Response to Change of Zoning Questionnaire
RE: 37044 Northwest Dr. Windsor, CO 80550
1) The proposed rezoning is consistent with Weld County Code 22 to protect the
community's health, safety and welfare.
The 1st FILING of the subdivision where my property is located is zoned R2 and
has no covenants.
I am applying to change my property to R3 to correct the original mishap of a
building that has 3 units with R2 zoning since 1973.
Otherwise as far as affecting the neighbors, nothing different is happening with
the property and remains consistent since 1973.
My property is the exact floor plan and outside brick finishes as other duplexes
in the neighborhood. It is consistent with the neighboring properties, but has a
basement that the others don't have. It is apparent by the finishes that the
basement unit was added during or shortly after the property was built in 1973.
Weld County has informed me that there are no records now existing of the
building permits or Inspections issued back then.
I have hired an Engineer to insure that my property meets the most updated
building and fire codes for the new zoning change.
The new IBC and Fire code improvements for my property will exceed those of
the existing R2 rental properties built 40+ years ago in the neighborhood. These
rezoning code_improvements are consistent with the intentions of Weld County
Code 22, _[to. protect the health, safety and welfare of the community].
The basement apartment has 2 bedrooms, appliances, including washer and
dryer with it's own fenced yard and private parking. The school bus stops at the
corner the property. Children of my tenants have a country home and
neighboring kids to play with. Since I acquired the property 3 years ago, the
former 2 leases have been single mothers with young children.
The basement apartment offers safe. affordable housing for families in an area
known for excessively high rents.
The income also helps to supplement my health Insurance premiums and
retirement income.
2) Because the parking for the basement unit is in the rear of the building and
has it's own driveway access, it also serves as access for emergency vehicles to
the neighboring property as well if needed.
3) The property has adequate sewer, consisting of two separate septic tanks.
4) North Weld Water District has provided the water since the property was built
in 1973. It has plenty of great water.
Windsor/Severance Fire Rescue has always provided protection for the
subdivision.

6) Access to the property has always been adequate with 3 accesses ( 1 on WRC
76 and 2 on Northwest Dr., and no changes are requested or required.

There are two septic tanks for the 3 units.
The North septic serves a total of 2 baths,l,kitchen and 5 bedrooms and 2 laundry
rooms.
The septic to the north side of the structure services the main units except
for the kitchen in the east unit, which goes to the other septic tank.
Ike. ast septic serves a total of 1 bath, 2 bedrooms and 2 kitchens and 1 laundry
room.
The septic on the east side of the property has always serviced the basement
plumbing, but includes the sink in the east kitchen in the unit above. The
basement has a kitchen and one bath and two bedrooms and laundry room.
