WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the n affairs of Weld County, Colorado, and rn WHEREAS, a public hearing was held on the 3rd day of May, 1978 at the hour of 2 : 00 o 'clock p.m. for the purpose of hearing the petition of Robert See, 724 8th Street, Greeley, Colorado 80631, requesting a change of zone from E-Estate District to C-UD- c.o Commerical Unit Development District for the following described parcel of land, to-wit: A parcel of land located in the West Half of Lot 1, of the Southeast Quarter of the Southeast Quarter of Section 9, Township 5 North, Range 65 West of the 6th P.M. , County of Weld, State of Colorado, according to the Subdivision of land made by the Union Colony of Colorado, more particularly described as follows: Beginning at the Southeast corr..er of Section 9, Township 5 North, Range 65 West of the 6th P.M. , County of Weld, State of Colorado; thence North 00°09'20" West, a distance of 659.90 feet; thence South 89°44'00" West, a distance of 332.92 fact; Thence North 00°31'17" West, a distance of 304.77 fact to the 2RUE POINT OF BEGINNING; thence North 00°31'17" West, a distance of 325.62 fact; thence South 89°48'00" West, a distance of 202.22 fact; thence South 00°36'14" East a distance of 327.50 feet; thence North 89°16'01" East, a distance of 201.75 feet to the True Point of Beginning. WHEREAS , the petitioner was present, and WHEREAS, persons opposing the Change of Zone were also pre- sent and presented evidence on their behalf, and WHEREAS , Section 8 . 2 and 8 . 3 of the Weld County Zoning Res- olution authorizes the Board of County Commissioners to grant a change of zone upon the showing by the petitioner of certain facts and, WHEREAS, the Board of County Commissioners continued the hearing of this application for a change of zone to May 10 , 1978 , and 780028 1764968 -a WHEREAS , the Board of County Commissioners has heard all the testimony and statements of those in favor of and in oppostion to the request, has studied the request of the petitioner and the _recommendations of the Weld County Planning Commission, and hav- ing been fully informed and satisfied that the request for rezoning complies with the Weld County Comprehensive Plan and the conditions set out in Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the petition of Robert -See for a change of one from E-Estate District to C-UD-Commercial Unit Development District on the above described tract of land, be -and hereby is, granted, subject to the development standards con- tained in the Planning Commission Recommendations . Dear Sirs : This is to notify you that I object to the proposed change of zoning referred to above, for the following seasons . 1 . The petition supporting rezoning is not dated. 2 . The petition opposing this rezoning dated March 4, 1978, has 49% more signatures than the petition in support of said proposal. 3 . The unit plan as submitted extends commercial oning 327 feet south of Highway 34 . The established line for commercial zoning -on property just East of this parcel is approximately 300 feet south of the highway. The -approval of the submitted plan will make commercially zoned land directly behind an established residence . 4 . The access road to the reamining property in this entire parcel would be controlled by an individual, greatly limiting development -of the remaining parcel as Estate-Residential property. 5. The storm retention area on the East side of the unit plan would create a potential nuisance as an eyesore and mosquito breeding area. 6 . The landscaped area is only along the highway, leaving dusty gravel surfaces an the access road and surrounding the two proposed buildings . 7 . The proposed buildings are constructed -of steel. This type of construction is ideal for farm useage, but, in my opinion, not attractive or desirable -as a business building . 8 . It is probable that the rezoning of this parcel to commercial use would decrease the value of established residences in the area. 9 . The rezoning to commercial would benefit only one person. The rights of the people already owning residential property in the area must be considered seriously . 10 . There is adequate available commercially zoned property already established in the Greeley area . Therefore this rezoning is not desirable or necessary, as the property can be developed as Estate-Residential property. There is no gravel or any other natural resource to be considered here . In conclusion, I would like to say that the public is constantly urged to become active and make their wishes known to their elected representa- tives . Public apathy is critized in the press and on the radio. Many of us involved in opposing this proposal have become very discouraged in our efforts to be heard and considered seriously. We have objected from the first hearing on Feb. 23rd, at the Board of V arian-ce hearing, and at the subsequent hearings before the Planning Commission. We are now at the last hearing. i urge you to represent your constituents and look through your file carefully and listen to what the majority of the people are saying to you. The rezoning request agrees with the policies contained within the Weld County Comprehensive Plan in that the request for commercial development is located adjacent to an existing municipality (City of Greeley) and in compliance with the Comprehensive Plan of that Municipality. 3. The City of Greeley Planning Commission has indicated no objections to the requested zone change since the proposed commercial use agrees with the City 's Comprehensive Plan and adjoining property to the east has commercial zoning. 4. The Weld County Health Department has indicated that they have no problems with this request . 5. The Weld County Engineering Department has recommended approval of this request provided the applicant complies with the stipulations as indicated in the Engineering Department 's memo dated March 1 , 1978, regarding drainage and the proposed storm retention area. 6 . The Western Hills Fire Protection District indicated fire protection for this site is acceptable. 7. The applicant has submitted a petition form signed by several of the surrounding property owners in support of this request . 8. The Weld County Board of Adjustment has granted the applicant a variance from the minimum 5 acre requirement for unit developments. Comment : To date our office has received six letters of opposition to this request for rezoning from surrounding property owners. See - Commercial Uni. L Development. DEVELOPMENT STANDARDS 1. The permitted uses on the hereon described property are : A. The business of operating a farm building construction company which includes storage and assembly of building materials for delivery to erection sites . B. Wholesale and retail distribution of ranch and farm equip- ment produced on the property. C. An office area ae..J sale and management functions related to the above described permitted uses . These permitted uses shall be conducted within the fac- ilities and structures shown on the unit development plans . Fronting upon a highway, close proximity of cemetary and commercial operations, and uncertanty -of sewage facilities are the most limiting. The fact that the land had been repossessed and offered for sale for some time tends to confirm this. 2) The entire -county could benefit by our benefitting from this location. We serve all of Weld County, and should be centrally located. Also, County business such as building permits, etc, can be transacted more efficiently. This answer is somewhat related to number five. 3) For the most part, yes. The land value of adjoining land with commercial potential will surely rise. While the land is now in alfalfa, the neighbors remember well that it has been a weed patch in years past. A landscaped, clean business should be a benefit to adjoining land parcels, commercial or estate. 4) None, except that it is available for purchase, and has highway frontage. 5) The center of Colorado Agriculture is Weld County. The center of Weld County Agriculture is Greeley. This is why we chose Greeley for our headquarters. Since we are established here, and our employees live here, it would he terribly disrupting to relocate. Besides, we like Greeley. 6) Apparently the original zoning did not adequately consider the im- portance of commercial use of the main highway approaching Greeley from the East. The patch work developement along Colorado 34 indicates there has been a continuous struggle to fin'' the best use for the area. 7) The area (cast 18th street) has attracted and will probably continue to attract at an accelerated rate, businesses serving the agricultural community. The Division has reviewed the site and finds that accessto the -property can be allowed directly off of US 34 Business. The access will be limited to one opening - 24 feet for residential use or 35 feet for commercial use. The access can he located at any point along the frontage; however, no closer -than ten feet of either property line. A Driveway Permit will be required. Application for the access shall be sent to Mr. David Fraser, District IV Maintenance Superintendent, 1420 Second Street, P. 0. Box 850, Greeley, Colorado 80631 . Four copies of an engineer's- type drawing or sketch should accompany the application. This sketch should indicate size and location of the opening as well as a description of where the property is located in relation to county roads -or other physical character- istics in the area. It is the Division 's practice to request of the County preservation of land for future highway use. In this area , our comprehensive plan indicates that 100 -feet of right of way (50 feet each side of centerline) will -be needed. We request that this additional right of way be preserved by setback, reserva- tion, or dedication (preferably the latter) as local zoning laws and regulations permit. It is important to take into consideration what impart the traffic on -the highway will have on noise and -air pollution levels at the site of the proposed development. Developers shall bear the responsi-bility for providing those abatement measures that may be required to meet the minimum environment-al standards. If the highway was built or reconstructed since 1970, it is possible that an air quality or noise impact analysis has been completed. As a general rule for meeting noise standards, residential improvements should generally be set back a minimum of 150 feet to 200 feet from the nearest travel lane, and business improvements should be set -back a minimum of 100 -feet to 150 -feet from the nearest travel lane, unless some other type of noise abatement measures (wall , earth berms, noise-insulated walls and windows, Etc. ) are constructed. A more specific determination can be made only after the parameters for the highway involved are evaluated. As might be expected, -the degree of air pollution decreases as the distance from the source increases. Although this item consists of so many variables , such as meteorology, emission values, Etc. , there are presently no definite parameters to follow. In development proposals such as hospitals, private residences , etc. , where air pollution is a sensitive issue, the test coursE of action is to keep them asfar away as possible from air pollution sources and out of vallEys where pollutants tend to collect. In certain cases, other items should be considered. In a city, it may be dppropriate adjacent to some highways to have the developer provide curb and gutter and sidewalks. In some rural areas, developers should bear the cost of cattle guards at approaches where the rear and sides of a development are not fenced to prevent cattle from coming onto the highway right of way. To Planning Commission, This letter is in regards to a change of zone from "E" Estate to "C" Commerical District for Robert See. We object to the change because it will decrease the value of our property. We take a great deal of pride in our home and it would be more difficult to find a purchaser who would be willing to move their family where there was a commerical operation. It could be next to impossible to even sell the property. The area around and on Cherry Ave is known for a peaceful and quiet enviornment plus being an excellent neighborhood to raise children. .We feel that another commerical operation in the area would greatly effect this whole urea putting it on the minus side and ruining the chances of families raising their children in a good area for potential interest in 4H and other related organizations. We strongly object to the change.
