RESOLUTION RE: APPROVE REINSTATEMENT OF SEPTIC SYSTEMS CLEANER LICENSE - REDI SERVICES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 23, 2013, the Weld County Department of Public Health and Environment ("WCDPHE") sent Notice to Redi Services, LLC, located at 7604 Miller Drive, Unit A, Frederick, Colorado, for failure to submit monthly cleaner reports from January of 2012, through the first quarter of 2013, in violation of the Weld County Code, and WHEREAS, on January 16, 2014, WCDPHE sent Certified Notice to Redi Services, LLC, for the continuing failure to submit monthly cleaner reports and notification of a Board of Public Health hearing scheduled for February 25, 2014, and WHEREAS, on February 25, 2014, a hearing was held in front of the Board of Public Health, during which time the systems cleaner license for Redi Services, LLC, was revoked, and WHEREAS, pursuant to Weld County Code changes, it is now required that the Board of County Commissioners decide whether a person or company who has had a systems cleaner license previously revoked should be denied the issuance of a new systems cleaner license upon application, and WHEREAS, on May 8, 2015, a new systems cleaner license was applied for by Redi Services, LLC, and WHEREAS, on May 11, 2015, Redi Services, LLC, submitted all monthly pumping logs from 2012 through 2015, copies of which are attached hereto and incorporated herein by reference, and WHEREAS, on May 18, 2015, a reinstatement hearing was held in front of the Board of County Commissioners, at which time the Board deemed it advisable to continue the matter to June 1, 2015, to allow for the business owner to be present and address the Board, and WHEREAS, on June 1, 2015, the Board heard the testimony and deems it advisable to approve the reinstatement of the systems cleaner license for Redi Services, LLC. NOW THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado, that the systems cleaner license for Redi Services, LLC, be, and hereby is, reinstated. cc:*Ic. February 18,2013 The systems cleaner license renewal fee is paid for by Redi Services, LLC. This is the last time that Redi Services, LLC renewed their systems cleaner license. April 23,2013 Letter sent by the Weld County Department of Public Health and Environment (WCDPHE) to Redi Services, LLC for failure to submit monthly cleaner reports from January 2012 through first quarter 2013. January 16,2014 Certified letter sent by the WCDPHE to Redi Services, LLC for failure to submit monthly cleaner reports after giving notice on April 23,2013. Notification of Board of Public Health hearing scheduled for February 25, 2014 to consider revocation of systems cleaner license for repeat violations of Section 30-3-40 B.3.c of the Weld County Code. February 25,2014 Hearing held in front of the Board of Public Health during which the systems cleaner license for Redi Services, LLC was revoked. Redi Services, LLC did not attend this hearing. This revocation occurred prior to the code changes which now require that the Board of County Commissioners decide if a systems cleaner license shall be revoked. March 4,2014 Certified letter sent by WCDPHE to Redi Services, LLC to give notification that the systems cleaner license had been revoked at the February 25, 2014 Board of Public Health hearing and to give notification that continued operation without a systems cleaner license could lead to criminal prosecution (Class 1 petty offense). 2 May 8,2015 A new systems cleaner license was applied for by Redi Services, LLC. Redi Services, LLC stated their address and phone number has changed. May 11,2015 Redi Services, LLC submitted monthly pumping logs from 2012 through 2015 to WCDPHE. May 18,2015 Hearing held in front of the Board of County Commissioners,during which the hearing was continued to June 1,2015. May 21,2015 Certified letter sent by WCDPHE to Redi Services, LLC to give notification of the continuance of the May 18, 2015 hearing until June 1, 2015. The Weld County Board of Public Health voted to revoke your cleaner license due to the repeated failure to submit documentation as required by Weld County Code Section 30-3-40 B.3.c. which states(emphasis added): "The licensed system cleaner shall provide the Division a list of the locations and legal descriptions of all disposal sites utilized for each load transported. This shall be provided monthly except for septage that is land applied. Septage which is land applied shall meet the requirements of Chapter 14,Article VI of the Weld County Code." Continued operation without a septic cleaner license is a violation of Weld County Code and could lead to criminal prosecution pursuant to Sections 30-8-10.8.1 and Subsection (e).which state in pertinent part: "Any person who commits any of the following acts or violates any of the provisions of this Section commits a Class 1 petty offense as defined in Section 18-1.3-503,C.R.S • "e. Conducts a business as a systems cleaner without having obtained the license provided for in Section 25-10-109(2), C.R.S., in areas in which the Board of Public Health has adopted licensing regulations pursuant to said section". 6 Furthermore,continued operation without a septic cleaner license in violation of Weld County Code can result in the imposition of fines pursuant to Section 30-8-10.B.2 which states: "Upon a finding by the Board of Public Health that a person is in violation of the provisions of this Section or the rules adopted and promulgated pursuant to this Section,the Board of Public Health may assess a penalty of up to fifty dollars for each day of violation." Any person who has previously had a license revoked must have the application to renew the cleaner license approved by the Weld County Board of Public Health, and must submit all outstanding pumping logs to the Division. In part, §25-10-113(2)states: Upon a finding by the local board of health that a person is in violation of this article or of rules adopted and promulgated pursuant to this article, the local board of health may assess a penalty of up to fifty dollars for each day of violation. The basis for the possible imposition of a monetary penalty is that the cleaning of sewage treatment works and on-site wastewater treatment systems, or the transportation of septage to a disposal site, without a valid systems cleaner license from February 25, 2014, until May 18,2015, is a violation of Weld County Code§30-4-120,as authorized by§25-10-109,C.R.S. and Colorado On-Site Wastewater 8 Treatment Regulation 43.4(L). I wish to convey to you, the other fellow commissioners and the good citizens of Weld County my heartfelt apology for our actions and inactions on not being compliant with county regulations. Again, I want to strongly express my apologies as cogently and concertedly as I possibly can, and convey remorse for any harm or difficulties our actions have imposed on Weld County. We at Redi place a high priority and value in operating our company in an open, transparent and compliant manner. We are cognizant that there is an important implied social contract to operate between a business and a community above and beyond the formal regulations. We at Redi have flat out performed poorly at meeting the appropriate standards. We now humbly come to you, the other commissioners and the good citizens of Weld County and ask for your acceptance of our redoubled commitment to be compliant in this facet of our business operations. I believe that our actions and inactions regarding our incidents are not indicative of the true character of our company, but represent a series of unusual events that are saliently outside our normal operating procedures. Clearly with regards to the matter of complying with the septic licensing procedures we failed on all accounts. A Humble Request for a Second Chance Redi respectfully and humbly seeks your kind consideration for a second chance to demonstrate our resolve to complying with county regulations. Correspondingly we seek an extension of our license. Clearly the various events have elevated this matter to a very high sensitivity in our firm. We have over 50 employees residing in Northeast Colorado. Our waste management services are a strong part of our business model and provide employment for several Weld County residents. As you know the oilfield service support industry is undergoing a major challenge with the reduction of oil and gas prices. We approach the commissioners with a plea that you would grant our company the license extension and test our resolve to be fully compliant immediately and remain that way. How Did Redi Get In this Predicament Again, I take full responsibility for our mishandled manner of licensing, but there have been several organization issues that caused our inadvertent inattention. Redi commenced operations in Northeast Colorado in 2012. At that time we were located in a small facility in Frederick. We outgrew that space and move our operations to Ft. Lupton. We knew that this was a temporary arrangement and commenced looking in earnest for a more compatible facility to better accommodate our company's business activities. In late 2014 we then moved to our current location in Platteville. I bring this up to give you some perspective on the dynamics of our business history in Northeast Colorado. During this period of time going from Frederick to Ft Lupton and then to Platteville we have change out our entire operating and office team members. It is now obvious that we failed to establish written operating tasks that included compliance with our septic cleaning reporting requirements. Again, Redi is responsible for comporting with the regulations and we are not minimizing our role in meeting those procedures even with the personnel turnover we experienced. But what I am trying to convey is that our inactions in reporting and securing licensing extensions were primarily the result of poor communication between the transitions of leaders and office administrators — NOT from any intrinsic attitude of purposely wanting to avoid compliance with county regulations. Redi's Leaminqs from this Matter At the upcoming June 1, 2015 commissioner meeting Redi would be delighted to share with you and the commissioners our learnings take way from this experience. I believe that the core question that the commissioners have is: What will Redi do differently from here forward if granted a second chance? Clearly we will asseverate that we will be complaint on a going forward basis. But to augment that declaration we will outline what our plans are to internalize and formalize our approach and activities to this area of procedural compliance.
