RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 269 - EDWARD
KIRLIN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 21st day of September, 1977 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Edward Kirlin, does not
come within the purview of the definition of the terms, "subdi-
vision" and "subdivided land, " pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, said Board of County Commissioners did approve
Recorded Exemption No. 269, by Resolution, on September 21, 1977,
and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has been informed by the Weld County Department of
Planning Services, that the aforementioned Recorded Exemption
now needs to be amended by correcting two bearings and distances
on the recorded exemption plat which would eliminate the dis-
crepancies between what was shown on the plat and what was actually
measured in the field during the survey. The amended legal
description is as follows:
The Southeast Quarter of Section 6, Township 4
North, Range 68 West of the 6th P.M., Weld County,
Colorado, and a portion of the Southwest Quarter
of said Section 6, being more particularly de-
scribed as follows:
Beginning at the Southeast Corner of the South-
west Quarter of said Section 6, Township 4 North,
Range 68 West of the 6th P.M. ,
Thence West 579 feet;
Thence North 1128.5 feet;
Thence East 579 feet;
Thence South 1128.5 feet to the place of beginning,
and containing 15 acres, more or less; minus all
land lying between the West line of said tract and
the centerline of the McIntyre Lateral Ditch,
namely that land lying East of the West line of
said tract and West of the centerline of the
McIntyre lateral Ditch, and containing 1 acre,
more or less.

WHEREAS, the Board of County Commissioners of Weld County,
Colorado deems it advisable and in the best interests of Weld
County to approve said amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 269 for Edward Kirlin be, and
hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 20th day of
November, A.D. , 1978 .

RE: Amendment to Recorded Exemption #269
Dear Commissioners :
The attached materials are in reference to a request from Edward
Kirlin for an amendment to recorded exemption #269. The property
is described as Pt . S Section 6, T4N, R68W of the 6th P. M. , Weld
County, Colorado. This property is located 7 miles west of Johns-
town.
The request is to amend recorded exemption #269 by correcting two
bearings and distances on the recorded exemption plat . On the ori-
ginal recorded exemption plat there was a discrepancy between what
was shown on the plat and what was actually measured in the field
during the survey. The request , if approved, would eliminate the
discrepancies.
Based on the information submitted, the Department of Planning Ser-
vices Staff recommends approval of this requested amendment since
the amendment corrects an incorrect legal description.
