HomeMy WebLinkAbout20151132.tiff HEARING CERTIFICATION DOCKET NO. 2015-33 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR15-0008, FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS, (MINI-STORAGE AND OUTSIDE RV AND BOAT STORAGE) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - DOUGLAS AND DAWN DETIENNE, C/O WEST GREELEY SELF STORAGE A public hearing was conducted on April 29, 2015, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tern Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Brad Yatabe Planning Services Department representative, Diana Aungst Planning Services Engineer representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: O I hereby certify that pursuant to a notice dated March 20, 2015, and duly published March 25, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request of Douglas and Dawn DeTienne, do West Greeley Self Storage, for a Site Specific Development Plan and Use by Special Review Permit, USR15-0008, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts, (mini-storage and outside RV and boat storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. (Clerks Note: Commissioner Cozad recused herself due to prior representation of this client while working in the private sector for Tetratech.) Anne Best Johnson, Tetratech, representing Douglas and Dawn DeTienne, do West Greeley Self Storage, was present and advised by Chair Kirkmeyer, that, since Commissioner Cozad was not able to be present due to prior representation, if the hearing resulted in a tie vote the application would be deined. Ms. Johnson stated she understood and agreed to proceed. et:all;ea; Ntslat, 2015-1132 PL2336 HEARING CERTIFICATION - DOUGLAS AND DAWN DETIENNE, C/O WEST GREELEY SELF STORAGE (USR15-0008) PAGE 2 El Diana Aungst, Department of Planning Services, presented a brief summary of the proposal for a Mini-Storage and outside Boat and RV Storage and stated there were 15 referrals sent out and 11 returned with either no response or no concerns. She clarified at full buildout there will be approximately 725 mini storage units in ten buildings for about 76,000 square feet of rentable space, and for screening purposes there would be chain link fencing and landscaping. She stated the customer access is automated and available 24 hours each day with security cameras and lighting proposed. There would be up to three (3) employees on-site, and there is no office or water or sewer provisions indicated. The site is located at US Highway 34 and 95th Avenue and the adjacent properties consist of pastures, crops and rural residences with the closest being 55 feet east of the east propoerty line. She further reported the Promentory Subdivision is close by and there are two (2) USRs within one mile. Ms. Aungst stated staff received one letter from the property owner to the south supporting this endeavor; and, had not received any correspondence indicating objection or conerns. This site is within the three (3) mile referral area of the City of Greeley and Town of Windsor; the Town of Windsor indicated no concerns and the City of Greeley indicated the site is within the bounds of City annexation and also meets the standards if annexed. Ms. Aungst entered the favorable recommendation of the Planning Commission into the record as written and displayed a PowerPoint presentation of the site and surrounding views and properties. In response to Commissioner Moreno, Ms. Aungst clarifed the areas to be fenced. CI Wayne Howard, Planning Services Engineer, provided a brief overview of the transportation plans and requirements to include traffic counts and projected daily trips in relation to the business. He further stated the City of Greeley referral indicated the City will work with the applicant regarding the access permit process. Mr. Howard clarified the access gates must be set back, the site is not in a geohazard or floodplain area, a drainage report has been accepted, and the Grading Permit is under review. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating the applicant is not proposing any permanent water or sewer; therefore, portable toilets are acceptable in accordance with the policy regarding ten (10) or less customers and less than two (2) employees on-site at any given time. If the use increases or exceeds the policy requirements, it will require permitting for water and sewer. She stated the applicant has submitted a Dust Abatement Plan, internal circulation will be recycled asphalt, and the Waste Handling Plan indicates customers are required to remove their own waste. She reviewed the typical Development Standards related to environmental health. CI Anne Johnson, Tetratech, represented the applicant, introduced team members who were present, and displayed a PowerPoint presentation. She communicated the site has been designed with input from the Windsor-Severance Fire Protection District and the City of Greeley to include several meetings with Greeley to determine design standards and expectations, and to address on-site circulation patterns. Ms. Johnson conveyed the Fire Marshall agreed with the design and information provided, and mentioned the plat provides a 10-foot right-of-way along 95th Avenue for negotiation. She reiterated the applicants' intent to provide at full buildout 725 storage units and outside storage for RVs and boats and further indicated the applicants' desire to fence the perimeter and place landscaping along the entrance. She also stated the applicants are currently working with Tom Parko to apply for the Small Business Development Program. 2015-1132 PL2336 HEARING CERTIFICATION - DOUGLAS AND DAWN DETIENNE, C/O WEST GREELEY SELF STORAGE (USR15-0008) PAGE 3 Ms. Johnson clarified the landscaping will be natural in color, drought tolerant, and not cause a lot of debris. She mentioned Condition of Approval #1.B could be removed because it has been addressed. In response to Commissioner Conway, Ms. Johnson referred to an article in the Greeley Tribune from March 14, 2015, regarding the shortage of RV and boat storage in the region, and mentioned the prohibition of parking on City streets to include Homeowner Association regulations. O No public testimony was offered concerning this matter. O The Board agreed with the removal of Condition of Approval of #1.A, and clarified the matter surrounding the dedication or even reservation of the extra 10 feet recommending that the City purchase this portion. In response to Commissioner Moreno, Ms. Johnson stated the rules prohibiting the storage of hazardous material and how this is mitigated without impacting property rights of the tenants. Ms. DeTienne added information of how the site will be monitored and their right to inspect questionable items and, if necessary, terminate the contracts at any time. 0 In response to Chair Kirkmeyer, Ms. Johnson, on behalf of Douglas and Dawn DeTienne, do West Greeley Self Storage, indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. e Chair Kirkmeyer expressed her concern regarding RV Storage in general when it is not designed or mitigated properly; however, stated she appreciates that it appears this proposal has been designed properly and will be managed within the guidelines and in consideration of the surrounding property owners, therefore, she is willing to support this application. O Commissioner Conway moved to approve the request of Douglas and Dawn DeTienne, do West Greeley Self Storage, for a Site Specific Development Plan and Use by Special Review Permit, USR15-0008, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts, (mini-storage and outside RV and boat storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Moreno. Commissioner Conway expressed his agreement with Chair Kirkmeyer's comments regarding poorly done storage businesses and expressed his appreciation for the applicant doing their research. He further stated this is needed and it appears this business will be successful based on due diligence.
