RE: APROVE THE TRANSFER OF EIGHT (8) WEAPONS FROM THE SHERIFF'S OFFICE
TO THE NORTHERN COLORADO REGIONAL FORENSIC LABORATORY TO BE
ADDED TO THE FIREARMS REFERENCE LIBRARY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a request to transfer eight (8) weapons
that were confiscated by the Weld County Sheriff's Office in the performance of its duties to the
Northern Colorado Regional Forensic Laboratory to be added to the Firearms Reference
Library, and
WHEREAS, after review, the Board deems it advisable to approve the request, as the
weapons were involved in criminal action and cannot be returned to the owners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request to transfer eight (8) weapons that were confiscated by
the Weld County Sheriff's Office in the performance of its duties to the Northern Colorado
Regional Forensic Laboratory to be added to the Firearms Reference Library, be, and hereby is,
approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

by the following vote on the 6th day of May, A.D., 2015.

RE: Weapons for the Regional lab firearms collection

Brief description of the problem/issue: We current have a firearms collection in the Regional Lab that has
been built up through the donations by various agencies in the region, primarily by the five participating
agencies. Recently Susan Johnson notified the lab of guns that were scheduled for destruction and asked that
our Firearms examiner visit the Greeley evidence vault to determine if any of the weapons for destruction could
be used by the regional lab. Dan Gilliam followed up on that request and as a result identified 8 weapons
associated with Weld County cases that could be used by the regional lab to expand our collection.
These weapons are used in the forensic analysis of cases submitted by the five agencies and are critical in the
examiner being able to complete the testing on weapons submitted to the lab. Because the weapons cannot be
returned back to the person they were taken from the only other options are destruction of the weapon as per
court order or transfer to WCSO for use by the SO. In the past the Sheriff has allowed the weapons to be
submitted to the lab for its use and if and when the weapon no longer can serve its function in the lab it will be
returned for destruction. Because such weapons become the property of the County we are required to ask
permission from the commissioners to retain the property at the regional lab. Once made a part of the firearms
collection, the weapons undergo an annual audit to confirm their presence in the regional lab. I am asking that
the 8 weapons identified by Susan Johnson be transferred to the regional lab for use by the lab.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
I. Accept the weapons and transfer to the regional lab.
2. Allow them to be destroyed

Re: Regional Crime Lab firearms request
When firearms have no additional evidentiary value and can be legally disposed of, such firearm can be
transferred to the North Colorado Regional Forensic Laboratory to further their forensic firearms
laboratory work in criminal investigations.
On Friday April 3d, 2015 Regional Lab Ballistics Criminalist Dan Gilliam, Officer Eric Gliva and
Detective Clay Buckingham met with me to review a list of guns in evidence storage slated for destruction.
Out of the guns slated for destruction, Dan Gilliam identified 8 firearms from Weld County cases which
would be useful for his forensic collection. These guns and case numbers are listed below:

On behalf of the Regional Crime Lab I respectfully request the attached list guns of which are all
designated for destruction to be converted to the Regional Crime Lab for use in their firearms
collection.
