HomeMy WebLinkAbout20150348.tiff HEARING CERTIFICATION DOCKET NO. 2015-10 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0075, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - LARRY AND PATRICIA NELSON, C/O STEVE CARLSON A public hearing was conducted on February 4, 2015, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Brad Yatabe Planning Services Department representative, Steve Elkins Planning Services Engineer representative, Jennifer Petrik Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated December 31, 2014, and duly published January 5, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request of Larry and Patricia Nelson, do Steve Carlson, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0075, for one (1) Single-Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Fi Steve Elkins, Department of Planning Services, presented a brief summary of the proposal, referral responses and surrounding land uses. He stated there has been one letter of objection received from surrounding property owner, Kelli Carlson, the Little Thompson Water District will provide water, and the site is located in the three (3) mile referral area of the Towns of Berthoud, Johnstown, Milliken and Platteville, which sited no conflicts or did not repond. Mr. Elkins displayed photographs of the site and adjacent views and entered the favorable recommendation of the Planning Commission into the record as written. e Jennifer Petrik, Department of Planning Services Engineer, provided a brief overview of the transportation plans and requirements stating the property accesses CR 36, a local gravel road maintained by Weld County with an average daily traffic count of 46 vehicles as of September, 2012. It has been suggested that there will be an average of eight daily round trips and an Access Permit has been issued, (AP#14-00480). There are two development standards regarding weeds and historical flow patterns. 11 Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating the septic has been determined to be adequate for the addition of a second residence and it has been approved to connect it to the existing septic system. This resulted in the deletion of Condition of Approval #7.A, because it has been completed. There are no outstanding concerns regaridng this request. Steve Carlson, the proposed new resident, represented the applicant and stated Mr. Nelson is experiencing some medical issues and needs some help around the farm. He also communicated that the Nelson's like to travel and this creates a need for assistance as well. In response to Commissioner Conway, this second dwelling makes it possible for Mr. Carlson to live on-site and continue the agricultural operations of the property. IE No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Carlson indicated he and the Nelson's have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. e Commissioner Conway moved to approve the request of Larry and Patricia Nelson, do Steve Carlson, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0075, for one (1) Single-Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Moreno. Commissioner Conway expressed his approval for the assistance to the Nelsons to continue the agricultural operations of the farm. It carried unanimously.
