Proposed use of property Bill Barrett Corporation (BBC) is proposing to drill a new Class II Underground Injection Well on property in eastern Weld County near the border of Morgan County. The proposed property, zoned for agricultural uses, is currently owned by the Colorado State Land Board and measures approximately 328 acres in total area (Parcel No. 096736200004). The proposed well and associated equipment, will measure approximately 3. 192 acres in total size. A Subdivision Exemption approximately 3.2 acres in size will be processed prior to this USR application to accommodate for the proposed facility. The facility (referred to as the ANSCHUTZ STATE 5-62-36 SWD Injection Well Facility) will be used exclusively by BBC for subsurface water disposal of completion flowback water and produced water from BBC's wells within the Denver-Julesburg (DJ) Basin. Injection wells are commonly used in oil and gas development operations for the safe disposal of fluids associated with oil and gas production activities. A complete list of structures and equipment is listed below. The proposed facility will be a permanent facility, operating year-round, lasting the approximate 30-year lifespan of the associated injection well. At the end of well lifespan, the well would be plugged and abandoned according to Colorado Oil and Gas Conservation Commission (COGCC) regulations. The sites will be surrounded by a six-foot tall chain link fence as depicted on the Site Plan. The proposed facility is located in the NW 1 /4/4 of Section 36, Township 5N, Range 62 West approximately 6.6 miles west of the Morgan County line. Consistency with the intent of the Comprehensive Plan BBC has reviewed the Comprehensive Plan as outlined in Chapter 22 of the Weld County Code and believes this project is consistent with its guiding principles. Section 22-2- 10(D) emphasizes extraction of natural resources as an important part of the economy and should minimize impacts to agricultural lands. The proposed facility will be located on lands that are currently non-irrigated rangeland located in a rural area with existing oil and gas activity. 3. Consistency with the intent of the zoning and zone district The injection well facility is classified by Weld County as an Oil and Gas Support and Services facility. Section 23-3-40.A. 1 and 2 of the Weld County Code states that this facility is allowed to be constructed, occupied, operated and maintained in the A (Agricultural) Zone District only upon approval of a Use by Special Review permit in accordance with the requirements and procedures set forth in Article II, Division 4 of Chapter 23. 4. Type S uses sur rounding the site The ANSCHUTZ STATE 5-62-36 SWD facility is surrounded by agricultural properties and is located in an area with existing oil and gas activity. Produced water handling is a necessary component of oil and gas development. When operational, this permitted facility will aid in the reduction of traffic and wear on county roads. 5. Project details a Number of people using the site Approximately 16 contractors and/or employees will access the facility. Contractors accessing the site would be truck drivers that would be disposing water into the SWD well. b. Number of employees housed at the site Upon completion of construction, the injection well will largely operate remotely. There will be no full time personnel on site; however one pumper/operator will be assigned for daily inspections. c. H ours of operation The facility will operate 24 hours a day, seven days a week. However, typical access in and out of the facility will occur during daylight hours except during overnight flowback operations. d. Kind of vehides (type, size, weight) and how often Facility traffic will flow to and from the site daily at intermittent times during mostly daylight hours. (Please see accompanying Traffic Memo.) Fire protection The property falls within the Wiggins Fire Protection District. A referral packet will be sent to the district by Weld County upon application for the USR. h. Water source No full time personnel are on site. No water source is required for this facility. Employees at the site will use bottled drinking water. i. Sewage disposal system A sewage disposal system is not required. A portable toilet will be located on site and emptied at least once a week. j . Storage (what type) No additional storage is required for this facility beyond what is indicated in d(i) and d(ii) above. 6. Pr opoeed Landscaping After the well has been drilled and the facility is constructed, reclamation for those portions not necessary for operations would be completed according to COGCC regulations. The injection well site would be graveled and graded for positive drainage and a 6-ft chain link fence will surround the facility. No further landscaping is proposed. 7. Proposed Redamation When use of the facility is terminated, all facilities will be removed and the land will be returned to its native state according to COGCC regulations. 8. Storm Water Drainage The facility is located on a relatively flat parcel and will be surfaced with gravel. Please see the Drainage Memo included with this application. 9. Construction Process Upon receipt of the appropriate COGCC permits to drill and the UIC Class II permit, construction operations for the well pad would commence. Waste M anagement Plan BBC maintains a corporate Waste Management Plan that covers the management of wastes typically associated with our operations. This plan is used to determine how to best manage common wastes. The objective of the plan is to ensure that generation of wastes is minimized and materials are reused or recycled whenever possible. When that is not possible the plan is utilized to ensure that wastes are managed in accordance with all Local, State, and Federal regulations. BBC personnel are trained on waste management practices. BBC anticipates that the following wastes will be generated at the site: • Used oil • Tank bottoms • Spent filters • Light bulbs • Spent batteries • Hydrocarbon impacted soil from minor leaks and vehicle traffic • Used packaging material, including cardboard, scrap lumber from crates, metal strapping, etc. A small dumpster will be placed on site and municipal solid waste will be managed by either Redi Services, LLC or Waste Management Incorporated. The dumpster will be emptied weekly or bi-weekly. A RCRA Universal Waste program will be set up and managed by Clean Harbors Incorporated for the proper management or recycling of universal wastes such as spent batteries and light bulbs. Used oil will be managed by either January Environmental Services Incorporated or Tri-State Oil Reclaimers. When necessary, tank bottoms will be removed and sent to an authorized disposal facility. This activity will be coordinated by Clean Harbors Incorporated. In addition Redi Services, LLC or Reck Flyers will provide portable toilet service on location. Spills and releases will be managed in accordance with the facilities SPCC Plan and BBC's Emergency Response Plan. Hydrocarbon impacted soils will be removed from the facility as needed and disposed of at Waste Management Incorporated's landfill in Ault, Colorado. 11 . Dust Abatement Plan During the construction phase of the project, BBC will use water or magnesium chloride trucks for dust suppression. Soil erosion will be mitigated through the appropriate use of best management practices contained within BBC's Storm Water Management Plan. After construction is completed, BBC will gravel the access and travelways within the facility area as well as the SWD pad location. Water or magnesium chloride application will be applied on an as-needed basis. SECTION 2 1 . Notification requirements County Notices Section 23-2-210(8)(1): Upon application completeness, agency notice submittal (28 day comment period). This step is completed by Weld County staff Section 23-2-210(8)(6), a sign shall be posted by the County on this proposed site. This step is completed by Weld County staff Section 23-2-210(8)(4): Notice to owners of property within 500 feet of the parcel. As per 23-2-260(B)(9), the list attached was created from Assessor records of Weld County on August 29, 2014. 2. Operational Standards Noise Control: The operation of the facility shall comply with the noise standards enumerated in Section 802 of the COGCC Amended Rules 2008 in addition to any other applicable state noise standards. Minimal noise emissions are expected from this site. Noise sources are expected to be limited to vehicle traffic and electric-drive injection pumps which will be housed inside buildings. Air and Water Quality: All activities will be in compliance with the permit and control provisions of the Colorado Air Quality Control Program, Title 25, Article 7, and C.R.S. as applicable. No waste water will be discharged on the surface of the site. Human wastes will be contained to the portable toilet on site. Lighting: Lighting on the site will be downcast and shielded lighting will be provided on the proposed building. Lighting is for nighttime security and emergency work only. Lighting will be on a timer and motion detection. Any source of lighting on the site shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties. In addition, neither direct nor reflected light from any light source on site will create a traffic hazard to operators of motor vehicles on the adjacent access road Weed Control: The facility will be kept free of weeds, rubbish, and other waste material. The area shall be treated if necessary and as practicable to prevent invasion of undesirable species and noxious weeds. 3. Required Permits Weld County: A Use by Special Review Permit is required to be approved by the Board of County Commissioners. Access to the site will be coordinated with the Weld County Department of Public Works. An access permit application will be submitted as a part of the Subdivision Exemption application. A grading permit is expected to be required. BBC will submit any additional permits necessary for county approval prior to the commencement of construction on site. Wiggins Rural Fire Protection District: The Site Plan and Use by Special Review Application will be referred to and reviewed by the Wiggins Rural Fire Protection District. Oversize Load Permits: If necessary, oversize load permits will be obtained prior to moving any new equipment onto the site. Colorado Oil and Gas Conservation Commission: An Application for Permit to Drill will be obtained prior to drilling and the associated UIC Class II Injection Well Permits will be obtained prior to injection well start-up. 4. Traffic Please see the Traffic Memo located the Appendix. 5. Fire and Emergency Response There is adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county. All roads leading to and those in the site area are designed and maintained to support fire apparatus. Ample turnaround room to accommodate fire apparatus is present. All storage tanks will be permanently mounted with foam nozzles according to API (American Petroleum Institute) standards. BBC support personnel in the field or on call at all times to provide technical assistance in fire prevention and elimination. Containment/SPCC Plan If required, a SPCC plan will be created for the facility prior to commencing operations. It is BBC's policy to create and maintain SPCC plans at all of its non-transportation related facilities in accordance with 40 CFR Section 11 . Upon completion of the SPCC plan, a signed copy will be provided, per the request of Weld County. BBC will implement the containment procedures noted below. In addition, diagrams attached to the application provide further details. • Concrete containment berms around the unloading area • Tank area to be tripled lined, bentonite liner with two synthetic liners. Leak detection system in between the two synthetic liners. • Also, in an emergency situation, there will be psi transducers that will shut the system down when indications of high or low pressures exist. Electronic call outs will be placed within the containment of the tanks and a flow switch will alert BBC personnel. 7. Noise Abatement Plan Given the rural nature of the site and the proximity of existing residences a full noise abatement plan is not a part of this application. As stated in the Operational Standards, above, the facility will comply with all applicable state and COGCC regulations. 8. Groundwater M onitoring Plan A groundwater monitoring plan will be submitted to the Weld County Department of Environmental Health for review and approval prior to recordation of the USR plat. TRAFFIC MEMO • To: Weld County CC: Baseline Project File — 246PL Bill Barrett Corporation Underground Injection Control Well From: Noah Nemmers, PE Date: August 26, 2014 Re: Bill Barrett Corporation — Underground Injection Control Well (Anschutz State 5-62-36 SWD Injection Well Facility) OVERVIEW This traffic memo is prepared to accompany the Use by Special Review permit application for the underground injection control well by Bill Barrett Corporation (BBC). If approved, these uses will be located on land in the eastern half of the northwest quarter of Section 36, Township 5 North, and Range 62 West of the Sixth P.M . in Weld County, Colorado. This memo provides an overview of the long term traffic associated with this site. BACKGROUND Access to the site is located on WCR 56 via a proposed 20 foot-wide driveway. The site is located 3 .5 miles directly southwest from the intersection of WCR 56 and WCR 89 and approximately 6.5 miles west of Morgan County line (intersection of WCR 52 and WCR 97) . WCR 56 is a gravel road with one lane in each direction . A new road will be built off of WCR 56 where it terminates north of Section 26, Township 5 North, and Range 62 West. The road will move southwest through Section 26, cross the southeast corner of Section 27, and south through Section 34. The road will then travel east along the southern border of Section 35 until it reaches the subject property. The use on the site consists of one wellhead building, insulated pump building, Electronic Mechanical Control building, water tanks, gunbarrel tanks, polishing tanks, concrete unloading pad, temporary generator, combustor, conex storage/shipping containers. No personnel will be housed on site. The site will be remotely operated with one person supervising the daily operations. WCR 89 will be the main traffic arterial for the haul route. All other roads used to access the site will connect onto WCR 89 from the north and south . All traffic will then direct to the site via WCR 56. When trucks exist the site they will do so via WCR 56 connect and disperse north and south via WCR 89 . 1 TRIP GENERATION Operational Traffic The following vehicle summaries have been used to determine the anticipated traffic generation numbers: • Overall Employees — 1 per shift, one shift — 2 trips • Average Daily Deliveries/Pickups (Semi-trucks) — 20 daily (40 trips) The following table depicts the expected long term trip generation for the operation : Table 1. CONCLUSION The ongoing use of the site and associated traffic is consistent with the existing uses on surrounding properties with existing traffic onto WCR 52. Intersections along the route have adequate control measures and adequate line of site for proposed traffic volumes. Baseline is processing a Use by Special Review ( USR) application for improvements to land located in the East 1/2, of the Northwest 14 of Section 36 , Township 5 North , 62 West in Weld County. Currently the site is completely pervious, consisting of native vegetation with no structural improvements . Total acreage of the site is approximately 180 acres . A new underground saltwater disposal well (SWD) is proposed for the site . The well , in addition to the facility that will operate the site , will encompass approximately 3 . 19 acres. New gravel access roads and a gravel production area will be installed . EXISTING SITE DESCRIPTION The proposed site is situated south of Weld County Road (WCR) 56 and west of WCR 89, approximately 6 .6 miles west of the Morgan County Line . The site and surrounding area is undeveloped rangeland . In addition , separate oil and gas production facilities exist to the north and west. No existing drainage issues are apparent. PROPOSED SITE DESCRIPTION A subdivision exemption (SE) application will be prepared and submitted along with the proposed SWD Use by Special Review application . This SE lot will encompass approximately 3 . 19 acres of the parent parcel . The remaining areas within the parent parcel will remain largely unchanged .
