Home My WebLink About760126.tiff I RESOLUTION WHEREAS, a public hearing was held on January 26, 1976, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of the Colorado State Highway Depart- ment, c/o Leo O'Connor, 1420 2nd Street, Greeley, Colorado, (Shaklee Land) requesting permission to locate a gravel pit operation on the following de- scribed property: A tract or parcel of land in the Northeast Quarter Section 26, Township 2 North, Range 65 West of the 6th P. M. , Weld County, Colorado, said tract or parcel being more particularly described as follows: Beginning at a point from which the Northeast corner of Section 26, Township 2 North, Range 65 West of the 6th P. M. bears North 40°58'08" East, a distance of 1815 feet; Thence South 0° a distance of 140 feet; Thence West 90 a distance of 80 feet; Thence South 0° a distance of 320 feet; Thence East 90° a distance of 420 feet; Thence South 0° a distance of 150 feet; Thence East 90° a distance of 240 feet; Thence South 0° a distance of 790 feet; Thence West 90° a distance of 1200 feet; Thence North 0° a distance of 1160 feet; Thence East 90° a distance of 400 feet; Thence North 0° a distance of 250 feet; Thence East 90° a distance of 220 feet, more or less, to point of beginning. Said tract or parcel containing 28. 73 acres, more or less, and WHEREAS, the Petitioner was present, being represented by Mr. Joe A. Intermill, Jr. , Engineering Technician for the State Highway Depart- ment, and WHEREAS, there was no opposition to the request of Petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the Petitioner and studied the recommendations of the Weld County Planning Commission and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Colorado State Highway Department c/o Leo O'Connor (Shaklee Land) to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 760126 , 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That Petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when gravel extraction is completed said permittee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 4. That the operation and development of each gravel pit excavation and rehabilitation shall be limited to plans as submitted and in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. We are requesting permission to remove sand and gravel from a location approximately one mile east and two miles north of Hudson. The material is located on property owned by George and Zelda Shaklee. The pit area is located in a dryland pasture where sand and gravel have previously been removed. Our excavation will not exceed the depth of the present pit. The backslopes will be left no steeper than 2:1 with the bottom of the pit area from which sand and gravel is removed to be seeded. The material will probably be removed with a front-end loader, then screened and stockpiled, or hauled by truck to the roadway or our maintenance yards. Approximately two miles of graveled county road would be utilized in hauling from the pit area to our frontage road. We will conform to Weld County Zoning and Reclamation Regulations for our gravel pit operation and reclamation of the area. Very truly yours, DWIGHT M. '; Sec. 26, T. 2 N. , R. 65 W. One of the County Planning Commission's stipulations is that we obtain your approval of our plan for seeding the area at the completion of our gravel removal operation. As I discussed with you on the telephone, our intentions are to seed it in a similar manner to what we are doing along our right of way in this area. This consists of approximately 18 pounds of seed per acre using a 50-50 mixture of crested wheat and sand love. Approximately one pound of 20-10-10 fertilizer is mixed with the seed prior to planting. We will also use approximately 1600 pounds of straw as mulch prior to planting.
