HomeMy WebLinkAbout20153129.tiff HEARING CERTIFICATION DOCKET NO. 2015-84 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0071, FOR A 160-FOOT TALL TELECOMMUNICATION TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT - TIMBRO RANCH AND CATTLE COMPANY, LLC, C/O WHITING OIL AND GAS CORPORATION A public hearing was conducted on October 7, 2015, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair- EXCUSED Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno - EXCUSED Also present: Acting Clerk to the Board, Tisa Juanicorena County Attorney, Bruce Barker Planning Services Department representative, Diana Aungst Planning Services Engineer representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 14, 2015, and duly published August 19, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request of Timbro Ranch and Cattle Company, LLC, c/o Whiting Oil and Gas Corporation, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0071, for a 160-foot tall Telecommunication Tower in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made��gq this a matter of record. El Chair Pro-Tem Freeman advised Jim Savory, representing the applicant, that, since Commissioners Kirkmeyer and Moreno were not able to be present, it will require three affirmative votes to approve the permit. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and stated that ten (10) referrals were sent out and eight (8) either did not respond or indicated no concerns. She clarified the site location and the need to submit information regarding oil and gas operations in the area utilizing the tower that will be monitored remotely. Ms. Aungst reported that there is a decommissioning plan in place and a Development Standard to address the co-location of antennas on the tower. She stated there is no requirement for landscaping or screening due to the remote location and she reviewed the adjacent property uses, nearest residence, and clarified it is not within the three (3) mile referral area of any municipality or Intergovernmental Agreement area. Ms. Aungst displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. 2015-3129 PL2369 CC atu; PI; j%7 HEARING CERTIFICATION -TIMBRO RANCH AND CATTLE COMPANY, LLC, C/O WHITING OIL AND GAS CORPORATION (USR14-0071) PAGE 2 Wayne Howard, Planning Services Engineer representative, provided a brief overview of the transportation plans and requirements stating that the site is accessed from County Road (CR) 112 with the approved Access Permit, AP#14-000267. He stated traffic is not a concern as the applicant indicated not more than one vehicle per month for maintenance purposes only and there are no drainage requirements. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating there is no need for sanitary facilities, and there are no concerns with the application. El Mr. Savory, represented the applicant, and stated the tower helps with communication monitoring and notification regarding any potential problems to eliminate surprises. • No public testimony was offered concerning this matter. • In response to Commissioner Cozad, Mr. Savory explained the height of the tower is due to the topography, and there are no other towers in that area. ID In response to Chair Pro-Tem Freeman, Mr. Savory indicated no concerns with the Conditions of Approval or the Development Standards and he thanked staff for their help with the application process. He stated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards. • Commissioner Cozad moved to approve the request of Timbro Ranch and Cattle Company, LLC, do Whiting Oil and Gas Corporation, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0071, for a 160-foot tall Telecommunication Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
