D. A regular meeting of the Weld County Planning Commission was held in the Weld County
Administration Building, Hearing Room, 1150 O Street, Greeley, Colorado. This meeting was called to
order by Chair, Jason Maxey, at 1:30 pm.
Roll Call.
Present: Bruce Johnson, Bruce Sparrow, Jason Maxey, Jordan Jemiola, Joyce Smock, Michael Wailes.
Absent/Excused: Benjamin Hansford, Nick Berryman, Terry Cross.
Also Present: Kim Ogle, Diana Aungst, and Steve Elkins, Department of Planning Services; Jennifer
Petrik, Department of Public Works; Lauren Light, Department of Health; Brad Yatabe, County Attorney,
and Kris Ranslem, Secretary.

ID' Diana Aungst, Planning Services, stated that the applicant has submitted a letter requesting
withdrawal of USR14-0062.
The Chair asked if there was anyone in the audience who wished to speak for or against the withdrawal
of this application. No one wished to speak.
Motion: Withdraw Case USR14-0062, Moved by Joyce Smock, Seconded by Bruce Sparrow.
Commissioner Wailes noted the violation on this case and asked how that will get dealt with. Ms. Aungst
stated that the Zoning Compliance Officer will forward this case to the County Attorney's office to process
it and they will set a court date. If the applicant has everything associated with the business removed
from the site prior to the court date,then there will be no court hearing.
Vote: Motion carried by unanimous roll call vote(summary: Yes=6).

f° Steve Elkins, Planning Services, presented Case USR14-0075, reading the recommendation and
comments into the record. Mr. Elkins noted that one (1) letter of opposition was received. The
Department of Planning Services recommends approval of this application with the attached conditions of
approval and development standards.
fr Jennifer Petrik, Engineering, reported on the existing traffic, access and drainage conditions and the
requirements on site.
f" Lauren Light, Environmental Health, reviewed the public water and sanitary sewer requirements, on-
site dust control, and the Waste Handling Plan. Ms. Light stated that the applicant did fulfill Condition of
Approval 7.A and recommended deleting this condition.
Steve Carlson stated that he currently resides on site with the Nelsons. He stated that he is
assisting in taking care of the farm since Mr. Nelson has some health issues and is not able to take care
of it himself. The second dwelling is for him and his children. He added that the letter of opposition was
submitted by his ex-wife.
Commissioner Maxey said that it appears there was an initial violation and there was another violation
because of construction proceeding and was then issued a stop work order. Mr. Carlson said that he was
not aware of the multiple violations but did stop work on the second residence when told to do so. He
added that they had submitted the permits and then they were granted approval to resume construction.

D' Motion: Delete Condition of Approval 7.A, Moved by Bruce Johnson, Seconded by Michael
Wailes. Motion carried unanimously.
The Chair asked the applicant if they have read through the amended Development Standards and
Conditions of Approval and if they are in agreement with those. The applicant replied that they are in
agreement.
D" Motion: Forward Case USR14-0075 to the Board of County Commissioners along with the
amended Conditions of Approval and Development Standards with the Planning Commission's
recommendation of approval, Moved by Michael Wailes, Seconded by Joyce Smock.

Commissioner Maxey stated that he would like to excuse himself from this case. His employer, United
Power, is a member of Tri-State Generation and Transmission and this case is located entirely in United
Power's territory.
D" Kim Ogle, Planning Services, presented Case USR14-0067, reading the recommendation and
comments into the record. Mr. Ogle noted that one (1) letter was received from a developer for the
Aristocrat 3r° Filing with concerns on the alignment. The Department of Planning Services recommends
approval of this application with the attached conditions of approval and development standards.

D' Selina Koler, Tri-State Generation and Transmission, 1100 W 116th Avenue, Westminister,
Colorado, stated that this is proposed as a phasing project. Phase 2 will take a little more time in routing
and added that they hope to present it later this year. Ms. Koler provided a description of the line, poles,
routing and substation associated with this project. The routing is determined by residences, agricultural
uses, oil and gas wells and tanks, other pipelines, and property lines.
Vice-Chair Jemiola asked if there was anyone in the audience who wished to speak for or against this
application. No one wished to speak.
The Vice-Chair asked the applicant if they have read through the Development Standards and Conditions
of Approval and if they are in agreement with those. The applicant replied that they are in agreement.

Conditions of Approval and Development Standards with the Planning Commission's recommendation of
approval, Moved by Bruce Johnson, Seconded by Bruce Sparrow.
