HomeMy WebLinkAbout20151431.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING CONCERNING EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding concerning the Edward Byrne Memorial Justice Assistance Grant (JAG) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the City of Greeley, commencing upon full execution, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding concerning the Edward Byrne Memorial Justice Assistance Grant (JAG) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the City of Greeley be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum of understanding. Alan Caldwell DATE: 5/15/15 RE: 2015 JAG Grant anticipated expenditures The Sheriff's Office was notified that it will be awarded $ 15,361.00 from the Edward Byrne Memorial Justice Assistance Grant Program (JAG). It's anticipated that such funds would be available to the Sheriffs Office sometime in the fall of 2015 if the BOCC agrees to accept the grant and enters into the MOU with the City of Greeley. The Weld County Sheriff's Office would like to utilize the 2015 JAG funds to purchase traffic radars for the patrol vehicles. Traffic safety is a public safety priority of the Sheriff's Office. At this time it's expected that all funds would be spent on radars. The number of radar units to be purchased will be determined in the future since it's dependent on the unit price. The Sheriffs Office intends to work with Weld County Purchasing to determine the best pricing. In the event that JAG funds remain available after purchasing the radars, the Sheriffs Office would like to spend the remaining funds on equipment for the Patrol and/or Detention's division. Examples of such equipment include TASERS, body armor, protective shields, restraint systems and surveillance equipment. The Sheriffs Office is committed to informing the BOCC of how it intends to spend JAG funds. WHEREAS, the Bureau of Justice Assistance has provided joint funding that is available to both the City of Greeley and Weld County; and WHEREAS, the funding that is being provided by the Bureau of Justice Assistance is in the total amount of $60,052; and WHEREAS, the City of Greeley Police Department will be the Fiscal Agent for the grant and will initially receive the total grant award of $60,052; will remit the amount of $ 15,361 to Weld County as the Sheriff's Office portion of the grant award; and, will retain the amount of $44,691 as the City of Greeley Police Department's portion of the award. WHEREAS, as with previous funding, both agencies have determined that they have different needs and uses for the funds being made available; and WHEREAS, this Memorandum of Understanding provides for the division of funds being made available; and WHEREAS, the parties wish to reduce their understanding to writing. THE PARTIES HEREBY AGREE AS FOLLOWS : 1 ) Upon receipt of the total funding amount of $60,052, the Greeley Police Department (Fiscal Agent) will pay the sum of $ 15,361 to the Weld County Sheriffs Office as and for the Weld County's portion of the Edward Byrne Memorial Justice Assistance Grant (JAG) formula program. 2) The remaining sum in the amount of $44,691 will be retained by the City of Greeley as and for the Greeley Police Department's portion Edward Byrne Memorial Justice Assistance Grant (JAG) formula program. 3) The financial reporting to the Bureau of Justice Assistance will be maintained by the Greeley Police Department (Fiscal Agent) with each party maintaining a financial and operational record of their respective portions of the program and in compliance with the Federal Financial Guide, the parameters of the grant and any special conditions as noted in the SOGA award. The Weld County Sheriff's Office shall transmit said records to the Greeley Police Department upon request by the Department.
