WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land being the
property of William E. Elliott and Ruth L. Elliott, husband and wife, Weld
County, Colorado, and more particularly described as follows:
Part of the West Half (WZ) of the Southwest Quarter (SW-) of
Section 9, Township 5 North, Range 66 West of the 6th P. M. ,
Weld County, Colorado, being more particularly described
as follows:
Beginning at the Southwest Corner (SW Cor) of said Section 9,
and considering the West Line of said Section 9 as bearing
North 00°00'00" East, with all other bearings contained herein
relative thereto;
Thence North 00°00'00" East, along said West Line, 2343. 64
feet;
Thence North 89°11 '30" East, 238. 62 feet;
Thence North 00°03'40" West, 121. 88 feet;
Thence North 89°29'50" West, 238. 55 feet to a point on the West
Line of said Section 9; Thence North 00°00'00" East, along said
West Line, 183. 53 feet to the Northwest Corner (NW Cor) of the
Southwest Quarter (SW;) of said Section 9;
Thence South 89°10'40" East, 1335. 56 feet;
Thence South 00°01 '32" West, 2659. 19 feet to a point on the South
Line of said Section 9;

being the Point of Beginning. Said described parcel of land contains
80. 857 acres, more or less, including a strip of ground 30 feet in
width along the South and West Lines of said Section 9, reserved
for County Road ROW purposes and is subject to any rights-of-way
or other easements as recorded by instruments of record or as now
existing on said parcel of land,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in 1973 C. R. S. 30-28-101 (10), as amended,
and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, has studied the request of the petitioners and studied the
recommendations of the Weld County Planning Commission, and having been
fully informed, now desires to exempt this particular division of land pursuant
to its authority under 1973 C. R. S. 30-28-101 (10) (d), as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by William E. Elliott and Ruth L. Elliott, husband
and wife, Weld County, Colorado, be exempted from the definition of the terms
"subdivision" and "subdivided lands" as provided for in the new Weld County
Subdivision Regulations at Section 2-1, A. , (3) adopted August 30, 1972; how-
ever, subject to the following condition:
1 . That at such time as interior road access is available to property
fronting County Road No. 58, direct access be terminated, and that all access
then be from interior roads; and that if and when the area is developed for

residential purposes the access onto County Road No. 58 (20th Street) be
terminated and future access be onto interior roads only.
The above and foregoing Resolution was, on motion ul made and

Dear Commissioners:
The attached application, plat, and related items are in reference to
a request by William E. and Ruth L. Elliott, for a recorded exemption.
The parcel in question is described as part of the WZ of the SWa of
Section 9, T5N, R66W of the 6th P.M., Weld County, Colorado. Said
property is located approximately 1 mile west of Aim's College at the
junction of County Road 29 (71st Ave. ) and County Road 58 (20th St. ).
The subject property contains 80.857 acres. The request is to split
off a 3.855 acre parcel with a set of improvements from the remainder
of the parcel which also includes a set of improvements. The intention
of the applicants is to retain the 77.002 acre parcel and improvements
would be transferred to the applicants' son and daughter-in-law, Mr. &
Mrs. Donald Elliott.
Based upon the information submitted, the Planning Commission staff re-
commends approval for the following reasons:
1 . The proposed split conforms with the intent clause (Section
9-2 of the Weld County Subdivision Regulations), the intent
clause for the Agricultural District (Section 3.3(A) of the
Weld County Zoning Resolution), and the Weld County Compre-
hensive Plan in that each resulting parcel would have a
existing set of improvements. The use would be compatible
with surrounding apricultural uses.
2. The City of Greeley Planning Commission recommended approval .

Dear Gary:
On Tuesday, April 13, 1976, the Planning Commission discussed a
proposal for a recorded exemption for Mr. Elliott' s property
located at 20th Street and 71st Avenue. The Commission
recommended that the application be approved if an access could
be provided between lots "A" and "B" in the future so that, when
the City grows out to that area, access would not be directly
onto an arterial trafficway and provided that the owner recognizes
that such Planning Commission endorsement in no way affects the
agreements contained in the Greeley-Loveland Shareholders' Contract.

VII . REFERRAL FROM WELD COUNTY - APPLICATION FOR RECORDED EXEMPTION

Planning staff members explained to the remainder of the Administrative Review
Team that this item had been referred to us by the Weld County Board of
Commissioners for a recommendation. The proposal would split a parcel
which would be known as Lot A, a parcel of 3.855 acres in size, from a
larger parcel known as Lot B, which is approximately 77 acres in size. It
is the owner's intention that Lot A, which is the site of existing residential
improvements, would be used for residential purposes; and Lot B, the 77-acre
parcel , would remain in farming uses. Mr. Elliott is a shareholder in the
Greeley-Loveland Ditch Company and, as such, has a City of Greeley water
agreement. City of Greeley water services are asked for both lots, and
septic systems are planned to meet sewer needs. Staff members indicated no
specific disagreement to the approval of the recorded exemption; however, the
City' s endorsement of such a document should in no way be interpreted as being
an approval to constitute a future development of the larger 77-acre parcel .
The water agreements with the City of Greeley, as such, would not be changed
by an approval of this recorded exemption in that obligation on the City' s
behalf to supply the three taps to this acreage would go with the land and not
be affected or enlarged by the exchange in ownership of the land.

Mr. James Larson of 1810 - 20th Avenue presented a petition signed by people who live
directly across from the church on 20th and 21st Avenues and 18th Street. The petition
expressed opposition to the preschool. Mr. Larson stated that there had been a definite F
traffic increase.
Mrs. Oreskovich stated that they used their parking lot for delivering children and, .
since children from different families sometimes rode together, there shouldn't be that

much of an increase.
Dean Cummins moved that the Planning Commission recommend approval of the special use r.
application subject to further review if the preschool wished to expand beyond 37
students at any one time. Glenn McDonald seconded, and the motion passed unanimously.
IV. VACATION OF PLATTED EASEMENT ''EI
Location: Lots 8 and 9, Block 1
Greeley Industrial Park Subdivision
(2035 - 2 Avenue)
Mr. Sasaki presented a plat of the area and pointed out the existing easement. He
presented letters from the utility companies which stated they had no opposition to
vacation of the easement.

Bob Britzman moved the Planning Commission recommend approval of vacation of the easement. i
Dean Cummins seconded. The motion passed unanimously.

Location: 71st Avenue and 20th Street
Mr. Neal commented that Weld County Commissioners are currently considering a recorded
exemption for this property. Ken McWilliams of Weld County Planning staff was present. t
The landowner of this property has requested and received three water taps to his property. i
The Comprehensive Plan outlines a contiguous growth ring policy. The Plan's specific
recommendations are that only single-family development be allowed on parcels of ten acres I
or more and that agricultural uses be allowed. Our own development standards would t,
require that, when single-family lots are platted, they not be platted to have access
onto an arterial trafficway. This parcel would have access onto an arterial trafficway. S:
Ken McWilliams reviewed Senate Bill 35 and recorded exemption procedures. He commented L:
that presently there is an old residence on Lot A as well as a residence under construc- f
tion. Mr. Elliott was present and stated that the old residence would be torn down to r
obtain a water tap. He had requested and been denied another water tap on Lot A. .
Bob Britzman moved that the Planning Commission recommend approval to the County Com-
missioners if an access could be provided between Lots A and B in the future so that
when the City grows out to that area access would not be onto an arti-ial trafficway,
and if the owner of the property agreed to use existing water taps and not request more 6
taps. Glenn McDonald seconded, and the motion passed unanimously.
VI. REFERRAL FROM WELD COUNTY: SPECIAL USE PERMIT TRUCK WASH FACILITY f
Location: East 18th Street (1/2 mile east of Fern Avenue)
Mr. Sasaki reviewed the proposed use of the facility. It will serve as a livestock
truck wash. The water would be recycled. The property is zoned agricultural. Staff rwas concerned that the facility not become a truck stop or storage area. The proposed e.
facility would be one-third of the eventual size if the facility is successful. If
approved, we would request that any further expansion be referred to the Planning
Commission again. Mr. Alleman, Director of Water and Sewer, had expressed concern in an i�
Administrative Review Team meeting about the creation of methane gas due to decomposition,
which would possibly create an explosion. Also, the water would have to be disposed of 4
eventually. Since the facility would be near a river, there could be other environmental '
problems.
Mr. Ewald expressed concern about truck traffic. Mr. Britzman mentioned that a facility
of this type should be near an arterial trafficway.

Location: 71st Avenue and 20th Street
Mr. Neal commented that Weld County Commissioners are currently considering a recorded
exemption for this property. Ken McWilliams of Weld County Planning staff was present.
The landowner of this property has requested and received three water taps to his property.
The Comprehensive Plan outlines a contiguous growth ring policy. The Plan' s specific
recommendations are that only single-family development be allowed on parcels of ten acres
or more and that agricultural uses be allowed. Our own development standards would
require that, when single-family lots are platted, they not be platted to have access
onto an arterial trafficway. This parcel would have access onto an arterial trafficway.
Ken McWilliams reviewed Senate Bill 35 and recorded exemption procedures. He commented
that presently there is an old residence on Lot A as well as a residence under construc-
tion. Mr. Elliott was present and stated that the old residence would be torn down to
obtain a water tap. He had requested and been denied another water tap on Lot A.
Bob Britzman moved that the Planning Commission recommend approval to the County Com-
missioners if an access could be provided between Lots A and B in the future so that
when the City grows out to that area access would not be onto an arterial trafficway,
and if the owner of the property agreed to use existing water taps and not request more
taps. Glenn McDonald seconded, and the motion passed unanimously.

The attached application, plat, and relate items are in reference to
a request by William E. and Ruth L. Ellio , for a recorded exemption.
The parcel in question is described as p t of the W1 of the SW4 of
Section 9, T5N, R66W of the 6th P.M., W d County, Colorado. Said
property is located approximately 1 mi e west of Aim's College at the
junction of County Road 29 (71s e ) ounty Road 58 (20th St. ) .
The su .p�roperty contains 80.857 acres. The request is to split
off a 3.85" acre parcel with a set of improvements from the remainder
- --- of the parcel which also includes improvements. The intention
of the applicants is to retain th 77.002 acre parcel and improvements
would be transferred to the applica s' son and daughter-in-law, Mr. &
Mrs. Donald Elliott.
Based upon the information submitted, the Planning Commission staff re-
commends approval for the following reasons:
1 . The proposed split conforms with the intent clause (Section
9-2 of the Weld County Subdivision Regulations) , the intent
clause for the Agricultural District (Section 3.3(A) of the
Weld County Zoning Resolution), and the Weld County Compre-
hensive Plan in that each resulting parcel would have a
existing set of improvements. The use would be compatible
with surrounding apricultural uses.
2. The City of Greeley Planning Commission recommended approval .

perty fronting County Road 58, direct access be terminated. All access
would then be from interior roads. The recommendation of approval by
the City of Greeley Planning Commission stipulated that when it is
