Subject. Revocation of BP No . 13683-79-377
Based upon a review of information received by our office
subsequent to the issuance of BP No . 13683-79-377 , it appears
that the building permit was incorrectly issued on the 80
acre parcel. Based upon said information, the 80 acre parcel
as shown on the BP application is actually two 40 acre parcels .
Section 3 .3 G. of the Weld County Zoning Resolution states:
"G. Minimum Lot Area - The minimum lot area in
the A-Agricultural zoned district shall be
determined by the classification of the
subject parcel in the records of the Weld
County Assessor. The minimum lot size for
parcels classified by the assessor as
irrigated lands shall be 80 acres. The
minimum lot size for parcels classified
by the assessor as dry lands shall be 160
acres. In the case of a parcel which
contains both classifications, the minimum
lot size shall be governed by the more
prevalent classification. (Rev. 12-29-76)"
Further Section 3.3 H. of the Weld County Zoning Resolution
states :
"H. Building Permits - No building permit shall
be issued for any construction on any parcel
of land in this zone which is not a "Legal
Lot" as defined in Section 12. 2 of this
Resolution; or unless the building permit
is to be issued in connection with a legal
non-conforming use pursuant to the
provisions of Section VII of this Resolution;
or in connection with a legal Conditional
Use pursuant to the provisions of Section
3.3(D) of this Resolution; or in connection
with a legal Special Use pursuant to the pro-
visions of Section 3 .3(E) of this Resolution.' OH�_,

"Legal Lot" is defined in Section 12. 2 (26) of the Weld County
Zoning Resolution as :
"Legal Lot"
As used in this Resolution, the term "Legal Lot"
shall refer to any parcel in existence at the
time of adoption of this Resolution, as indicated
on official records maintained in the office of
the Weld County Clerk and Recorder, or any
parcel created subsequent to the adoption of
this Resolution which was duly created in
accordance with the requirements of the Weld
County Subdivision Regulations and which meets
the minimum area and similar requirements specified
by this Resolution; or any parcel created sub-
sequent to the adoption of this Resolution which
was duly created in accordance with the Condition
Use requirements of Section 3 .3(D) of this
Resolution, or which was duly created in
accordance with the Special Use requirements of
Section 3 .3 (E) of this Resolution, and which
has been placed on record in the office of the
Weld County Clerk and Recorder. (Rev. 12/29/76)"
Our department is requesting you revoke BP. No. 13683-79-377 .
The Weld County Zoning Resolution states that no building permit
be issued unless in connection with a legal Conditional Use.
Such a Conditional Use has not occurred nor has one been applied
for at this time.
