WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County

Home Rule Charter, is vested with the authority of administering
the affairs of Weld County, Colorado, and
r WHEREAS , a public hearing was held on April 27 , 1977 , in

the Chambers of the Board of County Commissioners , Weld County,
Colorado, for the purpose of hearing the petition of Arthur
Gallegos , 720? Wood Street, Ft. Collins, Colorado 80521 , re-

5.5 questing a change of zone from E-Estate District to C-Commercial
District, for a tract of land located in the Northwest Quarter
(NWa) of the Southwest Quarter (SA) of Section 9 , Township 5
North, Range 65 West of the 6th P.M. , Weld County, Colorado,
more particularly described as follows :
Commencing at the Southeast Corner of Lot 8 of the North-
west Quarter (NWa) of the Southwest Quarter (SW4) of said
Section 9, according to the subdivision of lands by the
Union Colony of Colorado, Thence South 90°00'00" West,
462.00 feet to the True Point of Beginning; Thence South
90°00'00" West 186.92 feet, Thence North 1°31'00" West, 170.50
feet, Thence North 89°52'50" West, 24.00 feet, Thence North
00°30'30" West, 82.98 feet, Thence North 89°29'30" East,
62.00 feet, Thence North 2°33'30" East, 21.28 feet, Thence
North 90°00'00" East, 154.10 feet, Thence South 00°11'00" West,
275.28 feet to the True Point of Beginning.
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioner for a change of zone upon the aforementioned tract
of land, and
WHEREAS , Section 8. 2 and 8. 3 of the Weld County Zoning
Resolution authorized the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts , and
WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, has studied the
request of the petitioner and the recommendations of the Weld
County Planning Commission, and having been fully informed and
satisfied that the request for rezoning complies with the Weld

County Comprehensive Plan and the conditions set out in Sections
8. 2 and 8. 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the petition of
Arthur Gallegos for a change of zone from E-Estate District
to C-Commercial District on the above described tract of
land, be, and hereby is granted subject to the following stip-
ulation by the Planning Commission:
1. As requested by the City of Greeley, the minimum
setback for all structures must be 80 feet from
the centerline of E. 18th Street.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
April, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 2nd day of May, A.D. , 1977.

I hereby certify that pursuant to a notice dated March 14, 1977,
duly published March 25, and April 15, 1977 in the Greeley Booster,
a public hearing was held on the request of Arthur Gallegos for
a Change of Zone fran E-Estate to C-Commercial District. Mr. Ralph
Cooper, Scott Realty, was present representing the applicant and
answered questions for the Board. After discussion, Canuissioner
Jacobucci made a motion to grant the COZ fran E to C subject to
the Planning Canmission's conditions and the City of Greeley's
request for an 80 foot setback. Catmissioner Carlson seconded
the motion and it carried unanimously. Commissioner Dunbar
was absent fran the hearing.

1. It is the opinion of the Planning Commission that the applicant has
demonstrated that changing conditions in the area now justify a new
classification.
2. The rezoning request agrees with the policies contained within the Weld
County Comprehensive Plan in that the request for Commercial development
is located adjacent to an existing municipality (City of Greeley) and in
compliance with the Comprehensive Plan of that municipality,
3. The City of Greeley Planning Commission has recommended this rezoning
request be approved since the proposed commercial use agrees with the
City's Comprehensive Plan,
4, The Weld County Health Department has indicated that the proposed
commercial development is in compliance with Weld County and State Health
Standards and Regulations,
5, The Weld County Engineering Department indicated no engineering programs
could be identified,
6. The Soil Conservation Service indicated they could not identify any problems

7, The Western Hills Fire Protection District indicated they
had no problems with the approval of this request.
The Planning Commission recommends that the following stipulation
become a condition of approval by the Board of County Commissioners:
1, As requested by the City of Greeley, the minimum setback for all
structures must be 80° from the centerline of E. 18th Street.
Additionally the Planning Commission recommends that the following
items be completed by the applicant prior to advertisement being
done for the hearing by the Board of County Commissioners:
1. As requested by the State Division of Highways and the City
of Greeley, provision should be made for reservation of the
additional right-of-way needed to develop E. 18th Street into
an arterial. A minimum of 50 feet from the centerline of the
existing road must be reserved for this purpose and the re-
zoning plat must be amended to show this additional right-of-
way.
2. The rezoning plat must bear the certification of a registered
land surveyor in the State of Colorado.

The present use of 225 E. 18th Street has been for
raising weeds and disposing of junk cars and other old
items that the renters have discarded from the rectal
units at 221 E. 18th St. This lot is approximately 70'
x 275' deep; it has 70' frontage on bast 18th St. and is
very accessible for our intended use. We have presently
removed all the trash and junk from this lot and intend
on building a small offica, 20' x 20 ' , on the front part
of the lot. Our immediate plans are to construct a h0 '
x 60 ' or h0' x 80' warehouse to store our equipment,
which consists of trash trucks, trash bins, and other
miscellaneous equipment related to our trash business.
This building will contain sufficent electrical service
to give us enough lighting and electrical switches to
operate a compress-or and a welder for use in servicing
and repairing cur equipment. Because there is no water
availah,lo at present for this property in the way of a
water tap we do not intend to wash our equipment at this
location, There are facilities within three blocks for
washing equipment and we intend on using it. As far as
the 20' x 20' office complex, it will contain two office
rooms and a reception area and a small restroom. Vie
intend on installing a septic system and a cistern to
provide eneouh water to maintain cur restroom facilities.
Whcn water is available we intend on taping into the line.
We will be using four employees ; a secretary and three
drivers. We will have three trash trucks which will leave
at 6 :00 a.m. each day and return at 2:00 p.m. daily except
Saturday and Sunday - only one truck will he used from
6 :00 a .m. to approximately 9:00 a .m. There will be a
'Company pickup and each employee will probably have his
own car or pickup. To the best of our knowledge we will
only ingress and regress once daily unless we have some
kind of problem.

The Creeley Planning Commission at its regular meeting on March 8, 1977
reconuuended approval of a rezoning from Estate to Commercial located at
221 East 18th Street in the County. The motion of approval was subject
to consideration of development controls and site plan review to ensure
development that is compatible with surrounding land uses and future de-
velopment of past 18th Street.
East 18th Street will he inmroved as an arterial . In addition, the pro-
posed uses may fall within the City's 1-1 zoning district which requires
a 30-foot front yard. Therefore, a minimwa building front yard setback
of 80 feet from the centerline of 18th Street should be maintained.

tion by Arthur Gallegas. The parcel of land consists of two tracts "A" &
"B" located 225 E 13th St . and 221 E 18th St . respectively .
The primary purpose of this application is to _haree zoning from 5. tates to
Commercial . Tract "A" wi Ii be used for equipment storage and office For trash
hauling business serving the city of Greeley. Tract "B" wilt remain a:; is

The entire area is comprised of one soil type : Otero sandy loam 0 to t
percent slope . The soil ha:; only siight limitations for septic tank ahsorr-
tion fields and building construct ion. The soil does have an extreme
susceptability to wind erosion if the so ; 1 surface is left unprotected
without vegetation.
A septic tank filter field is to be installed to serve office rest room
facilities . There should be no problems , as soils indicate only slight limita-

Re: Arthur Gallegos - request for change of zone from Estate to Commercial ,
NW' , SWa of Sec. 9, T. 5 N. , R. 65 W.
The Colorado Division of Highways has reviewed the above zone change request
and requests due consideration be given the following comments.
Consideration must be given to the preservation of at least the minimum
right of way that will be needed for the improvement of the highway to the
classification shown on the long range regional transportation plan. In the
case of US 34 (18th Street) , 100 feet of total right of way (50 feet each side
of centerline) will be needed. Any additional right of way needed to meet this
requirement shall be protected by reservation, setback, or dedication (preferably
the latter) as local zoning laws and regulations permit. Where the comprehensive
plan for the area indicates that sidewalks, bicycle paths, noise berms , etc. ,
will be built adjacent to the highway, additional right-of-way widths must be
reserved to accommodate these facilities .
The Division assumes that the existing driveway will be used as access
to the two tracts. It would be our recommendation that location of the driveway
not be changed.
It is important to take into consideration what impact the traffic on
US 34 will have on noise and air pollution levels at the site of the proposed
buildings.
Developers shall bear the responsibility for providing those abatement
measures that may be required to meet the minimum environmental standards.
At this time, the Division has not made a noise study in this area. As a
general rule for meeting noise standards, residential improvements should
generally be set back a minimum of 150 feet to 200 feet from the nearest travel
lane, and business improvements should be set back a minimum of 100 feet to
150 feet from the nearest travel lane, unless some other type of noise abatement
measures (walls , earth berms, noise-insulated walls and windows , etc. ) are
constructed. A more specific determination can be made only after the parameters
for the highway involved are evaluated.

As might be expected, the degree of air pollution decreases as the distance
from the source increases. Although this item consists of so many variables,
such as meteorology, emission values, etc. , there are presently no definite
parameters to follow. In development proposals such as hospitals , private
residences , etc. , where -air pollution is a sensitive issue, the best course
of action is to keep them as far away as possible from air pollution sources
and out of valleys where pollutants tend to collect.
