HomeMy WebLinkAbout750021.tiff RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, are charged with preserving the health, safety and welfare of the citizens of Weld County, and WHEREAS, said Board of County Commissioners, Weld County, Colorado, has heretofore adopted a Uniform Building Code, and other uniform codes dealing with the construction of buildings and other structures within the County of Weld, and WHEREAS, all of such codes adopted by Weld County, Colorado, have been for the purpose of maintaining the health, safety and welfare of the citizens of Weld County, and WHEREAS, it has come to the attention of the Board of County Commissioners, Weld County, Colorado, that certain aspects of the construc- tion of buildings within Weld County, Colorado, are not included within the term of the uniform codes previously adopted by said Weld County Board of County Commissioners, Weld County, Colorado, and WHEREAS, the County is desireous of maintaining the health, safety and welfare of the citizens of Weld County and that it is necessary that those aspects of construction not covered by the codes of construction previously adopted by Weld County, should be controlled and directed by a building code which would be a standard against which to measure the quality of work, and WHEREAS, the Uniform Mechanical Code of 1973 contains provisions for construction of heating and ventilating systems and other mechanical systems for the construction of buildings, and WHEREAS, it is the determination of the Weld County Board of County Commissioners that such a code be adopted so as to cover the construction of the heating, ventilating and cooling and other mechanical systems of a building for the health, safety and welfare of the citizens of Weld County, and WHEREAS, the Uniform Mechanical Code of 1973 in the determination of the Board of County Commissioners is an adequate standard to so regulate such construction, and WHEREAS, upon review, the Board of County Commissioners deems it necessary that such a code be adopted in order to protect the health, safety and welfare of the citizens of Weld County, Colorado, and NOW, THEREFORE, BE IT RESOLVED, that the Uniform Mechanical Code of 1973 is hereby adopted as the Uniform Code governing the construction of mechanical systems of any buildings to be constructed within Weld County, and these provisions shall prevail as a minimum standard for the construction of mechanical systems and buildings in Weld County. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the23rdday of July, A.D., 1975. Those present were: Richard Straub, County Engineer, Weld County V. D. Einsphahr, Assistant Fire Chief, Greeley Harold Evans, Hensel Phelps Construction Paul Lundquist, Nelson Haley Patterson & Quirk Jim Robenstein , Bargelt & Company Virgil McKee, Chief Building Inspector, Weld County Gary Fortner, Interim Planning Director, Weld County INTRODUCTIONS: Mr. Straub introduced the members to each other and stated that he had been temporarily appointed Chairman of the Board until they held their election of officers. He thanked everyone for coming and for any help they can give. It was felt that they would not need to meet much more than once a month. DISCUSSION: Mr. McKee asked the Board's opinion regarding height and size for escape windows. Code says you need 22 inches overhang; at the moment some windows are a little over 16 inches. Is this large enough to get through? Mr. Robenstein stated that, with the City, if you take the wording on that particular requirement of the Code, it says, ". . .a window meeting this will meet it. . . "; but it doesn't necessarily say that all other windows are out. It leaves it so that you can on your own part make a judgement if you feel that those windows do open far enough to let a person out. An escape window is required in a basement or a bedroom, height to be 48 inches. Another question is, if the County adopts the Uniform Building Code, do they also adopt the Mechanical Code at the same time? The feeling of the Board was No. The Mechanical Code is a separate code unto itself. Chief Einsphahr was wondering if the County was going to adopt the Fire Code? Mr. Fortner stated the Planning Office staff was working on it. Another problem is with fireplaces. Mr. McKee suggested they seriously consider eliminating that part of the Code dealing with fire log lighters (or amend it) . They are hazardous in several ways. Most of them don't have an automatic shut off on them; they don't have any pilot light that can be safely turned off; the turn on valve is accessible to children and could be turned on but not lit. With natural gas they aren't quite as bad, but where propane is used, they are especially dangerous. Another problem is that there are no Fire Zones in the County. ELECTION OF OFFICERS: Mr. Evans nominated Mr. Robenstein for Chairman, seconded by Mr. Lundquist. A unanimous vote of "Aye". Motion carried. Mr. Robenstein is new Chairman of the Board. Mr. Lundquist nominated Mr. Straub as Vice-Chairman, seconded by Mr. Evans. A unanimous vote of "Aye". Motion carried. Mr. Straub is new Vice-Chair- man of the Board. Will probably hold meetings in the County Commissioners ' Hearing Room in the new Health Department Building. Meeting time around 1 :00 P.M. seemed most convenient for all members. WCUBCBA - 1 Agendas will be mailed to all members prior to any meetings giving them sufficient time to do any research they may wish to do. Mr. McKee stated that he would give the members sections of the Code which the case applies to. Mr. Straub stated that he had spoken to Joe Hellewell , Assistant County Attorney, in regards to attending any meetings where a legal opinion may be required. It was felt that three members attending a meeting would be sufficient for a quorum, majority would rule. No substitues would be able to vote. If three members could not make a meeting, it would be postponed to a later date. SUBJECT: Reason for Board DISCUSSION: Mr. McKee read the Code (Section 204, Chapter 2) dealing with the Board of Appeals. "In order to determine the suitability of alternate materials and methods of construction and to provide fbr reasonable inter- pretations of the provisions of this Code, there shall be and is hereby created a Board of Appeals, consisting of five (5) members who are qualified by experience and training to pass upon matters pertaining to building construction. The Building Official shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the (Mayor/County Commissioners) and shall hold office at his pleasure. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant and may recommend to the (City Council/County Commissioners) such new legislation as is consistent therewith.
