Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description This project is west of and adjacent to CR49 and is south of and adjacent to CR30. Parcel number 121325400012 Roads: County Road 30 is a Paved road and is designated on the Weld County Road Classification Plan as a Collector road, which requires 80 feet of right-of-way at full buildout. This road is maintained by Weld County. Latest ADT on CR 30 was taken on 3/6/13 which counted 1118 vpd with 68%trucks. Traffic: A traffic study was submitted by Gene Coppola with the application materials and indicated that there will be approximately 40 truck daily roundtrips, 6 employees and 2 misc trips. The expected traffic routes are CR 30 going east and west of site and distribution of traffic is estimated to be 85% going east and 15% going west. The site will have 6 employees working between 6am and 6 pm. Access: An access permit has been approved for the access to the site (AP15-00133). Entrance gates (if applicable) must be set back a minimum of 75 feet from edge of existing right of way (future right of way if classification is other than local) to allow a truck and trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped for gate be allowed to create a safety issue for roadway users. Tracking Control: Tracking control has been shown on the site plan which includes double cattle guards and pavement. Other PW Permits: A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way. Contact Weld County Public Works at 970-304-6496 ext. 3764. A Transport Permit is required for any oversize and/or over weight vehicles. Contact Weld County Public Works at 970-304-6496 ext. 3764. General Site Plan Requirements: i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes) -Improvements Agreement: An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a Floodplain. Drainage Study: A signed and stamped drainage report with a Certificate of Compliance was prepared and submitted by TetraTech. Engineering finds this to be acceptable. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. Grading Permit The applicant has submitted a grading permit application which has been released under Early Release GRD15-0035 15-0035 CONDITIONS OF APPROVAL: Prior to recording the plat: A. An Improvements Agreement and Road Maintenance Agreement is required for offsite improvements at this site. Road maintenance including dust control, damage repair, specified haul routes and future triggers for improvements will be included. The map shall be amended to delineate the following: A. Show the approved access(es) on the plat and label with the approved access permit number (AP15-00133) B. Show the accepted water quality feature on the map with volume and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA C. Show drainage flow arrows Prior to Construction: NA Prior to Operation: A. Construction of the approved access and/or tracking control improvements is required prior to operation. DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. 5. There shall be no tracking of dirt or debris from the site onto publically maintained roads. The applicant is responsible for mitigation of any offsite tracking and maintaining onsite tracking control devices. MEMORANDUM \ TO: Kim Ogle, Planning Services \ FROM: Heather Barbare, Environmental Health U� foY N T t - - SUBJECT: USR15-0016 Saddlehorn Crude Oil Storage and Transload DATE: APRIL 1, 2015 Environmental Health Services has reviewed this proposal for a site specific development plan and a special review permit for a mineral resource development facilities including oil and gas storage (eight 260,000 barrel crude oil storage tanks and associated equipment) facility and transloading in the A (Agricultural) Zone District. There will be eight employees located at the facility. The applicant is proposing to provide water for drinking/sanitary purposes to the facility by commercial well and is proposing to install a septic system at the facility. The facility will provide portable toilets and bottled water during construction activities and for truck drivers. The applicant provided an approved waste management plan as part of the application. The waste handling plan stipulates that all waste generated onsite will be removed offsite to Waste Management. Wastes from tanks bottoms will be removed via vacuum truck and disposed of at CSI. Wastes generated on-site will be disposed of off-site. The applicant provided an approved dust abatement plan as part of the application. Traffic areas will be either paved or stabilized with road base or aggregate materials. Onsite speeds will be reduced. During construction and as needed, water trucks will be utilized to suppress dust. The applicant submitted verifiable evidence of Air Pollution Emission Notice (APEN) and Emissions Permit application submittal to the Air Pollution Control Division, Colorado Department of Health and Environment. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: Prior to allowing the plat to be recorded: A. The applicant shall submit written evidence of a commercial well to Weld County Department of Public Health and Environment. Prior to the issuance of the Certificate of Occupancy: A. An onsite wastewater treatment system is required for the proposed facility and shall be installed according to the Weld County Onsite Wastewater Treatment System Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Onsite Wastewater Treatment System Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved waste handling plan, at all times. 4. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 5. Any contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. All spills will be reported to local, state and federal agencies in accordance with all state and federal regulations. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan, at all times. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be 2 serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the private water supply. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAPs) and volatile organic compounds (VOCs). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11.A current professional engineer signed and stamped Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 12.The operation shall comply with all applicable State noise statutes and/or regulations. 13.Secondary containment shall be constructed around tanks to provide containment for the largest single tank and sufficient freeboard to contain precipitation. A synthetic or engineered liner shall be placed directly beneath each above-ground tank. Secondary containment shall be sufficiently impervious to contain any spilled or released material. We had a meeting on December 4, 2014 to discuss the proposed facility. A conference call on March 9, 2015, in addition to many follow up conversations in regards to the following. They have agreed to all recommendations below. • A tank will comply with NFPA 22 with a capacity of approximately 250,000 gallon above ground atmospheric tank for fire protection of said facility. The site at this time does not have infrastructure for the required fire flow, as it is not supplied by an outside water source. • Any type of plumbing for the fire department will be compatible to our fittings and hydrant placement TBD. • The fire protection system on the tanks is not stated nor been documented. Depending on this statement, there may be an amendment to the cistern. • On site foam quantity to be no less than 660 gallons at any given time, stored in a controlled environment room. • All fire protection systems on site would need to be accompanied with a plan, fees and schedule for review prior to construction of fire protection systems. • Cross training with Magellan Midstream, initial and ongoing. Systems will be complete and tested prior to certificate of occupancy or temporary certificate of occupancy, if one is approved. Southeast Weld Fire Protection District has adopted the 2006 International Fire Code (IFC) in its entirety, in addition to the comments mentioned above;the 2006 IFC will be complied with. Our office has reviewed the submitted materials. A search of our riles and those of the county assessor's office indicates that there are no historic properties within the project area. Please note that this area has not been comprehensively surveyed for subsurface(historic and prehistoric) archaeological resources. Although agricultural operations can sometimes disturb and/or destroy archaeological sites, this is not always the case, and the site in question may contain significant archaeological and/or cultural resources. We urge caution when developing the site. If resources are discovered during the course of construction, we ask that you contact our office for further guidance. Under state and federal laws, our office takes on a consulting role in projects that involve federal or state funding, permits, and/or land.
