RE: APPROVAL OF RECORDED EXEMPTION NO. 339 - SVEN AND KAREN
JOHANSEN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with "the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 30th day of August, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 339, being the property of
Sven and Karen Johansen, described as the West Half of the North-
west Quarter of Section 17, Township 5 North, Range 64 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described as follows:
Part of the West Half of the Northwest Quarter lying
South of County load 58, Section 17, 'I reship 5 North,
Range 64 West of the 6th P.M., Weld County, Colorado,
being more particularly described as follows:
Beginning at the Northwest Corner of said Section 17,
and considering the West line of said Section 17, as
tearing South 00°00'00" West, with all other bearings
contained herein relative thereto;
Thence South 00°00'00" West, along said West line 285.25
feet to the True Point of Beginning;
Thence continuing South 00°00'00" West, along said West
line 483.95 feet;
Thence North 90°00'00" East, 288.00 feet;
Thence North 00°00'00" East, 376.33 feet;
Thence North 69°30'37" West, 307.45 feet to the True
Point of Beginning.
Said described parcel of land contains 2.844 acres, more
or less, including 0.519 acres, more or less reserved
for County Road Right-of-Way purposes. Said described
parcel of land is subject to any rights-of-way or other
easements as recorded by instruments of record or as
now existing on said described parcel of land.

under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the

Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Sven and Karen Johansen, be and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 30th day of
August, A.D. , 1978 .

Dear Commissioners:
The attached application, plat and related items are in
reference to a request by Sven & Karen Johansen for a
recorded exemption. The property on which this request has
been made is described as the WlNW* Section 17 , T5N, R64W
of the 6th P.M. , Weld County, Colorado. This property is
located 1 mile northwest of the Town of Kersey. The pro-
perty contains approximately 67 acres of Class II and III
irrigated soils. The request is to split the property
into parcels of 2 . 844 acres and 64 . 6 acres.
On August 9, 1978, the Board of County Commissioners ap-
proved a request by Sven Johansen for a lot size variance
so that he could make application for this recorded exemp-
tion. At the time they made a decision on that request ,
the Department of Planning Services Staff submitted a
letter of recommendation to the Board. A copy of that
letter of recommendation is included in the attached
packet . Nothing has been received by our office which
would change our recommendation of approval for this
request as outlined in a letter to the Board of County
Commissioners dated August 8, 1978. This request com-
plies with the provisions of Section 9-4 A. of the Weld
Count. Subdivision Regulations .

In accordance with my conversation with Mr. Thomas E. Hohn, I herewith
enclose the needed material for an application for a recorded exemp-
tion, legal description of subject property as follows:
W1 of NWT, Sec. 17, Twnsh. 5N,
Range 64W. of the 6th P.M.
As per his request, I am enclosing the following documents:
1. Certificate of Conveyances.
2. Evidence that the disposal of sewage exists.
3. Application for Recorded Exemption.
4. Surveyor's plat and accurate legal description.
On June 16, 1978, the following described documents were submitted to
the Weld County Planning Commission:
1. Copy of Deed.
2. Rough draft of improvements to be exempted.
3. Letter from Central Weld County Water District.
4. Letter of request for variance.
I am requesting a recorded exemption of the described property, as I
now have an opportunity to sell the approximate 2.8 acres, together
with the hog farrowing operation. I will continue to retain the balance
of the irrigated farm, but due to my age, the work load and the responsi-
bilities of the hog operation have become too great for me.
The County Commissioners granted a variance of the described property on
August 9, 1978.
I hope this letter serves its purpose in obtaining the recorded exemption.

Dear Commissioners : •

The attached letter and related materials are in reference to a request
by Mr. Sven Johansen for a lot size variance . The property on which
this request has been made is described as the WI of the NW* of
Section 17 , T5N, R64W of the 6th p .m. , Weld County , Colorado. This
property is located one mile northwest of the Town of Kersey. The
property contains approximately 64 acres of Class II and III irrigated
soils . The request is to obtain a variance from the minimum lot size
requirement , Section 9-4 A. (6) , so that he can make application to apply
fnr a recorded exemption . If this lot size variance is granted , Mr.
Johansen will proceed with his application for a recorded exemption to
divide the property into two parcels . Mr. Johansen wishes to sell three
acres more ,or less which will include the existing improvements and a
hog farrowing operation . The balance of the property will continue to
be used for irrigated farming.
Based upon the information submitted and the adopted policies in the
county, the Department of Planning Services staff recommends this request
be approved for the following reasons :
1 . The request is in compliance with the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivision Reg-
ulations ) in that Lhe propsed use of the property will be compatible
with the surrounding agricultural uses .
2 . The request is in compliance with the intent clause of the Agricultural
Zone District (Section 3 . 3 A . of the Weld County Zoning Resolution )
and the Weld County Comprehensive Plan in that the request will be
encouraging a related use to agriculture which is the predominant
land use.
