REVIEW (USR) QUESTIONNAIRE

The following questions are to be answered and submitted as part of the USR application. If a
question does not pertain to your use, please respond with "not applicable", with an explanation
as to why the question is not applicable.
1. Explain, in detail, the proposed use of the property.
This proposal is to use site and existing infrastructure for a trucking business. The
applicant proposes to build a 60' x 80' steel building to be used for storage of equipment.
The current residence will remain as the owner's residence.
This site will employ up to 10 drivers. There will be up to 10 semi tractors and up to 15
semi trailers parked on this site. There will be no manufacturing at this location.
There is no painting proposed at this facility.
There is no fuel storage proposed on site.
No sign is proposed at this time. If at such time as a sign is required it will meet the sign
requirements as stated in the Weld County Code.
As shown on the site plan, the facility will have approximately 15 truck parking spaces.
Additional parking is available for employees however, as the parking area is gravel,
striping and specific spaces are not specified.
2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter
22 (Comprehensive Plan).
This USR application has been prepared utilizing the process outlined in the Weld County
Code and Procedural Guides. The Guiding Principles of the Comprehensive Plan found in
Section 22-1-120 states, "Land use changes must afford flexibility based on the specific
location and the particular circumstances encountered within the locality. It is also
important to weigh the cumulative impacts that specific land use changes will have."
This proposal is respectful of surrounding uses. The surrounding area has multiple uses
including trucking companies, rural residential, agriculture and also businesses within the
City of Greeley. The site is also adjacent to Weld County Commercial and Industrial
Zoned properties.
The application is consistent with Section 22-2-20 G. A.Goal 7. "County land use
regulations should protect the individual property owner's right to request a land use
change. 2. A.Policy 7.2. Conversion of agricultural land to nonurban residential,
commercial and industrial uses should be accommodated when the subject site is in an
area that can support such development, and should attempt to be compatible with the
region. "

The site is in an area that can support the proposed use. The site is adjacent to or in close
approximation of Weld County C-3 through I-3 zoned properties.
3. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 23 (Zoning) and the zone district in which it is located.
The proposal is for a trucking company in the Agricultural Zone. This proposal is
allowed in the Ag Zone as a Use by Special Review as called in Chapter 23, 23-3-40.
S. Any use permitted as a Use by Right, an ACCESSORY USE, or a Use by
Special Review in the COMMERCIAL or industrial zone districts, provided that
the property is not a Lot in an approved or recorded subdivision plat or lots parts
of a map or plan filed prior to adoption of any regulations controlling
subdivisions. PUD development proposals shall not be permitted to use the
special review permit process to develop.
This facility will be established and operated in a manner that is compatible with existing
and planned land uses in the neighborhood. Currently there are similar uses in the area.
Adequate provision has been made to protect the health, safety and welfare of the
inhabitants of the neighborhood and the County. Operation Standards as found in Section
23-2-260 of the Weld County Code were consulted in preparing this application.
4. What types of uses surround the site? Explain how the proposed use is consistent and
compatible with surrounding land uses.
The surrounding area has multiple uses including production agriculture, vehicle storage
facility, trucking companies and residential uses. The property is also adjacent to
Commercial and Industrial zone properties.
5. Describe, in detail, the following:
a. Number of people will use this site?
It is proposed that approximately up to 10 drivers and the occupants of residence
will use this site.
b. Number of employees proposed to be employed at this site?
It is proposed that approximately up to 10 drivers will use this site. Drivers will
arrive at the site and leave in semi tractor trailers for the day. The drivers will be
on site for less than 2 hours at a time.
c. Hours of operation?
The facility is projected to be operational Monday-Sunday. Standard hours of
operation are proposed to be 6:00 a.m. to 6:00 p.m. However, trucks may arrive
and depart 24 hours per day, if necessary.

A storage building is proposed to be built on this site. Proposed steel building is
60' x 80'.
e. What type and number of animals, if any, will be on this site?
Two (2) dogs will be on this site. Dogs are owned by residence occupants.
f. Kind of vehicles (type, size, weight) that will access this site and how often?
Typical vehicles accessing this site include residence occupants, employee and
owner vehicles and semi-trucks. The following numbers are anticipated:
Trucks and trailers 2-3 axle,from 8,000 to 30,000 lbs, 20-30 feet in length
Pickups and cars: Up to 10 per day for full-time drivers
g. Who will provide fire protection to the site?

h. What is the water source on the property? (Both domestic and irrigation)

6. Explain the proposed landscaping for the site. The landscaping shall be separately
submitted as a landscape plan map as part of the application submittal.
No additional landscaping is proposed. Pine trees are established on north side of
property along East 16th Street. Trees are also established on part of the west side of the
site. The site is completely fenced with an access gate on east side of property.
7. Explain any proposed reclamation procedures when termination of the Use by Special
Review activity occurs.
Reclamation procedures include compliance with applicable regulations and operated as a
commercial trucking facility. Should the facility be permanently discontinued, it would
be marketed under applicable county planning and zoning regulations to its permitted
use.

8. Explain how the storm water drainage will be handled on the site.
Stormwater drains toward the southeast corner of the property. A Water Quality Feature
has been designed and the drainage narrative is included with this application.
9. Explain how long it will take to construct this site and when construction and landscaping
is scheduled to begin.
Construction of storage building will commence upon final approval of the Use by
Special Review permit when economic conditions allow.
10. Explain where storage and/or stockpile of wastes will occur on this site.
There will be no storage of wastes on this site. Any wastes produced from employees
will be contained in a dumpster and hauled off regularly by a local trash service, Northern
Colorado Disposal.
11. Please list all proposed on-site and off-site improvements associated with the use
(example: landscaping, fencing, drainage, turn lanes, etc.) and a timeline of when you
will have each one of the improvements completed.

Traffic Narrative:
The site is located on the southwest corner of Balsam Avenue and East 16th Street. The access is
approximately 152 feet south of East 16th Street on Balsam Avenue. The intersection at Balsam
Avenue and East 16th Street is controlled by a stop sign. Balsam Avenue and East 16th Street are
both paved roads. Access to the site is on existing private gravel road.
Typical vehicles accessing this site include employee and owner vehicles, residence occupants
and semi trucks. Traffic will enter the property on Balsam Avenue at the existing access.
The following numbers are anticipated upon full build-out of the site:
Semi-truck and trailer trucks: 1 - 10 round trips per day
Employee vehicles: 1 -10 per day
The ongoing use of the site and associated traffic is consistent with the existing uses on
surrounding properties, and existing traffic on Balsam Avenue and East 16th Street. Traffic
flow is dependent on the destination service location with expected trip distribution being
80% northbound on Balsam Avenue and proceeding eastbound on East 16th Street and 10%
northbound on Balsam Avenue and proceeding westbound on East 16th Street and 10%
southbound on Balsam Avenue.

Drainage Narrative
The Dan Guzman Trucking, LLC site is a 5-acre parcel that is currently used for a
residence, shop and truck parking. The site is covered by native grasslands, and gravel
driveways and parking areas. The topography is gently sloping 1% or less in general
from north to southeast direction. Historically storm water has surface drained to the
roadside ditch that exists on the east side of the property.
The proposed changes to the property include a new metal building 4,800 SF in size,
with additional gravel parking and truck circulation area to accommodate up to 15
trucks. The drainage calculations include the proposed improvements.
A stormwater quality depression will be incorporated at the southeast corner of the site.
This depression will be approximately 25 x 100 x 1', to allow for 2,500 cf storage. The
design requirement is .052 acre-feet.

Good Afternoon,
This is in response to the Weld County Staff (Kim Ogle) Comment 1.B. page 5, dated
May 5, 2015, which states: "The applicant shall attempt to address the concerns of
the City of Greeley as stated in their referral response dated March 10, 2015." I
have reviewed the City of Greeley staff comments prepared by Caleb Jackson and
Eva Rojas, and offer the following response:
1. We are now aware that the property is located within the City of Greeley's
LREGA. The applicant/owner has no desire to annex at this time. If they should
petition for annexation in the future they understand that certain City of Greeley
Development Standards would apply. For the purpose of this application, the
owner/applicant will adhere to Weld County Development Standards. This includes
all standards related to building setbacks, landscape and streetscape requirements,
pavement requirements, screening, architectural fenestration and articulation,
building façade materials and colors, and lighting.
2. The owner/applicant is aware that the adjacent roadways: East 16th Street
and Balsam Avenue, are 2-lane collector roadways. A 30' half R.O.W. will be
dedicated by separate instrument prior to approval of the USR plat on both roadway
frontages. Further, a 10' future ROW will be delineated on the plat for future use.
Note: There is an existing fence located at 30' from the center line which will
remain in place until such time as the roadway is improved and built to its ultimate
configuration. Proposed structures are shown a minimum of 25 feet from the future
R.O.W. Line.
3. The owner/applicant is aware that a fire hydrant is required. They will agree
to the installation of this prior to the construction of the proposed building.
4. The "storm water infrastructure" on the eastern edge of the property will be
identified and labeled on the plat.
