HomeMy WebLinkAbout20151306.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MAY 6, 2015 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, May 6, 2015, at the hour of 9:00 a.m. O ROLL CALL: The meeting was called to order by the Pro-Tern and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Steve Moreno Also present: County Attorney, Robert T. Frick Acting Clerk to the Board, Tisa Juanicorena Controller, Barbara Connolly • MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of May 4, 2015, as printed. Commissioner Conway seconded the motion, and it carried unanimously. O AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. O PUBLIC INPUT: No public input was given. CI COMMISSIONER COORDINATOR REPORTS: Commissioner Cozad reported attending the Children's Water Festival sponsored by the Central Colorado Water Conservancy District, City of Greeley and West Greeley Conservation District to educate fourth graders about water conservation. Commissioner Cozad offered to volunteer working with the new District 6 Superintendent to try and get festival attendance higher. Commissioner Cozad also attended a Human Services Committee meeting where the focus was on the DOLA audit, and the final results will be available in 30 days. She had the opportunity to attend the Oklahoma Bombing Lessons presentation, which outlined disaster preparations and how to best make sure everyone is doing their "job". Lastly, she reported that she has been attending various municipal board meetings and was at City of Greeley's where they made some changes to the zoning by the airport from high density commercial to medium density industrial and I gave acknowledgement to the County Commissioners for the project on CR 49. ()15 Minutes, May 6, 2015 2015-1306 Page 1 BC0016 (Clerks Note: Pro-tern Freeman noted for the record that Chair Kirkmeyer arrived at 9:07) Commissioner Moreno reported attending the 2015 Energy Environment Symposium and mentioned other county department heads present from other states. He attended the pilot review election committee demonstration which was given by the vendor that Weld County uses. E9 Commissioner Conway wanted to acknowledge the hard work on Transbonds Bill; however, he said Commissioner Conway stated he is looking forward to the CDOT meeting on May 29, 2015, to learn what their plan is for moving forward. He encouraged the public to attend the Transportation summit meeting on June 15th where they will have the opportunity to question Legislators, and the Governor on how to address the growing crisis concerning maintenance for the larger highways and interstates. OLD BUSINESS: IR 1) CONSIDER FOURTEEN (14) PARKING SPACE LEASES WITH VARIOUS ENTITIES (CON'T FROM 5/4/2015): Toby Taylor, Director of Buildings and Grounds, requested the Board reject the leases for the parking spaces and enter into new negotiations in the coming week. The motion, to reject the leases was made by Commissioner Conway, and seconded by Commissioner Freeman, carried unanimously. NEW BUSINESS: O 1) CONSIDER TRANSFER OF EIGHT (8) WEAPONS FROM THE SHERIFF'S OFFICE TO THE NORTHERN COLORADO REGIONAL FORENSIC LABORATORY TO BE ADDED TO THE FIREARMS REFERENCE LIBRARY: Ron Arndt, Director of the Northern Colorado Regional Crime Lab, identified that these weapons were to be legally destroyed and asked the Board for permission to retain these at the regional lab for use by the firearms examiners. Commissioner Cozad moved to approve said transfer of the eight (8) weapons. The motion was seconded by Commissioner Conway, and it carried unanimously. O 2) CONSIDER TEMPORARY CLOSURE OF CR 39 BETWEEN CRS 38 AND 40: Janet Lundquist, Department of Public Works, presented the terms of the closure effective May 12, 2015, through May 15, 2015, and stated it is for a badly damaged irrigation culvert replacement staff d will be working closely with the farmer for minimal impact on the irrigation season. Commissioner Freeman moved to approve said temporary closure of 39. The motion, which was seconded by Commissioner Moreno, carried unanimously. El 3) CONSIDER TEMPORARY CLOSURE OF CR 388 BETWEEN CRS 59 AND 61: Ms. Lundquist presented the details of the closure to be effective May 18, 2015, through June 4, 2015, and stated it is for a bridge re-deck. Commissioner Moreno moved to approve said temporary closure. Seconded by Commissioner Conway, the motion carried unanimously. Pi 4) CONSIDER TEMPORARY CLOSURE OF CR 44 BETWEEN CRS 47 AND 51: Ms. Lundquist reviewed the details of the closure for an Improvement Project intersection of County Roads 49 and 44 it will begin in early May and end in September, and message boards in will be posted advance to communicate with the traveling public. Commissioner Freeman moved to approve said temporary closure. Commissioner Cozad seconded the motion, and it carried unanimously. • 5) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY PERMANENT EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN IMPROVEMENTS TO COUNTY ROAD 49 and authorize Chair to sign: Tiffane Johnson Department of Public Works, reviews the terms of the purchase agreement for a total of $15, 054.00. Commissioner Minutes, May 6, 2015 2015-1306 Page 2 BC0016 Conway moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Moreno, carried unanimously. e 6) CONSIDER ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM GRANT AGREEMENT FOR COUNTY ROAD 49 WIDENING IMPROVEMENTS FROM 1-76 TO U.S. HIGHWAY 34 and authorize Chair to sign: Elizabeth Relford, Department of Public Works, present the terms of the DOLA grant and stated the County is fortunate to have $9,000,000.00 spread out over two (2) years. This effort is Weld County's first design/build project. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Commissioner Cozad seconded the motion. la Commissioner Conway thanked staff for their hard work, as well as former DOLA Director Reeves Brown. Commissioner Moreno also extended his thanks to staff and to Chair Kirkmeyer with assistance for the program. Commissioner Cozad concurred and it carried unanimously. e 7) CONSIDER STATEMENT OF WORK (OFFICE 365 MIGRATION) and authorize Chair to sign — DELL MARKETING, LP: Ryan Rose, Director of the Department of Information Technology, presented the history of the contract. A response from Dell included a $60,000 credit for use on Dell services. Commissioner Freeman thanked staff for the work at no cost Commissioner Freeman moved to approve said statement of work and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. • 8) CONSIDER AGREEMENT FOR LEASE OF STORAGE OF RURAL DITCH WATER AT HOKESTRA GRAVEL PIT AND AUTHORIZE CHAIR TO SIGN - VARRA COMPANIES, INC: Clay Kimmi, Department of Public Works outlined the annual lease agreement for Varra Companies, Inc., to store and release Weld County's Rural Ditch Water Commissioner Conway moved to approve said agreement for lease of storage of rural ditch water and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. El 9) CONSIDER STATE NOXIOUS WEED FUND GRANT AGREEMENT FOR MAPPING ALONG THE SOUTH PLATTE RIVER: Tina Booten, Pest and Weed Division, explained that The Colorado Department of Agriculture has $100,000 to distribute in grant funding for weed control to help with properties impacted by the recent floods. They gave Weld County two extra months and an additional $10,000 to cost share with landowners. Commissioner Conway moved to approve said grant agreement and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. PLANNING: O 1) CONSIDER IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT OFF-SITE COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT, USR13-0058 - JOSE NIETO: Rich Hastings, Department of Public Works, stated he has reviewed the improvements and the off—site collateral, in the amount of $3, 600.00. Commissioner Moreno moved to approve said agreement, recommends acceptance of the collateral and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. O 2) CONSIDER IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT OFF-SITE COLLATERAL FOR MINOR AMENDED USE BY SPECIAL REVIEW PERMIT, MUSR14-0014 - OPAL FOODS, LLC: Mr. Hastings, presented the agreement as part of a poultry farm Minutes, May 6, 2015 2015-1306 Page 3 BC0016 facility that is expanding and they are having some improvements done for access. Commissioner Freeman moved to approve said collateral for improvements and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved: Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
