RE: APPROVE SUBMISSION OF APPLICATION TO THE PUBLIC UTILITIES
COMMISSION FOR IMPROVEMENTS TO RAILROAD CROSSING AT COUNTY
ROAD 26 NEAR U.S. HIGHWAY 85 AND AUTHORIZE COUNTY ATTORNEY TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application to the Public Utilities
Commission (PUC) related to certain safety improvements to be constructed to the railroad
crossing at County Road 26 near Highway 85, and
WHEREAS, the PUC requires such applications to be signed and submitted by an
attorney, and
WHEREAS, after review, the Board deems it advisable to approve said application, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that submission of the Application to the Public Utilities Commission be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that Bob Choate, Assistant County Attorney,
be, and hereby is, authorized to sign said application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 16th day of March, A.D., 2015.

The Board of County Commissioners,Weld County,Colorado on behalf of the Weld County Department
of Public Works,(hereinafter referred to as"County"),hereby applies to the Colorado Public Utilities
Commission of the State of Colorado(hereinafter referred to as"PUC"),for PUC for an order
authorizing the installation of railroad crossing safety devices(signage and stop bar)at the intersection of
the Union Pacific Railroad Company(hereinafter referred to as"UPRR"),railroad tracks, DOT#804-
334F, UPRR Mile Post 31.99 Denver Service Unit,Greeley Subdivision.
The County presents the following in support of its application:

(II) The County is a political subdivision of the State of Colorado and is duly authorized to construct,
maintain and operate public roadways in Weld County,Colorado. Offices are located at:

(V) The U. S.Department of Transportation designation of the crossing is#804-334F.The crossing
location is further described as UPRR Mile Post 31.99 of the Greeley Subdivision.Weld County does not
use mile posts referencing,all references are by other County Roads or State Highways,and in this case
the crossing is located on WCR 26 east of State Highway 85. A field diagnostic review was held on
November 19,2014 with attendance by the PUC,UPRR and Weld County staff. This group determined
that additional signage and stop bars should be installed to improve safety and provide advance warning
to truck drivers of the limited storage distance between the track crossing and the WCR 26 intersection
with US Highway 85.
(VI) WCR 26 currently crosses the mainline tracks of the UPRR at nearly a 90 degree angle. The
crossing is located outside of any city or town, in the unincorporated area of the County.An
aerial photograph showing the immediate surrounding area is attached to this application as
"Exhibit A".
(A) WCR 26 is a two-lane,24 foot wide gravel roadway and will be paved with asphalt for
approximately 500 LF. Only a stop sign at SH 85 exists now,there is no other protection
of the crossing.Additionally,WCR 26 intersects with State Highway US 85
approximately 60 feet west of the railroad crossing.WCR 26 grade from US 85 to the
railroad crossing is approximately 4%and from the crossing to the east approximately
3%. There are no large obstructions to inhibit sight of on-coming trains.
(B) UPRR single track grade is a uniform 4%+/-to the north. The crossing pad is concrete.
(C) The ADT at this location was measured at 377 vehicles per day on 8/9/12,with
approximately 30%trucks.This current ADT is anticipated to grow at an annual rate of
about 5% in the future. Current total daily train movements along the UPRR track is
estimated at 15 total trains.This train volume is anticipated to remain relatively constant
in the future.
(D) This Application for crossing protection addresses only a partial solution to the safety of
this crossing. Weld County regularly attends the Highway 85 Coalition meetings and
additional safety improvements could be considered in the future.
(VII) Statement of Work:
(A) The scope of work includes converting the existing WCR 26 approach to the UPRR
crossing to asphalt pavement,on the east side. The approach roadway grade will be
lessened to provide a smoother approach(see Exhibit D). In addition,will be the
installation of regulatory signs R8-8 "Do Not Stop on Tracks",along with a combination
of advance warning signs consisting of W10-11 (storage space sign)and W10-11A
(storage distance sign)and W10-1 (railroad crossing sign).
(B) Estimated Cost of Work within the UPRR ROW is$10,340 for paving and grading and
$600 to$800 for signing and striping.
(C) The construction of this project is currently planned for June through August,2015.
(D) The County,by this application,requests the PUC to approve the work,which will be
100%funded by the County.
(E) The County and UPRR will enter into a Construction and Maintenance Agreement for
this crossing following the PUC's approval of this Application.The Construction and
Maintenance Agreement will be sent to the PUC following execution.
(IX) Installation of signing and striping will be in accordance with the latest edition of the Manual of
Uniform Traffic Control Devices for Streets and Highways.
(X) Should the PUC approve this Application the estimated construction start date is June 2015,
and the expected completion date August,2015.
(XI) For a Vicinity Map of the proposed project—See Exhibit A
(XII) A schematic of the improvements are shown in Exhibit B and Costs are shown in Exhibit C.The
existing conditions as described in paragraph(VI)above.
(XIII) Names and mailing addresses of all persons,adjacent property owners,public utilities,
municipalities,counties,and state that may be interested in or affected by this application
are shown in Exhibit E.
(XIV) A grade separation at WCR 80 location is not practicable or economically feasible,as this
is a rural crossing with limited train and vehicle traffic,and only limited funds are
available,and the crossing is located too close to State Highway 85.
(XV) The County agrees to respond to all questions propounded by the Commission or its staff

WHEREFORE, the County requests that the Public Utilities Commission of the State of Colorado
authorize the upgrading of the above described crossing, including the installation, operation and
maintenance of the crossing. The applicant prefers any hearings be held in the office of the PUC in Denver,
Colorado.
