SUBJECT: USR15-0033 Pearson Truck Parking
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Parking of hot oil trucks.
This project is west of and adjacent to CR 31 and is south of and adjacent to CR 40. Parcel number
105733100051. Commercial access is from CR 40.
Roads:
County Road 40 and CR31 are gravel roads and are designated on the Weld County Road Classification
Plan as local roads, which require 60 feet of right-of-way at full buildout. The applicant shall delineate on
the site map the future and existing right-of-way. If the existing right of way cannot be verified it shall be
dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is maintained
by Weld County.
Traffic:
Just west on CR40 traffic counts in August of 2013 were 333 with 22% of that being trucks.
There are 7 hot oil trucks, 6 employees' personal vehicles and 1 tractor that are associated with the
business. 6 of the trucks are picked up in the morning and returned at the end of the work day.
Access:
An access permit has been approved for the access to the site (AP15-00307).
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users.
Tracking Control:
4 to 10 round large truck trips/day:
Access onto gravel roads requires recycled asphalt or road base on all driving surfaces.
Improvements and Road Maintenance Agreement:
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day
or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded map
indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the
site onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite
tracking and upgrading and/or maintaining onsite tracking control.
Drainage Requirements:
The drainage code is currently going through changes with the Board of County Commissioners. As of
July 13'h the draft code is to be used in a pilot program mode until August 17'h when finalized.
The draft drainage code is available on the planning-engineering website.

As there are no changes to surface types with this project no stormwater detention pond is required as it
meets exception h "Development of sites where the change of use does not increase the imperviousness
of the site."
A water quality feature was provided.
Grading Permit
No grading is proposed with the site. It is planned to be used as is.
Geologic hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. The map shall be amended to delineate the following:

DEVELOPMENT STANDARDS (NOTES ON THE SITE MAP)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Planning-Engineering)
2. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for Mineral Resource
Development Facilities including Oil and Gas Support and Service (parking and storage
of hot oil trucks and related equipment) in the A (Agricultural) Zone District.
The application indicates there are 6 drivers who park on site. A portable toilet will be
provided for drivers, which is acceptable. The rental house is not associated with the
business.
Dust and waste plans were submitted. Washing of vehicles and oil changes will not
occur on site. There will be three fuel storage containers on site.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. For employees or
contractors on site for less than 2 consecutive hours a day, and 2 or less full
time employees on site, portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall be
retained on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The facility shall comply with all provisions of the State Underground and Above
Ground Storage Tank Regulations.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Subject: USR15-0033 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV15-00032)was noted. This
violation was initiated due to the storage and operation of more than 1 (one)Commercial Vehicles without
first completing the necessary Weld County Zoning Permits. This case has not been presented to the
Weld County Court Magistrate through the Violation Hearing process. Since this application was
submitted prior to an actual court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
This violation was initiated on March 17, 2015.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all but 1 (one) Commercial Vehicle (and
shall not return to the property, even if temporarily)shall be removed within 30(thirty)days of denial or the
violation will proceed in court accordingly.
