Explain, in detail , the proposed use of the property. UET Midstream, LLC (UET) is proposing a two-phase pipeline injection and crude oil tank storage facility and Class II Oilfield Disposal Facility within the Agricultural Zone District . The intent of the oil storage facility, which comprises Phase I , is to provide a local crude oil storage facility that will have receipt capability via trucks/tankers and pipeline. The crude terminal will then store the crude on- site in two (2) large storage tanks prior to transfer to the Pony Express Pipeline (PXP). Athird crude oil storage tank may be installed in Phase II . The facility will consist of approximately five (5) to eight (8) oil truck Lease Automatic Custody Transfer units (LACT) receiving skids, outbound injection skid into the PXPSistem, and potential inbound LACTto accommodate local gathered barrels. The Phase II disposal facility will operate as a self-contained Class II oilfield waste disposal facility (saltwater injection) operating 24 hours per day, 7 days per week, 365 days per year with unlimited truck t rips to the facility. The 9.40 acre property is identified as Lot Aof RE-5039-34-3, located on a portion of Section 34, Township 8 North, Range 59 West of the 6th P.M . This site is currently vacant land and is located south of the intersection of Highway 14 and CR36.5. (Please refer to the Recorded Exemption No. 0539-34-3 included with this pre-application package.) The applicant is anticipating approximately 120 inbound oil truck deliveries per day for the crude storage facility, as well as company vehides and contractor vehides. During Phase I , UET Midstream, LLCis proposing to install two 50,000 barrel (BBL) crude oil storage tanks with 5 truck unloading bays. As part of Phase II, a produced water storage area with 3 truck unloading bays will be constructed. The proposed facility will be one-directional and will be entered and exited off of County Road 115 by separate access drives. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Ran. This proposal is consistent with the following goals and polities in the Weld County Comprehensive Ran: V G. A.Goal 7. County land use regulations should protect the individual property owner's right to request a land use change. V A. Fblicy 7. 1 . County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal , or can be mitigated, and where adequate services are currently available or reasonably obtainable. The proposed 51ND facility will provide a valuable service to oil and gas companies in Weld County by providing a local crude oil storage and disposal facility. The single use of the facility will be to unload or load trucks with crude oil or disposal water from the area. Electric service will be the only utility service required for operation of the facility. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. The intent of the A (Agricultural ) Zone District is "to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land uses [and] . .to provide areas for the conduct of uses by Special Review which have been determined to be more intense or to have a potentially greater impact than uses Allowed by Fight ." Installing and utilizing crude oil and saltwater disposal storage tanks is an appropriate use in this agricultural area. The location of this fadlity, next to Highway 14, means that truck traffic would be kept to the Highway and would likely reduce truck traffic, dust and noise on the gravel surfaced county roads. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). The proposed use is consistent and compatible with the surrounding land uses, which are primarily agricultural in nature. There are also numerous oil and gas facilities in the area, which would have similar traffic to the proposed fadlity. 5. Describe, in detail , the following: a. Number of people who will use this site In addition to the number of employees on-site, the projected maximum number of inbound truck deliveries to the facility will be 120 loads per day. Approximately 40 tanker trucks will be utilized to deliver 3 loads per day. Fefer to the response to question 5.f. below for details. b. Number of employees proposed to be employed at this site The facility will be staffed by a maximum of 5 employees that work 12-hour shifts. There will be 4 full time employees and one (1 ) manager per shift . c. Hours of operation The applicant is proposing to be operational 24 hours a day, 7 days a week, 365 days a year. Type and number of structures to be erected (built ) on this site There are no existing structures on the property. The facility will require an 8'x28' office trailer with restroom and two (2) 8'x22' M0?' SNitchgear trailers. All structures will be semi portable units set on concrete pads. Other structures proposed for site include the storage tanks, which will also be set on engineered concrete pads and a canopy over the truck loading bays. Lease Automatic Custody Transfer units (LACT) - truck offload skids - will be brought to the site and placed at each loading bay. e. Water source on the property (both domestic and irrigation) A commercial well could be permitted on the property to provide drinking water for drivers and employees and running water for the office and bathroom, or non-potable water storage tanks will be utilized for bathroom fadlitieswith bottled water brought in for drinking water. i . Sewage disposal system on the property (existing and proposed) An engineered and permitted On-Ste Wastewater Treatment System (OVVTS) is proposed to serve the restroom. j . If storage or warehousing is proposed, what type of items will be stored The fadlity will be used to store 100,000 barrels of crude oil in two 50,000 BBLtanks (87'Dia x 48'H) and another 50,000 barrels in a third tank in the future. In addition to the crude storage area, the facility will contain a polishing/water area consisting of two (2) 1 ,000 barrel polishing tanks and one (1 ) 400 barrel water tank. The Sk/VD storage facility to be constructed in Phase 2 will contain a 14,000sf tank farm including various tanks (number and size to be determined) that will be used to store various stages of produced water. All tanks will be endosed in a secondary containment area. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal . No landscaping is proposed. UET Midstream will install an 8' tall chain link fence around the fadlity. Infer to the Ste Ran (US-Rat Sleet 2 of 2) for the location of the proposed fence. If the fadlity were no longer needed, the tanks and their foundations, road base and concrete surfaces would be removed and the site would be re-seeded with native socd mix. 8. Explain how the storm water drainage will be handled on the site. Detention is provided for the gravel drive and roadside areas by a pond in the southeast corner of the property. Secondary containment is provided for the tank storage area, releasing captured stormwater manually only after it is determined to be uncontaminated. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Construction will begin as soon as authorized by Weld County FUblic Works after the approval of the Grading Permit . Construction of Phase I of the fadlity, induding gravel drives, crude oil tank storage and appurtenances, is anticipated to begin in May of 2015 and will last approximately 4 months. 10. You have requested additional clarification regarding existing and site generated traffic estimates at the site access roadways. As discussed, existing traffic of less than 5 vehicles per hour was estimated based on a couple of our site visits for a few hours in length. While we were at the site recently, we did not observe any vehicles traveling through the SH 14 / WCR 115-WCR 86.5 intersection. Therefore, we made the estimate of maximum 5 existing vehicles in any one hour, which may be conservative considering no traffic was observed during the site visit. This maximum existing traffic estimate would be distributed at the intersection with 1-2 vehicles inbound (left and right turns) and 1-2 vehicles outbound (left and right turns) in a 60-minute period. Some of the traffic volumes shown in Figure 1 (attached) are passenger car equivalents. The 2 vehicles shown in the figure accessing the intersections to/from the southeast are employee passenger vehicles. The remaining 15 vehicles oriented to/from the northwest are trucks, as truck traffic will not travel to the south based on regional operations planned to the northwest of the site. The turning movements shown in the figure are maximum hourly traffic volumes estimated to be generated by the site uses at peak operations. On an average day, the traffic volumes are expected to be less than this. Considering the very low existing traffic and forecast site peak operations traffic, we anticipate the intersections to function well within desired capacities and will not warrant auxiliary turn lanes. The approximate 9-acre vacant site is generally located on the southwest quadrant of the State Highway (SH ) 14 intersection with Weld County Road (WCR) 86.5 and WCR 115, also identified as Lot A of Recorded Exemption No. 0539-34-3 RECX14-OO59. The project involves the construction of a pipeline injection and crude oil/produced saltwater tank storage facility. Vehicular access to the site is planned along WCR 115 south of SH 14. Transportation and Access Conditions The site is located in a rural area of Weld County at the SH 14 / WCR 86. 5-WCR 115 junction . The site is a triangular piece of vacant land that fronts WCR 115. The site vicinity is illustrated on the attached Exhibit 1 for reference. The site is near SH 14 mile marker 195 which is approximately 20 miles east of Briggsdale and 40 miles west of Sterling, Colorado. Based on CDOT traffic count data, the average daily traffic along SH 14 in the site vicinity is 1,900 vehicles per day (sampled in 2013) . The CDOT data showed that trucks make up approximately 40/ of the daily traffic volumes. The SH 14 corridor is paved and has a posted speed limit of 65 miles per hour. All county roads adjacent to the site are unpaved gravel roads with stop conditions at intersections with SH 14. Existing roadway conditions are shown in the photos on the attached exhibits for reference. Access to the site is planned along WCR 115 via two one-way driveways. The northern driveway will provide access for inbound vehicles. The southern access will serve exiting vehicles only. The site includes two primary loading/unloading skid areas. The skid area located on the north portion of the site includes five lanes for the oil related trucks. The skid area on the south side of the site includes three lanes planned for the future saltwater disposal related facility. All traffic exiting the site will travel south along WCR 115 to WCR 86 to access the SH 14 corridor. The attached Exhibit 2 illustrates the inbound site traffic route. Exhibit 3 attached illustrates the outbound site traffic routing planned . Based on oil field and pipeline locations, the majority, if not all, of facility truck traffic will be oriented to / from the north and west along SH 14 with minimal traffic to / from the south and east. This results in the majority of site traffic turning right off of and left onto SH 14. The site access and circulation plan is illustrated on the attached Exhibit 4 for reference. Site Traffic Characteristics The facility is planned to operate 24 hours a day, seven days a week. The site will serve a maximum of 250 trucks per day (24-hour period) with average trucks per day at less than this number. Because intersection capacities are related to peak hour traffic ( highest traffic in a 60- minute period), the maximum peak hour traffic was estimated based on facility operations . The amount of traffic generated by the facility in a 60-minute period is related to the rate at which the trucks can load/unload the product. On average, the trucks can be loaded or unloaded in approximately 30-40 minutes. Based on this, it was assumed that each skid lane could process a maximum of two trucks per hour. With a total of eight skid lanes, this equates to a maximum of 16 trucks arriving and 16 trucks leaving the facility in a 60-minute period should the facility operate efficiently. This is not an average hourly volume, but a maximum figure assuming optimal operations at the facility during peak operations. An office is planned on site to manage facility operations. A total of five employees will operate the site during a 24-hour period with a maximum of 2-3 employees at any one time. It was assumed that one employee will arrive and one will leave within the same hour during the peak processing of the trucks . During a 24-hour period, it estimated there will be a maximum of 20 employee related trips (2 inbound and outbound trips per employee) . Based on the information presented above, the maximum trip generation for the proposed facility was estimated and summarized below. Maximum Site Traffic Characteristics: • 520 daily trips (260 in / 260 out) • 34 peak hour trips ( 17 in / 17 out) The 17 vehicles in the highest hour of the day will enter from the north at the SH 14/WCR 86.5- WCR 115 intersection and exit to the south at the SH 14/WCR 86 intersection . This equates to a maximum of one vehicle every 3-4 minutes turning off of or onto SH 14. Sight distances at the SH 14 intersection approaches exceed the CDOT design criteria, thus adequate sight distances exist for site traffic traveling to or from the SH 14 corridor. The site generated turning traffic onto and off of SH 14 at the adjacent intersections will not warrant CDOT auxiliary lanes. The adjacent intersections are anticipated to function at acceptable levels with existing side street stop traffic control and lane configurations. Conclusions In summary, this traffic analysis reviewed site generated traffic and adjacent transportation network conditions for the proposed Buckingham Crude Terminal Facility site in Weld County, Colorado. The facility is planned for crude oil and saltwater storage. The site use is estimated to generate a maximum of 520 trips in a 24-hour period with 34 of these trips occurring during a 60-minute period . The average daily and peak hour trips generated by the site will be less than the maximum figures. It was determined that the site traffic will be served by the existing adjacent roadway network assuming the planned truck routing. Inbound site trucks will access from the north at SH 14/ WCR 86.5-WCR 115 intersection and exit the site to the south at the SH 14/WCR 86 intersection . This routing spreads the truck traffic between the two intersections and minimizes turning conflicts at the existing offset intersection to the north with SH 14. It was determined that the adjacent intersections are anticipated to function at acceptable levels with existing side street stop traffic control and lane configurations. Offsite roadway improvements are not warranted with construction of this facility. This is an update to the original land use proposed on the site as contained in the traffic analysis prepared for the project dated February 9, 2015. The project is identified as Lot A of Fbcorded Exemption No. 0539-34-3 REC_X14-0059. The site is generally located on the southwest quadrant of the S-I 14 and WCR 86.5 - WCR 115 intersection in Weld County. Snce completion of the February 2015 traffic analysis, the injection well component (salt water disposal ) has been removed from the land use options. The site will now be limited to the crude oil component with five bays proposed initially and up to eight bays total on site in the future. As identified in the traffic analysis, the site is anticipated to generate a maximum of 34 peak hour trips (17 inbound and 17 outbound) during any one hour of the day at buildout peak operations. This traffic figure will still remain valid with the elimination of the injection well component as the same number of bays on site will ultimately be the same and the processing of the trucks will remain the same. However, the daily traffic estimates will be reduced because contracts for the user are limited to a maximum of 120 crude oil trucks per day. This limit in number of trucks per day will result in a total daily traffic volume of 260 trips (130 inbound and 130 outbound), including site employees. Based on the information presented above, the maximum trip generation for the proposed facility was estimated and summarized below.
