This letter is to inform you of our complete opposition to the current Weld County USR(Use by Special Review)application
# USR14-0084. We stand fast with our adjacent and local property owners and neighbors that this project is an attempt by a
land developer to gain financial favor at the expense of the adjacent property owners and local neighbors.
We have several objections and concerns about the USR questionnaire and application that are listed below.....
e Objections to answers provided by applicant to comply with Weld County Code Section 23-2-220.
We contend that this proposal is NOT consistent with agricultural zoned area in which the site is located. We also contend
that the proposal is NOT harmonious with the existing surrounding land uses.The examples of similar or existing industrial
type properties that were listed on the application were completely misleading as they were all located much closer to
established industrial locations(i.e. 8"' Avenue East of Hwy 85 bypass and Hwy 85 immediately north of Greeley and east of
Hwy 85).
We do not put much faith in the economic studies from 2012 used by the applicant. A much more current prognostication
from January 21, 2015 at the 2015 BizWest Economic Forecast held at UNC Ballroom,Greeley, CO had experts from real
estate, agriculture, health care,transportation and manufacturing industries sharing their concerns of economic uncertainty
for Weld County in 2015.
We also disagree with the assumption that the land use would be compatible with the future development of the surrounding
area. While visiting with surrounding land owners,agricultural usage was the predominant plan for the surrounding land.The
application also cited the City of Greeley Long Range Expected Growth Area(LREGA)has been located north to Colorado
State Highway 392.While there is a chance the City of Greeley may grow to that size in the future... there is the exact same
chance that the city will NOT grow to that area or size. The size and scale of the growth of the City of Greeley cannot be
foretold, with both accuracy and certainty.
Also, since the land in question was designated"Prime"per the Soil Conservation Service Important Farmlands of Weld
County Map, Weld County Code states that a diligent effort be made to conserve prime agricultural land. NO diligent effort
has been made by the land owner to conserve this prime agricultural land.This land was purchased by the developer
expressly for the water rights, which were quickly sold for profit to the highest bidder. After two years of this prime farmland
sitting idle,this developer now wants Weld County's Planning Commission and Weld County's Commissioners aid in
obtaining another large payday at the expense and anguish of local residents and landowners. EXHIBIT

• l Insafe Increase in Traffic Usage on both WCR -13 and WCR 66.
We will agree that WCR 43 will continue to see increased traffic usage in the future, however,to increase traffic on a WCR
66 so close to an already dangerous intersection, is a complete blunder.The traffic study that is referenced in the memo from
Jen Petrik,P.E., Development Review Engineer dated 3-4-15, is from late 2013.The latest ADT study for WCR 43 near the
site was dated September 2013 and the latest ADT study from WCR 66 was dated October 2013. Since 18 months have
passed since the last ADT study, it is hard to see how Weld County can accurately determine the effects of additional traffic.
Please note that WCR 66 is part of the current route for sugar beet re-hauling from the sugar beet dump located on the SW
corner of WCR 43 and WCR 66 from approx.November thru March each winter. The additional usage with no
improvements to the current intersection and already poorly maintained roads,will only allow continued degradation of the
roads and the surrounding areas.
• Amplified Noise and Light Pollution.
As direct adjacent property owners,we will be subject to increased noise and light pollution from the proposed site.The
vague terms used for business hours,employees and work done on site exposes us and our property to increased noise levels
and increased light pollution. The area surrounding WCR 43 and WCR 66 has seen a huge intensification in light pollution
from the recently built DCP plant located approx. 1 mile south of this site.The increased use of yard lights and security lights
listed in the application will only escalate the light pollution for property owners and residents around the proposed site.
Amplified mechanical noise during both day and night hours(i.e. idling diesel semi-trucks, air brakes,Jake brakes, and misc.
motor-pool noises from tools and etc.)from this proposed site is also a foremost concern of the adjacent property owners and
neighbors.
• Weld Count Right to Farm
In the Weld County Right to Farm declaration, it states that
"Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural
practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to
relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life."
This proposed site turns the incentives of living in rural areas.... open views,spaciousness, wildlife, lack of city noise and
congestion, and the rural atmosphere and way of life.... into drawbacks and undesirable traits ... LESS open views,LESS
spaciousness, LESS wildlife, a continued INCREASE of noise and congestion.
I recognize and support agriculture daily. As a local agriculture business owner myself, I certainly understand the need for
growth and development. However, I also realize that growth needs to be slow, steady and located in a supported or likewise
zoned area...so that the infrastructure has time to adapt and"keep up."I certainly strive for my business to be as successful
as possible.... but success should not have to come at the expense of the rural benefits of the adjacent property owners and
local neighbors.

• \lisc. Objections....
The majority of the details of the information listed in the questionnaire are too loosely defined and extremely vague. Hours
of operations, daily vehicle trips, possible work done on site,are all issues that leave adjacent landowners and neighbors with
NO real sense as to what we are to expect from this proposed development. Words like probable,typical and anticipated
leave the door open for TOO much leeway in the usage of this prime agricultural land.Moreover, if this project is approved,
and the parameters of the USR are exceeded(i.e. too much traffic,too much noise, excess trash,etc.)we,the landowners and
local neighbors,will have no recourse of action.
In addition, based on the natural slope and the proximity to a Zone A Flood area of the site in question and taking into
consideration the use of diesel fuel, motor oils and greases used on large trucks, we are concerned about the lasting effects of
spilled fuels and petroleum products on this prime farm land. With only gravel and recycled asphalt listed in the plans,the
spilled fuels and petroleum products will seep thru these roadway products and contaminate the local soils and possible
larger areas if left to drain into thru adjacent properties and into the Sand Creek waterway.
This USR application also states that a current rezone and subdivision plat application is currently under review for approval
of 5 industrial lots using the PUD process on this same site. We will also be opposing this rezone application and the
development of 5 industrial lots with great conviction and principle. The process of singling out this small parcel of land for
a use classification entirely different from that of the surrounding area for the benefit of the owner of this property and to the
detriment of other adjacent landowners and local neighbors is the basis of our objection.The only goal of this developer is
profit. As a local business owner, I certainly identify the need for profit.However, as Weld county citizens and landowners,
we are against the proposed development of this property, as short-term and future effects to our property as well as the
surrounding land and properties outweigh the lack of benefits available with the possible change of land usage.

To whom it may concern,
As nearby homeowners, we oppose the proposed Use by Special Review#14-0084 for the following
reasons:
1. This USR would result in dramatically reduced property values on the residences nearby.
Specifically the following addresses:
a. 21081 CR 66
b. 21113 CR 66
c. 32413 WCR 43
d. 20767 CR 66
The property value reduction would be caused directly by the visual impact of parked vehicles,
storage containers,and increased traffic.
2. This USR would result in increased traffic on already over used roads, specifically County Roads
66 and 43. The existing beet dump adds an incredibly high amount of increased traffic
seasonally(September—December) and the newly expanded gas plant has added traffic as well.
With the exceptionally high number of traffic fatalities in Weld County,adding any truck traffic
to these roads would be irresponsible.
3. Other than the existing Lucerine Gas Plant,there are no other industrial properties within eye
shot. All the surrounding properties are farm land and residences. Though there are oil and gas
storage tanks scattered around,those are visually very different from parked trucks or industrial
buildings. The potential of up to 6 trucks, 9 trailers, personal vehicles, and 5 shipping containers
in an area is very different from agricultural equipment and use. The applicant's reference to
the airport's industrial developments and industrial development along Highway 85 are not
appropriate as they are quite a distance from the proposed site.
4. With the slow down of the oil and gas industry,the likelihood that these vehicles are parked
long term is high. This adds to the detraction of value for surrounding properties.
5. The applicant's reference to the hours of operation of 6am to 9pm "typically" is very concerning.
The use of the word "typically" leaves the hours of operation to change. In addition,these
hours are outside the normal business day hours and would affect the surrounding residents.
6. The addition of this facility would affect our lifestyle and our ability to enjoy our home. Adding
industrial use to a largely farming area is not an appropriate addition.
In conclusion,we are very concerned about this USR. It affects us and our neighbors and is not an
agreeable addition to the area.

1. We contend that the proposed USR is consistent with the surrounding agricultural zoning. As
the board undoubtedly knows, agricultural uses often comprise of a diverse mixture of industrial
activities ranging from heavy machinery to transportation of goods,to food processing and
packaging. Per the Weld County Code, examples of uses that are allowed in the A-Agricultural
zone include:
• TEMPORARY storage and sorting of, in transit, of crops,vegetables, plants,flowers and
nursery stock not raised on the premises and not for sale on said premises,
• Cultivation, storage and sale of crops,vegetables, plants,flowers and nursery stock
raised on the premises,
• Feeding of LIVESTOCK,
• OIL AND GAS PRODUCTION FACILITIES,
• UTILITY SERVICE FACILITIES,
• Alcohol production which does not exceed ten thousand (10,000)gallons per year,
provided that alcohol and by-products will be used primarily on the owner's or
operator's land,
• ANIMAL BOARDING and animal TRAINING FACILITIES,
• TEMPORARY seasonal uses, including fruit and vegetable stands,and facilities for the
sale of fireworks and Christmas trees,
The cultivation and harvesting of crops, requires heavy equipment to operate back and forth
throughout agriculturally zoned land. The feeding of livestock requires multiple vehicle trips
to and from agriculturally zoned land.The transportation of harvested crops and livestock
requires semi-trucks to make multiple trips to and from agriculturally zoned land. Oil and
gas production requires many vehicle trips to and from the site of an oil well for drilling of

the well, monitoring and maintenance of existing wells, and the transport of pumped oil
from battery tanks. Utility service facilities require the frequent coming and going of utility
provider service vehicles. Animal boarding and animal training facilities have many
customers coming and going to and from such facilities in agriculturally zoned land.
Vegitable stands,firework stands,and holiday sales stands also have many customers that
are allowed by right to be coming and going to and from agriculturally zoned land. The
proposed truck parking area has far less impact than many of the use by right uses listed
above.
Although a motor pool use for truck parking will increase traffic and noise somewhat,so
would an active agricultural use on the same property. We contend that the increase in
noise and traffic is not so great as to be incompatible with the surrounding uses,or the
surrounding zoning.
2. We contend that the proposed USR is harmonious with existing surrounding land uses. The site
has a diversity of uses in the immediate vicinity in addition to agricultural uses. There are oil
and gas wells on the property,as well as tank batteries on the property directly west and
directly south of the property.There's a "Western Sugar&Aukling Leasing"facility a half mile
west of the property. There's a raw water storage pond immediately south across CR 66 from
the site. There are multiple oil and gas wells and batteries in the immediate vicinity.

The nearby oil and gas wells generate truck traffic for monitoring maintenence and transport of
product. The"Western Sugar&Aukling Leasing"facility is a commercial endeavor that serves
nearby agricultural and trucking needs. The natural gas plant generates quite a bit of truck
traffic. Our proposed USR would not be unique to the area.
3. Greeley's. The City of Greeley's "Growth &Service Area Map" identifies an area called the
"Long Term Expected Growth Area (LTEGA)." The LTEGA is an area which is identified as being
appropriate for the city limits of Greeley to someday likely expand into. Much of the
commercial uses within the metropolitan area of Greeley are industries that serve the
agricultural uses of the more rural areas of the county. The majority of the agricultural uses of
Weld County are to the north and north east of the Greeley metropolitan area. Within the
LTEGA is the most appropriate area within which to expand the industrial and commercial uses
that serve and complement the agricultural industry.

Dear Planning Commission,
I am writing this letter in response to the letter that was submitted by Troy&Amy Gray objecting to the
Use by Special Review application and the rezoning application that has been submitted to create 5
industrial lots on parcel#080322300020.
In 2012, I had the property known as 21113 Weld County Road 66 listed for sale. When Troy&Amy
looked at the property they purchased we spoke about the remaining parcel of land and what the owner
of the property was planning on doing with the property since there was no longer any water rights with
the property. We had a conversation about what may happen on the property and I mentioned possible
uses such as trucking,a pipe yard or gravel mining that were possibilities the owner was considering at
that time.
We also had a conversation about the Gray's purchasing additional land to create an additional buffer
between the project and their property. At that time the owner of the property offered to sell an
additional 5 acres for$5,000 per acre.
In my opinion,the Gray's knew about the possibility of the parcel either being rezoned to Industrial or
there being Industrial activities on the property next to theirs and decided to purchase the property
anyway. Any of the uses that were mentioned as possibilities would cause an increase in traffic as well
as some noise and light pollution.
