HomeMy WebLinkAbout20152610.tiff RESOLUTION RE: APPROVE CONTRACT AMENDMENT #1 FOR NURSE HOME VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Contract Amendment #1 for the Nurse Home Visitor Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Health and Environment, and the Colorado Department of Human Services , Office of Early Childhood, commencing upon full execution of signatures, and ending June 30, 2016, with further terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Contract Amendment#1 for the Nurse Home Visitor Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Health and Environment, and the Colorado Department of Human Services, Office of Early Childhood, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. Wallace, MD, MPH, Executive Director Department of Public Health & Environment DATE : July 28, 2015 SUBJECT: FY15- 16 Nurse Home Visitor Program ( NHVP ) Contract Amendment # 1 Enclosed for the Board ' s review and approval is the FY15- 16 Nurse Home Visitor Program ( NHVP ) Contract Amendment # 1 between the Colorado Department of Human Services ( CDHS ) and the Weld County Board of County Commissioners for the Weld County Department of Public Health and Environment' s (WCDPHE ) Nurse Home Visitor Program . With the approval of this amendment, WCDPHE will be receiving funding of $ 782 , 417 to cover activities performed beginning July 1, 2015 , and ending June 30, 2016 . This is an increase of $ 36, 999 from the previous year . At no cost to the client, specially trained registered nurses provide bi- monthly home visits to low- income , first time mothers residing in Weld County beginning in pregnancy and continuing until the client' s child reaches the age of two years . Clients are educated and encouraged to develop positive maternal/child health practices, an understanding of infant/toddler developmental needs, effective parenting, and maternal economic self-sufficiency . This contract amendment was approved for placement of the agenda by the Board via pass- around dated July 24, 2015 . The State shall not be liable to pay or reimburse Contractor for any performance hereunder including, but not limited to, costs or expenses incurred, or be bound by any provision hereof prior to the Effective Date . 3) FACTUAL RECITALS The Parties entered into the Contract for/to provide Nurse Home Visiting Services . 4) CONSIDERATION-COLORADO SPECIAL PROVISIONS The Parties acknowledge that the mutual promises and covenants contained herein and other good and valuable consideration are sufficient and adequate to support this Amendment. The Parties agree to replacing the Colorado Special Provisions with the most recent version (if such have been updated since the Contract and any modification thereto were effective) as part consideration for this Amendment. If applicable, such Special Provisions are attached hereto and incorporated by reference herein as N/A . 5) LIMITS OF EFFECT This Amendment is incorporated by reference into the Contract, and the Contract and all prior amendments thereto, if any, remain in full force and effect except as specifically modified herein . 6) MODIFICATIONS. The Contract and all prior amendments thereto, if any, are modified as follows : Exhibit B The Personnel Services Category will increase from $561 ,407 to $621 ,640 . The Operating Category will increase from $ 12, 516 to $ 18,351 . The Training and Technical Assistance Category will decrease from $26, 585 to $ 14, 110 The Equipment Category will decrease from $ 1 , 550 to $3 . The Travel Category will decrease from $28,401 to $21 ,025 . A Contractual Services Category will be added to Exhibit B in the amount of $ 1 . The Other Costs Category will decrease from $ 18, 500 to $ 18,000 . The Administrative Costs Category will increase from $90,624 to $95 , 122 . The total funds available for FY 2016 will increase by the amount of $36,999 from $745,418 for FY 2015 to $782,417 FY 2016 as consideration for services related nurse home visiting program to be provided by the Contractor for FY 2016 . The total amount of this Contract is hereby revised to $ 1 ,527,835. The "Contract Not To Exceed Price" and "Maximum Amount Page 1 I a Available per Fiscal Year" on page one of the Original Contract are hereby modified accordingly START DATE This Amendment shall take effect on the later of its Effective Date or July 1 , 2015 . 7) ORDER OF PRECEDENCE Except for the Special Provisions, in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment and any of the provisions of the Contract, the provisions of this Amendment shall in all respects supersede, govern, and control . The most recent version of the Special Provisions incorporated into the Contract or any amendment shall always control other provisions in the Contract or any amendments. 8) AVAILABLE FUNDS Financial obligations of the state payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted, or otherwise made available .
