E. , Development Engineer SUBJECT: USR15-0043, Osvaldo The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Home site for truck storage This project is north of CR 42 and east of SH 85. Access is from CR 42. Parcel number 105723000061 . Roads: County Road 42 is a paved road and is designated on the Weld County Road Classification Plan as a collector road , which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right- of-way. This road is maintained by Weld County. Traffic: Latest ADT on 42 was taken on 9/30/14 which counted 320 vpd with 40% trucks. A traffic narrative was submitted with the application materials and indicated that there will be approximately 2 trucks daily roundtrips and 3 passenger vehicles roundtrips/day. The expected traffic routes are CR 42 and distribution of traffic is estimated to be 50% east and 50% west of access. Access: An Access Permit application was submitted with the application materials. Public Works will review the application and provide an access permit and permit number if approved. Questions concerning access requirements can be directed to Public Works access permit division . Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. 20 to 50 passenger vehicle round trips/day or less than 4 truck round trips/day: Access onto paved roads includes 100 ft of road base or recycled asphalt. *Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device *** Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. A development standard will be included on the recorded site plan. "The site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking ." A variance request for alternatives to the above tracking control can be submitted to the Traffic Division of Public Works for review and consideration. Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded plan indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the site onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite tracking and upgrading and/or maintaining onsite tracking control. Drainage Requirements: Detention pond waived and a simple drainage narrative: A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for an exception to detention requirements listed below. The drainage narrative must include at the minimum : 1 . Description which exception is being applied for and include supporting documentation . 2. Where the water originates if it flows onto the property from an offsite source 3. Where it flows to as it leaves the property 4. The direction of flow across the property 5. If there have been previous drainage problems with the property Exceptions. 1 . No stormwater detention will be required for sites that meet any of the following conditions: h. Development of sites where the change of use does not increase the imperviousness of the site. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information . Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain : This area IS NOT in a FEMA regulatory floodplain . CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1 . Show and label the approved tracking control on the site plan . Prior to Construction : A. If more than one (1 ) acre is to be disturbed , a Weld County Grading Permit will be required. (Department of Planning Services-Engineer) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1 . Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II , of the Weld County Code. (Department of Planning Services-Engineer) 2. The site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking . (Planning and Engineering) 3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized . (Department of Public Works) 4. The historical flow patterns and runoff amounts will be maintained on the site. (Department of Planning Services-Engineer) MEMORANDUM Ake '✓EL r TO: CHRIS GATHMAN, PLANNING SERVICES FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USRl5-0043 G - DATE: AUGUST 26, 2015 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development Facilities including Oil and Gas Support and Service Facility (parking of trucks and trailers associated with oil and gas support and service along with an office) in the A (Agricultural) Zone District. There will be 2 full time and 2 part time employees accessing the site. The application indicates the septic system for the existing residence will be utilized (SP-9900273). The septic system is sized for 6 people. A portable toilet can be used for the business in accordance with Environmental Health policy. Central Weld Water District provides water to the site. We have no objections to the proposal; we recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 7. In the event the existing septic system is utilized for business use, the septic system shall be reviewed by a Colorado registered professional engineer if the usage surpasses septic permit SP-9900273 sizing limitations. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. 8. For employees or contractors on site for less than 2 consecutive hours a day and 2 or less full time (40 hour week) or 4 or less part time (20 hour week) employees, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 9. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 2 MEMORANDUM Ittti = % r1 To: Chris Gathman , Planner August 3, 2015 From : Bethany Pascoe, Zoning Compliance Officer Subject: USR15-0043 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV15-00033) was noted . This violation was initiated due to the operation of a commercial trucking operation without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled , NO investigation fee is required . Due to records release laws, staff no longer tracks complainant information , but please be aware it is staff's policy to no longer accept staff initiated complaints. This violation was initiated on March 17, 2015. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied, all but 1 (one) Commercial Vehicle shall be removed from the property 30 (thirty) days of denial or the violation will proceed in court accordingly.
