RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A 60-FOOT EASEMENT ALONG COUNTY ROAD 49 - ROBERT SWARTZ WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from Robed Swartz, 4224 Starflower Drive, Fort Collins, CO 80526, a copy of said petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and included by reference, requesting vacation of a portion of Weld County road right-of-way located west of County Road 49, described as follows: The public road right-of-way, 60-foot road easement, recorded at book 710, page 485, September 16, 1924 (attached hereto and incorporated herein by reference as Exhibit A). The public road right of way continuing north from the aforementioned public right of way and running generally north-south through the E1/2 of Section 12, Township 2 North, Range 65 West and ending at the northeast corner of the NE1/4 of Section 12, Township 2 North, Range 65 West (attached hereto and incorporated herein by reference as Exhibit B, the right of way as cross-hatched on such document). The public road rights-of-way described herein exclude public road right-of-way associated with County Road 49 or any other public road rights-of-way intersected by the rights-of-way described herein. WHEREAS, the Department of Public Works has recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights-of-way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and Ca'Ptiea l5; Appl. 5/q 4100440 Pages: 1 of 3 04/21/2015 12:30 PM R Fee:$0.00 Carly Knopes. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Road Petition from Robert Swartz be, and hereby is, granted pursuant to Colorado Revised Statutes Sections 43-2-301, et. seq., and Weld County Code Chapter 17, Article VII. BE IT FURTHER RESOLVED by the Board that the portion of rights-of-way which are described above be, and hereby are, vacated, with the exception of existing easements located within the rights-of-way to be vacated. BE IT FURTHER RESOLVED that rights-of-way including, but not limited to, public road right-of-way associated with County Road 49, 60-feet within any section line, or any other public road rights-of-way intersected by the rights-of-way to be vacated shall not be vacated or altered in any way by means of this Resolution. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to record this Resolution and the attached Exhibit A in the records of the Weld County Clerk and Recorder. This has included recorded exemptions and oil and gas projects. We have committed considerable time and money into these efforts. The existence of the easement in question could have severe negative impacts on those plans. If we were to attempt to sell any of the 10 acre parcels in which the easement goes through the simple existence of the easement could dissuade potential buyers. Further, if an entity decided to try and exercise the easement and build a road it would have horrible consequences for the infrastructure we have spent so many years to set up. The existence of county road 49 as a thoroughfare seems to make the easement obsolete. Lastly, our land use planner suggested that we petition for official vacation of this easement to completely prevent any possible future conflict for us on our property. It makes sense to completely remove the possibility of having a conflict. It looks as though the easement is a long ago abandoned temporary CR 49 road that was in place until the straight north-south section line road was completed.We don't have any problems with moving ahead with this vacation.
