60 feet of unmaintained County line right-of-way.
The applicant shall delineate the existing right-of-way and the documents creating the right-of-way and
this information shall be noted on the plat. All setbacks shall be measured from the edge of right-of-way.
Traffic:
Latest ADT on 127 was taken on 12/10/2014 which counted 125 vpd with 55% trucks.
A traffic narrative was submitted and indicated that during peak times there will be approximately 25 truck
daily roundtrips and 2 employee's round trips/day. The expected traffic routes are 50% heading north
and 50% heading south from the access location.
Access:
An access permit has been approved for the access to the site (AP15-00086).
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users.
The applicant has shown this on the site plan.
Tracking Control:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
More than 10 round large truck trips/day or more than 50 round passenger vehicles trips/day:
P Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled
asphalt or road base which has been shown on the site plan.
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
*** Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
****Surface improvements less than 300 ft may be allowed if site constraints would prohibit meeting
condition.
Improvements and Road Maintenance Agreement:
An Improvements Agreement between the Applicant and the County will be required for this project. It will
detail the approved haul route(s), outline when offsite improvements will be triggered, and include a
maintenance agreement for the haul routes.

An Improvements Agreement is required for sites with required offsite improvements. Collateral is
required to ensure the improvements are made.
Road Maintenance is typically included as a section of the Improvements Agreement when the
County feels that the site activities may impact the County roadways. Possible mitigations included
in the road maintenance agreement may include but are not limited to: dust control, specified haul
routes, damage repairs, and future improvement triggers.
Other Public Works Permits:
A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way. Contact Weld
County Public Works at 970-304-6496 ext. 3764.
A Transport Permit is required for any oversize and/or over weight vehicles. Contact Weld County Public
Works at 970-304-6496 ext. 3764.
Drainage Requirements:
No stormwater detention shall be required for gravel pits where the stormwater drains into the pit.
Grading Permit
If more than 1 acre is to be disturbed for construction of non-gravel pit items such as permanent
structures, parking lots, etc..., a Weld County grading permit will be required prior to the start of
construction. Contact the Planning Department for more information.
CONDITIONS OF APPROVAL:
A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this
location. Road maintenance including dust control, damage repair, specified haul routes and future
traffic triggers for improvements will be included. (Department of Public Works)
B. The map shall be amended to delineate the following:
1. County Road 124 is unmaintained section line right-of-way. The applicant shall delineate on the
map the existing right-of-way and the documents creating the right-of-way. All setbacks shall be
measured from the edge of right-of-way. This road is not maintained by Weld County. (Planning-

2. Show and label the approved access(es), turning radii, and access permit number(s) on the map.

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on-site construction.

B. If more than one (1) acre is to be disturbed for construction of non-gravel pit items such as permanent

DEVELOPMENT STANDARDS (NOTES ON THE SITE MAP)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Planning-Engineering)
2. There shall be no tracking of dirt or debris from the site onto publicly maintained roads. The applicant
is responsible for mitigation of any road damages or offsite tracking and maintaining onsite tracking

3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for a mineral resource
development including open pit mining and materials processing (gravel mining
operation) in the A (Agricultural) Zone District.
As this is a temporary use, portable toilets and bottled water are acceptable for sanitary
uses.
Noise will be restricted to the level allowed in the industrial zone district.
Dust abatement will consist of utilizing a water truck for roads, reducing speeds and
tarping loaded trucks.
Waste will be removed nightly by personnel on site.
The State does not require registration of aboveground fuel storage tanks associated
with gravel pits as long as the following requirement is adhered to: "Aboveground
storage tanks used to store flammable and combustible liquids at mining facilities and
construction and earthmoving projects, including gravel pits, quarries, and borrow pits
where, in the opinion of the state inspector of oils, tight control by the owner or
contractor and isolation from other structures make it unnecessary to meet the
requirements of this article." The fuel tank is double walled and will be contained within
a secondary containment berm.
We have no objections to the proposal; however, we recommend the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
4. The facility shall comply with the Air Pollution Emission Notice (A.P.E.N.) permit
requirements as stipulated by the Air Pollution Control Division, Colorado
Department of Public Health and Environment, as applicable.
5. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. Portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand sanitizers.
8. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Mr. Gathman:
We have reviewed the above referenced proposal for a site-specific development plan and
use by special review for a mineral resource development facility on 32.2 acres. The submitted
material does not appear to qualify as a "subdivision" as defined in C.R.S. § 30-28-101(10)(a).
Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning
directors, this office will only perform a cursory review of the referral information and provide
comments. The comments will not address the adequacy of the water supply plan for this
property or the ability of the water supply plan to satisfy any County regulations or requirements.
The proposal is for a gravel mining operation, known as the Harms Pit, which will be
operated under Colorado Division of Reclamation Mining and Safety (DRMS) permit no. M-2013-018.
The primary commodities to be mined at the site are sand, gravel, rock, and dirt. The site is
proposed to be reclaimed to grazing/rangeland upon completion of the mining operation.
Comments regarding the reclamation permit conversion were provided to the DRMS in a memo
dated December 2, 2014.
No groundwater is anticipated to be encountered at the Harms Pit; therefore exposure of
ground water must not occur during or after mining operations. The site is anticipated to have
four employees on site, with additional visits by material haul truck drivers and other site users.
Bottled drinking water will be provided for employees and visitors, and portable toilets will be
located on site. Water for dust control purposes is proposed to be pumped from the well with
permit no. 69175-F. Industrial use of up to 300 acre-feet per year of ground water is allowed
under permit no. 69175-F, subject to all other permit conditions of approval.
Any storm water runoff intercepted by this operation that is not diverted or captured in
priority must infiltrate into the ground or be released to the stream system within 72 hours;
otherwise a substitute water supply plan or augmentation plan approved by water court must be
obtained.
