WHEREAS, it is apparent to the Board of County Commissioners,
Weld County, Colorado, that there is an urgent need for necessary space
for the Weld County Department of Human Resources - Head Start. Program,
the following described premises:
Certain premises located at 246 East First Street _
Ault, Colorado and consisting
of a kitchen, restrooms, class area to meet minimum require-
ments of at least 525 square feet, and
as per lease rental agreement attached hereto and made a part hereof by
reference; said lease rental agreement being for a term beginning January 15,
1975 and terminating June 5, 1975, payable in monthly installments of One
Hundred Thirty Dollars ($130. 00) as agreed upon in said lease rental agree-
ment.
NOW, THEREFORE, BE IT RESOLVED, that the County of Weld,
State of Colorado, agrees to lease from Santa Martinez
, for the use and benefit of the
Weld County Department of Human Resources - Head Start Program, the
hereinabove described premises as per said lease agreement, all as therein
recited.

LEASE AGREEMENT
THIS AGREEMENT, made and entered into this 12th day of
March, A. D. , 1975, between SANTA MARTINEZ, Party of the First Part,
and WELD COUNTY, a political subdivision of the State of Colorado, by the
Board of County Commissioners, for its respective interest, being the WELD
COUNTY DEPARTMENT OF HUMAN RESOURCES - HEAD START PROGRAM,
Party of the Second Part,
WITNESSETH:
That the said Party of the First Part, in consideration of the covenants
of the said Party of the Second Part, hereinafter set forth, does by these pre-
sence rents to the said Party of the Second Part the following described prop-
erty, to-wit:
Certain premises located at 246 East First Street
Ault , Colorado and described as being the kitchen,
restrooms, class area to meet at least the minimum require-
ments of 525 square feet, and to be occupied as facilities for
the Weld County Head Start Program, pursuant to the conditions
hereinafter set forth.
TO HAVE AND TO HOLD to the said Party of the Second Part from
the 15th day of January, 1975, to the 5th day of June, 1975. And the said
Party of the Second Part, in consideration of the leasing of the premises as
set forth, covenants and agrees with the Party of the First Part to pay the
said Party of the First Part as rent for the same the sum of One Hundred
Thirty Dollars ($130. 00) per month, payable on the 7th day of each and every
month.
In consideration therefor, Party of the Second Part agrees to furnish
said premises for the benefit of the Head Start Program in cooperation with
Party of the First Part who shall have full use of the premises. The use of
all facilities within subject property premises is to confirm with activities
directly related to conducting the Head Start Program, and Party of the Second
Part agrees to deliver the premises to Party of the First Part at 12:00 o'clock
noon on June 5, 1975, in the same condition as of the date occupancy began,
reasonable wear and tear accepted. All personal property of Party of the
Second Part shall be removed by such date.
Party of the Second Part shall secure and maintain liability insur-
ance in the amount of $100,000/$500,000
and provide Party of the First Party copy of such policy, or the verifica-
tion of coverage. Party of the First Part shall indemnify and hold Party
of the First Part harmless against all claims, demands and any :judgments
hereunder.
Party of the First Part additionally agrees to pay the rent each
month in advance and in a prompt manner.
Party of the First Part agrees to pay for all damages to the lease
premises or to the appliances and/or fixtures therein, other than that damage
caused by any act of negligency of Party of the First Part or anyone using the
premises during hours in which Party of the First Part occupies the same;
damages by fire excepted. Markings on walls or woodwork, made by Party
of the Second Part, shall not be considered ordinary wear and tear.
Party of the Second Part shall provide for installation and payment of
all telephone costs and services.
Party of the Second Part shall refrain from driving tacks, nails, screws,
etc., in walls or woodwork, and from painting anything belonging to Party of
the First Part.
Party of the First Part shall refrain from acts or practices causing
considerable noise which would reasonably disturb neighbors.
Party of the First Part, or her agent, shall have the right to enter the
lease premises for the following purposes:
(a) Inspecting the premises for damage or for making needed repairs
or improvements, without intruding into the Head Start. Program's
business records, equipment and/or personal property.
(b) Making necessary repairs or improvements.
(c) Exhibiting the premises to prospective tenants, purchasers, or

mortgagees.
Party of the First Part shall be responsible for the following main-
tenance, unless caused by or resulting from, occupancy of Party of Second
Part:
(a) Repairs to exterior premises.
(b) Repairs to sewers, heating units, all her appliances, wiring
and plumbing facilities.
(c) Repairs to doors, windows, and doorlocks.
Party or the Second Part shall be responsible for any of the above
repairs if they are made by the negligence of Party of the First Part, or any
of its employees or children enrolled within the program.
Provide for trash service and containers necessary to that service,
and to pay for same and shall be picked up once a week.
The furniture and equipment moved into the premises by Party of the
Second Part shall consist of no more than the following:
chairs ( consisting of every type and description
and to be shared with the church.
tables which shall be shared with the church.
filing cabinets.
instructional equipment.
Party of the Second Part shall pay a security deposit of One Hundred
Dollars ($100. 00) which shall be returned at the expiration of this lease less
the cost of repairing any damages (except ordinary wear and tear) caused by
Party of the Second Part, or anyone legally acting under Second Party's con-
trol, the cost of putting the premises in as clean a condition as Party of the
Second Part found them, and any rent due. A breach of this lease by Party
of the Second Part shall result in the forfeiture of the deposit, and at the
discretion of the Party of the First Part, termination of this lease. Security
deposit may be used to assure compliance by Party of the Second Part of all
provisions hereof. Return of this deposit, or any part hereof, shall take place

within thirty (30) days of the day Party of the Second Part vacates the pre-
mises. Party of the Second Part shall be furnished a written statement
setting forth the use to which such deposit is applied and any costs to which
the deposit was applied including the names, addresses, and fees of persons
doing repairs or cleaning, and the costs of materials used.
Party of the Second Part, agrees that it will not involve Party of the
First Part (Santa Martinez) in any activity of obligation other than mentioned
herein above.
If Party of the Second Part does not comply with standards set forth
by Party of the First Part, Party of the First Part, can and will, give thirty
(30) days written notice of eviction.
The covenants herein shall extend to and be binding upon the heirs,
executors, and assignors of the parties to this lease.
IN WITNESS WHEREOF, the parties hereto have hereunto set their
hands and seals the day and year first above written.
