ROGER BREITENBACH, FOR VIOLATION OF THE WELD COUNTY CODE -
ZCV15-00140
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, RLU Holdings, LLC, and Northwinds of Wyoming, Inc., c/o Roger
Breitenbach, ZCV15-0140, are allegedly in violation of the Weld County Code, specifically the
operation of a commercial business and/or storage of commercial vehicles, equipment, office
trailers, and employee parking without a permit, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of December, 2015, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, RLU Holdings, LLC, and Northwinds of Wyoming, Inc., c/o Roger
Breitenbach, property owner(s), was present at said hearing and presented testimony, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral for seven (7) days, to allow adequate time for the property owner(s) to submit a
complete Use by Special Review Application.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV15-00140 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against RLU Holdings, LLC, and Northwinds of Wyoming, Inc., c/o Roger
Breitenbach, to remedy the violation of the Weld County Code, and any other persons occupying
the properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties, with an instruction for delay of action upon such referral for
seven (7) days, to allow adequate time for the property owner(s) to submit a complete Use by
Special Review (USR) application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of December, A.D., 2015.

Consent Agreement
This Consent Agreement is made between the Weld County Department of Planning Services (the
Department) and RLU HOLDINGS LLC and NORTHWINDS OF WYOMING (Violator) . ((ZCVI5-00140))
1 . Violator owns or occupies property located at 19909 CR 39 , in Weld County, Colorado .
2 . There are violations of the Weld County Code Chapter 23 on the property, due to the presence of
commercial vehicles , construction trailers/office and employee parking without first obtaining the Use by
Special Review ( USR) permit .
3 . It is possible to correct the violations on the property, and Violator has the present ability to bring
the property into compliance with the Weld County Code , and to comply with the terms of this Consent
Agreement .
VIOLATOR AGREES TO COMPLETE THE FOLLOWING ACTIONS BY THE FOLLOWING DATES :
4 . Violator agrees to submit a COMPLETE Use by Special Review ( USR) application to the
Department of Planning Services by December 31 , 2015 . Please note : This means a 7 Day
Completeness Review application shall be submitted by December 18 , 2015 , so staff can
review and make comments . This will allow a short time period to re submit any missing
paperwork can be re submitted by December 31 , 2015 . In the alternative the business and all
associated storage shall be removed by December 31 , 2015 .
5 . Violator agrees to notice all property owners within 500 feet and conduct a neighborhood meeting .
Furthermore , the Violator shall provide record of attendees and written summary (notes) of the meeting to the
Department of Planning Services with the USR application .
6 . Violator agrees to provide any requested information necessary to complete the USR application process in
a timely fashion and to diligently comply with all timelines associated with the USR process .
7 . Violator further agrees that this Consent Agreement may be used by Weld County in any subsequent legal
action against Violator relating to the above mentioned violations on the property.
8 . Violator agrees that if it does not meet any of the individual deadlines outlined in this agreement, it will
immediately cease and desist all operations and activities that are in violation of the Weld County Code or any
other law, rule , or regulation . If Violator does not cease all operations immediately upon failing to meet a
deadline , County may file either a civil and/or criminal action to preclude any further violations .
THE DEPARTMENT AGREES :
9 . Not to file or server a complaint against Violator for the above-mentioned violations on the property as long
as Violator is otherwise in compliance with this Consent Agreement.

On Thursday, October 22 , 2015 an informal discussion took place at the Greeley Administrative Offices
Conference Room regarding a proposed pipeline construction business . (The legal description is Lot A RE-
4306 ; Part NE4 of Section 30 , T4N , R65W of the 6th P . M . ; Situs Address is 19909 CR 39 )
Background Information :
The proposed use of this property will be for a construction business yard , shop and offices . They would
house equipment and material needed for daily pipeline construction . Vehicles will be parked nightly along
with semis and trailers .
Vehicle maintenance , such as oil changes , tire repair and under carriage repair, engine work, brakes , etc. will
also be performed on the heavy equipment and company vehicles .
Hours of operation are Monday through Saturday from 6 am to 5 : 30 pm . There are approximately 20
employees during the slow time of year; however during the busiest time of the year there are approximately
100 employees .
There is currently 1 residence on the property in which Chad , Tanner and another individual will reside . There
are currently two (2 ) mobile office trailers and some storage (conex) trailers on site and used for storage
purposes . The applicants are proposing to build a 120x60 shop/office in the near term , and in the the future
may build a dry storage building (40x70 ) .
Building Department
Commercial Building and Electrical permits will be required for any new construction production equipment
tanks or alteration , or addition to any building on the property per Section 29-3- 10 of the Weld County Code .
Currently the following has been adopted by Weld County: 2012 International Codes ; 2006 International
Energy Code ; 2014 National Electrical Code . A building permit application must be completed and two
complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must
be submitted for review. A geotechnical engineering report performed by a registered State of Colorado
engineer shall be required or a open hole inspection .
A Fire District Notification letter shall be submitted to the Fire District with jurisdiction for review and comments
and submitted with Commercial Permit application to Weld County. Staff encouraged the applicants to visit
with the LaSalle Fire Department on their requirements .

Public Works
County Road 39 is a paved road and is designated on the Weld County Road Classification Plan as a collector
road , which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the site map the
future and existing right-of-way. If the existing right of way cannot be verified it shall be dedicated . All
setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County.
TRAFFIC REQUIREMENTS :
1 . Describe how many roundtrips/day are expected for each vehicle type : Passenger Cars/Pickups ,
Tandem Trucks , Semi-Truck/Trailer/RV ( Roundtrip = 1 trip in and 1 trip out of site)
2 . Describe the expected travel routes for site traffic.
3 . Describe the travel distribution along the routes (e . g . 50 % of traffic will come from the north , 20 %
from the south , 30 % from the east, etc. )
4 . Describe the time of day that you expect the highest traffic volumes from above .
An access permit has been approved by the Public Works department for the access to the site (AP11 -00544)
for small commercial . Per Public Works access manager, no additional access permit application is needed
when the use is the same classification or a lower classification . Therefore the existing access permit is valid
for this USR .
Access is along the irrigation ditch . Agreement in writing from the ditch company is required to utilize this ditch
road access for the USR .
For shared accesses , Engineering strongly recommends that the property owner establish an access road
maintenance agreement so future owners of the properties will be aware of their requirements for shared
maintenance of the access road . This is not a requirement for the recorded exemption but is recommended to
avoid property owner conflicts in the future .
Entrance gates ( if applicable) must be set back a minimum of 100 ft from edge of existing shoulder of roadway
to allow a truck and trailer or RV to pull completely off of the roadway and open the gate . In no case shall any
vehicle(s) stopped for gate create a safety issue for roadway users .
Show and label a 30 ft minimum access easement to provide adequate access to the parcel .
Tracking control is required to prevent tracking from the site onto public roadways . Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control
is installed ahead of construction activities .
20 to 50 passenger vehicle round trips/day or less than 4 truck round trips/day:
• Access onto paved roads includes 100 ft of road base or recycled asphalt.
4 to 10 round truck trips/day (tandem or semi-trucks) :
• Access onto paved roads requires a tracking control device and a minimum of 100ft of recycled
asphalt/road base OR 300ft of asphalt. ( Surface improvements less than 300 ft may be allowed if site
constraints would prohibit meeting condition . )
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
*** Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
A variance request for alternatives to the above tracking control can be submitted to the Traffic Division of
Public Works for review and consideration .
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or
50 round passenger vehicle trips/day. A development standard will be applied to the recorded map indicating
any impacts to the road must be mitigated by the owner. The site shall be maintained to mitigate any impacts
to the public road including damages and/or offsite tracking .
ENGINEERING DEPARTMENT
DRAINAGE REQUIREMENTS :
The applicant indicated there will be a new 120x60 foot shop with potentially several new buildings in the
future .
The draft drainage code is available on the planning -engineering website .

Detention pond summarized in a drainage report is required unless the project falls under an exception to
stormwater detention requirements per code section 23- 12-30 F . 1 .
1 . Detention pond requirements:
A drainage report and detention pond design shall be completed by a Colorado Licensed Professional
Engineer and adhere to the drainage related sections of the Weld County Code . The drainage report must
include a certification of compliance stamped and signed by the PE which can be found on the
engineering website . A general drainage report guidance checklist is available on the engineering website .
More complete checklists are available upon request.
2 . Drainage narrative requirements with exception from detention pond.
The drainage narrative must describe at the minimum :
1 . Which exception is being applied for and include supporting documentation .
2 . Where the water originates if it flows onto the property from an offsite source
3 . Where it flows to as it leaves the property
4 . The direction of flow across the property
5 . If there have been previous drainage problems with the property
DRAINAGE CODE REQUIREMENTS (informational only):
Section 23-12-30. Drainage Policy.
F. Exceptions to storm water detention shall not jeopardize the public health, safety, and welfare of
public and private property.
1 . Exceptions.
A. No stormwater detention will be required for sites that meet any of the following
i conditions:
1 . Use by right or accessory use in the A (agricultural) Zone District.
2. Zoning permits in the A (agricultural) Zone District.
3. A second dwelling permit in the A (agricultural) Zone District.
4. Towers including, but not limited to, cell, wind, and telecommunication towers.
5. Pipelines or transmission lines.
6. Gravel pits if the storm water drains into the gravel pit.
7. Residential developments where all the following conditions exist:
A. Nine (9) lots or fewer.
B. The average lot size is equal to, or greater than, three (3) acres per
lot.
C. Downstream roadway criteria are not exceeded.
D. The total post-development imperviousness for the rural residential
development does not exceed ten percent (10%), assuming that all
internal roads and driveways are paved, or will eventually be paved.
8. Development of sites where the change of use does not increase the imperviousness of
the site.
9. Urbanizing areas where the total project storm water runoff of less than, or equal to, 5
cubic feet per second (cfs) for the 1 -hour, 100-year, storm event.
10. Non-urbanizing areas where the total project stormwater runoff of less than, or equal to,
10 cfs for the 1-hour, 100-year, storm event.
11 . Parcels with total area less than, or equal to, a 1 . 0 gross acre.
12. Individual parcel with an unobstructed flow path and no other parcel(s) between the
Federal Emergency Management Administration (FEMA) regulatory floodplain channel
and the project.
13. A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is
allowed a onetime exception for a 1, 000 sq ft building or equivalent imperviousness.
14. A parcel greater than 5 gross acres in size is allowed a onetime exception for a 2, 000 sq
ft building or equivalent imperviousness.
15. Approved by a variance (DRAFT Weld County Code Section 23- 12- 150)
Section 23- 12- 150.`0. Stormwater Drainage Criteria Variances.
The following variance procedures are intended to allow additional exceptions to the code explicitly listed in
Section 23-42-30 provided certain requirements are met. Subsection A below is intended to be a lower cost
option which allows anyone to apply for a variance with or without stamped engineering documenta₹ion.
Subsection B below is intended to be used when more detailed analysis and engineering support is required.
A . An applicant may, request a variance for their site when conditions do not meet the drainage exemptions
described previously and impacts to the site and offsite properties are insignificant. Requests will be
reviewed by the Planning Director or his/her designee. No variance will be considered if it may
jeopardize the public health, safety. welfare and public and private property. In order to be granted, the
variance request must:
1 . Demonstrate that granting of the variance will still adequately protect public health, safety; and
general welfare.
2. Demonstrate there are no adverse impacts, from stormwater runoff to the public rights of way
and/or offsite si to properties as a result of the project.
Any engineer's supporting documentation or analysis has to be signed and stamped by a licensed PE
in the state of Colorado.
If the applicant's variance request is denied for not satisfying the above criteria and in the sole
discretion of the planning director or his or her designee; the applicant has the option to follow the
variance request in Subsection B below or appeal the denial to the Board of Adjustment.
B. The applicant's engineer may request a variance. The variance request shall be stamped and signed by a
professional civil engineer licensed to practice in the State of Colorado. Requests will be reviewed by
the Planning Director or his/her designee. In order to be granted, the variance request must:
1 . Describe the design criteria of the Weld County Code of which a variance is being requested.
2. Describe the proposed alternative with engineering rationale which supports the intent of the Weld
County Code.
3. Meet the design intent of the Weld County Code.
4. Demonstrate that granting of the variance will still adequately protect public health, safety; and
general welfare.
5. Demonstrate there are no adverse impacts, from stormwater runoff to the public nights of way
and/or offsite properties as a result of the project.
An applicant can appeal to the Board of Adjustments the Director of Planning Services decision
regarding the variance per Article VI of tluis chapter.
C. Variance requests, if accepted, are not precedent setting and are based upon specific site
constraints.
The applicants will be required to maintain the historic drainage flows and run -off amounts that exist from the
property .
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are
accepted after the planning process is complete ( map recorded ) . An Early Release Request Form may be
entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments . The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns . Contact an Engineering representative from the
Planning Department for more information .
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre . Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division , Rik Gay, 303-692-
3575 .
A Site Plan will be required identifying the following ( if applicable) :
o Show and label location of existing road Right-of-Way, future road Right-of-Way, and Easements
I
o Show and label location of drainage related features i . e . detention pond (s ) , ditches , etc. . . Detention
ponds shall be labeled as " No Build/Storage Area" and include design volume
o Show and label the drainage flow arrows showing how the stormwater flows across the property
o Show and label location of the access (es) and label with access permit number
o Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property
o Show and label the access turning radii (25 feet for passenger vehicles/60 feet for trucks)
o Show and label the approved tracking control
Planning Department
Additional fees may be included with the Building Permit such as Road Impact, County Facilities and Drainage

Screening of the parking area or outdoor storage may be required from any adjacent landowners or public
rig hts-of-way .
The applicant will need to provide a letter from the Ditch Company stating that they agree to the applicants
accessing their property through the ditch road easement.
Please provide an accurately drawn site layout map showing the location of all structures , parking areas ,
laydown yards , storage containers and overhead lighting , either on the building ( s ) or as area yard lights .
Staff encouraged the applicant to introduce themselves and speak with the surrounding property owners about
their business to be located on the property and the proposed uses associated with the business . If there are
concerns raised , demonstrate an attempt to mitigate the concerns as demonstrated on the site plan .

Staff explained the USR process . The applicant shall submit 1 packet for a 7 day completeness review. After
the 7 day completeness review the applicant will be informed of what items are still required to make the
application complete . Staff requested that the applicant submit the remaining material in electronic form .
Upon submittal of a completed application it will be sent out for referral for 28 days . The applicant will then
meet with their Planner to discuss the referrals and address as many of the referrals as possible . At that
meeting the Planning Commission hearing will be scheduled . The Board of County Commissioners hearing
typically follows approximately 3 weeks after the Planning Commission hearing .
The above notes are provided as a courtesy to the applicant. While we strive to help identify as many
potential issues upfront during the pre application meeting we cannot anticipate every issue that may come up
during the formal application process. The information contained herein has been placed on file with the
Department of Planning Services. The pre-application is valid for a period of one (1) year from the date of pre-
application. If a formal application is not received following the time period specified herein the Planning
Department reserves the right to require a new pre-application meeting. Please note that all land use, building
and impact fees are subject to change throughout this time period.

with a development idea can schedule a Pre-Application review meeting to get feedback on their idea Pre-
Application meetings are free and are meant to assist property owners and applicants in understanding whit
is required during development review
• At the Pre- Application meeting , members of various departments will offer comments on the development
proposal Based un the input from the meeting explaining the requirements for the proposed project the
applicant can then decide if they would like to move forward with a formal Land Use application .
• Pre-Application reviews are typically held Thursdays and Fndays of any given week at the planning

Planning questions
1 . The proposed use of this property will be for a construction business yard, shop and offices . We
would house equipment and material needed for daily pipeline construction . Equipment
storage when not in use or when maintenance work is being performed. Vehicles will be parked
nightly along with semis and trailers .
2 . Hours of operation are Monday — Saturday from 6:00 am to 5 :30 pm .
3 . Full time employees will depend on the work that is currently going on . Approximately 40
employees .
4 . No shift work
5 . People that will be using this site would include Northwinds of Wyoming personal along with
company personal that we may be working for. Delivery drivers for products as needed .
6 . No animals on property
7 . Currently the property consists primary of grass field . There is one home on the property along
with a gravel drive way. We would like to build a 120' by 60' shop/office if approved. Sitting on
the property is two mobile office trailers and some storage trailers along with Conex storage
containers for storage purpose .

.i 1 . Pickups should primary consist of one round trip level in the am and return in the pm . Tandem
trucks could consist of two round trips depending on material needed for projects. Semi would
depend on the materials needed for the field . Generally two round trips.
2 . Travel route or site traffic would be entering on to county road 39 and generally turning on
county road 42 or 44 heading East or West depending on project location .
3 . Travel distribution along the routes would be 85% West ( Highway 85 ) 15% East (CR 49 )
4. Highest traffic volume would be at 6 :00 am to arrive at work then 5 :00 pm when returning
trucks to the yard .
5 . Water drains to the West in the irrigation cannel .
6 . No water accumulation that we are aware of on the property.

1 . The property is on city utilities .
2 . The home property has a sceptic field which is attached .
1 . Storage would consists of equipment parts, maintenance tools and fluid ( oil , grease, paint,
filters — all in small quantities) Pipeline material such as tape, pipe wraps, coating.
